ORDINANCE MAKING AN APPROPRIATION FOR THE INDEBT-
EDNESS TO BE INCURRED BY THE CITY OF WICHITA FALLS,
TEXAS UNDER CONTRACT WITH STUCKEY CONSTRUCTION
COMPANY AND SAID CITY FOR THE MAKING AND CONSTRUCTION
OF CERTAIN STREET IMPROVEMENTS ON A PORTION OF
TWELFTH STREET IN TIE CITY OF' WICHITA FALLS, TEXAS,
AND DECLARING AN EMERGENCY.
WHEREAS, the Board of Aldermen of the City of Wichita
Falls, Texas, has heretofore ordered the hereinafter described
portion of Twelfth Street improved by raising, grading and
filling same and by constructing thereon a 6 inch reinforced
concrete pavement with integral curbs; said portion of
Twelfth Street so to be improved being described as follows:
THE UNPAVED AND UNIMPROVED PORTION OF TWELFTH STREET
which lies in and between a north prolongation of the east
property line of Lot 4 and the west property line of Lot 5,
Block 251, Isley Subdivision of the Original Townsite of the
City of Wichita Falls, Texas, and an imaginary 'Line drawn
parallel to and at a distance of 59 feet east of the prolong-
ation of the east property line of the said Lot 4 and the west
property line of the sLiid Lot 5 and being the south one-half
of that portion of Twelfth Street within the limits herein
described, known and designated as Unit No. 109;
and,
WHEREAS, the City of Wichita Falls, Texas has heretofore
entered into a contract with Stuckey Construction Company, a
partnership of Wichita Falls, Texas, for the making and con-
struction of said improvements; and,
WHEREAS, the terms and method of payment of the cost of
said improvements as contained in said contract have been
modified and amended to the extent that no assessment is to be
levied against the abutting property and. the owner thereof for
a portion of the cost of said improvements, but in lieu of
such assessment the owner of the abutting property, Miss
Ossie Bowers, has agreed to pay and. has paid. the City of
Wichita Falls, Texas the sum of $300.00 for the pro rates cost
of the im-croverrients to be constructed on and. abutting her
property; and,
WHEREAS, the estimated cost of said improvements, based
on unit prices set forth in said. contract, is $ 7/46.7 Z.
and the City of Wichita Falls, Texas is desirous of paying
Stuckey Construction Company the full amount of the cost of
said improvements to be constructed by the said Stuckey
Construction Company; THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:

To provide for the payment of the indebtedness to be
incurred by the City of Wichita Falls, Texas by virtue of the

construction of the improvements hereinabove mentioned by
Stuckey Construction Company on that portion of Twelfth Street
hereinabove described, there be, and is hereby, appropriated
and set aside out of current revenues and available funds for
said purpose, the sum of $- A-1/6T .

The present condition of said portion of street to be
improved endangers health and safety and. the improvement of
same constitutes an urgent public need for the preservation
of peace, health and safety of property and it is necessary
that said improvements be constructed while the weather will
permit and the construction of said improvements is being
delayed pending the taking effect of this ordinance and such
fact constitutes and creates an emergency and. an urgent
public necessity requiring that the rules providing for
ordinances to be read more than one time or at more than one
meeting or that the ordinance shall not go into effect until
30 days after its passage be suspended and that this ordinance
be passed as and take effect as an emergency measure and
such rules are accordingly suspended and this ordinance is
passed as and shall take effect and be in force as an emergency
measure and shall be in force and effect iara.ediately from and
after its passage.
