WHEREAS, the public convenience, safety, and necessity require that the
highway traffic signal be installed, since the unprotected intersection constitutes
a danger and serious inconvenience to the public which is urgently required to be
remedied and that the only practical remedy is that of installing the highway traffic
signal as herein provided; and
WHEREAS, the State of Texas has made it known to the City that it will
furnish the necessary funds for the actual construction; prepare plans and specifi-

cations; install said highway traffic signal; and supervise construction, prov�ded
the City approves the plans, specifications, and location of said project; and
WHEREAS, the City, in consideration of the providing of said highway traffic
signal project, agrees to furnish the electricity, operate, and maintain the highway

f io signal project, agrees to protect the State of Tess from any and all liability
and any and all damages to adjoining and abutting property or other property or
business or to any tenants occupying such property, caused by the installation, the
construction, the existence, the use, operation, and the maintenance of the highway
traffic signal or the passage and enforcement of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL:
Section 1. That since the public convenience, safety, and necessity
require it, a highway traffic signal be constructed and provided at the intersection

Section 2. That the State of Texas be and is hereby authorized to con-
struct said highway traffic signal project at the location and in the manner shown
on the plans and described in the specifications attached hereto, marked "Exhibit
A", and mode a part hereof in all respects.
Section-3. That nothing in this ordinance shall be construed as to
require the State of Texas to assume or pay any direct, incidental or consequential
damages to adjoining, abutting or other property or business or to any tenants
occupying adjoining, abutting or other property caused by, incidental to, or in any
way connected with the passage and enforcement of this ordinance and/or by the
installation, the construction, the existence, the use, operation and/or the main-
tenance of the highway traffic signal project authorized herein, or to defend any
suit or suits which may be brought against the State of Texas by any party or

property occasioned by or resulting from the installation, construction, existence,
use, operation and maintenance of said highway traffic signal project and the passage
and enforcement of the Ordinance hereinabove referred to.

A G R E E M E N T;
NOW, therefore, in consideration of the premises and of the mutual covenants
and agreements of the parties hereto to be by them respectively kept and performed,
as hereinafter set forth, it is agreed as follows:
1. For and in consideration of the mutual covenants herein contained, the
City does hereby agree that all damages and claims for damages, including damages
to adjoining, abutting or other property, if any there be, arising out of, incident
to, or in any way connected with the installation, the construction, the use, oper-
ation and/or the existence of said highway traffic signal project and/or the main-
tenance thereof, shall be adjusted and paid solely by the City and the City shall
and does hereby agree to hold harmless the State against any and all claims, demands
and causes of action for recovery of any and all such damages arising out of the
installation, the construction, the use, operation and/or the existence of said
highway traffic signal project and/or the maintenance thereof, and agrees to assume
the defense of any and all suits brought for the recovery of all such alleged
damages, and shall intervene and make itself a party therein in its own name, .if it
is not already made a party thereto, for the purpose, and shall if requested in
writing by the State so to do, wholly relieve the State from defending the same,
and hereby agrees to hold the State harmless as to court costs, attorney's fees and
all expenses in connection with such suits, and hereby assumes and agrees to pay
all judgments recovered against the State by reason of the construction, the instal-
lation, the use, operation and/or the existence of said highway traffic signal
project and/or the maintenance thereof.
2. The State will furnish the necessary funds for the actual construction;
prepare plans and specifications; install said highway traffic signal project; Isupper

vise construction,
3. That after completion of construction of said highway traffic signal
project, the City will furnish the electricity, operate, and maintain the highway
traffic signal project at its sole cost and expense.
4. -That the Citywill make no changes
ngea in the type of signal or design
or operation of said highway traffic signal project without written authority by
the State Highway Engineer.
5. That the State shall have the authority to make such changes in the
operation of the highway traffic signal as it may 6eem necessary and advisable to
promote the safe, convenient, and orderly movement of traffic.
6. That the City shall be responsible for the police enforcement required
for securing obedience to the highway traffic signal.
7. It is understood and agreed by and between the parties hereto that
the City recognises that the public convenience, safety, and necessity require the
construction of the highway traffic signal project as herein provided and has con-
sented to the construction of the highway traffic signal project hereinabove named
by the approval of the location and manner of construction as shown on plans and
described in specifications attached hereto, marked "Exhibit A", and rade a hart
hereof.
8. In the event the terms of this agreement are in conflict with the
provisions of any other existing agreement and/or contract between the City and
the State, this agreement shall take precedence over the other agreement and/or
contract. All other provisions of said existing agreements and/or contracts not
in conflict with this agreament shall remain in full force and effect.

SPECIAL SPECIFICATION
"INSTALLATION OF HIGHWAY TRAFFIC SIGNALS"
1.O DEFUMITION OF TERM-
1.1 DISTRICT ENGI MP. The Engineeroit responsible charge of
the District in which the project .is located, or his author zed
representative.
1.2 NATIONAL ELECTRICAL CODE. The National Electrical Code as
published by the National Board of Fire Underwriters.
2.0 ENGINEERING SUPERVISION
The work will be done under the supervision of the District
Engineer, to his satisfaction, and in accordance with the puns,
specifications, and proposal. No changes shall be made in the plans
or specifications without written permission of the District Engineer.
3.0 INTENT OF PLANS AND SPECIFICATIONS
It is the intent of the plans and specifications to provide for
the installation of highway traffic signals of the best quality and
workmanship. They are intended to be co-operative, and in the case of
disagreement, the interpretation of the District Engineer shall govern.
4.0 REFERENCE TO 1WT'JFAC"TURERS' TRADE NAM1'S AND CATALOGUE NUMBERS
Reference to any manufacturer's trade name or catalogue number for
any item of material shown on the plans is for the purpose, of identifi-
cation only, and the Contractor will be permitted to furnish like
materials of other manufacturers provided they are of equal quality and
comply with these specifications.
5.0 BARRICADES
The Contractor shall provide and maintain such barricades, warning
devices, and/or flagmen as required by the District Engineer for the
protection of the public during the construction of the project.

7.0 MATERIALS TO BE FURNISHED BY THE CONTRACTOR
The Contractor shall furnish all materials necessary to complete
the project, other than those furnished by the State highway Depart-
ment, including materials for the power connection that are not fur-
nished by the Power Company and shall install the materials in ac-
cordance with the plans and specifications. The Contractor shall also
furnish all labor, tools, equipment, and incidentals necessary to
complete the project in an efficient and worlm anlike manner. All
materials furnished by the Contractor shall be new undeprec.iated Stock.
El cttical materials and fittings shall conform to the requirements of
the National Electrical Code. Electrical fittings shall be water -tight
and weatherproof.
8.0 POWER CONNECTION
The power connection shall be made to a 110-120 volt, signal phase,
60 cycle, A. C. supply. The Contractor shall make all arrangements for
connection to the power supply; shall obtain meter and meter socket from
the rower Company when they are required and install them in accordance
with the plans; and shall furnish and install all other materials neces�
wary to make the power connection which are not furnished by the Power
Company. The wire used for the power connection shall be a minimum
size of No. 8 American Wire Gage; shall be insulated for six hundred
(600) volts; and the cormon wire shall be white coded.
9,rO CONDUIT
All conduit shall. be galvanized rigid steel. each length of con-
duit shall be plainly marked with the Underwriters Laboratory approval
and shall be true to size and form, free from warps, kinks, and beds,
except the beads provided for in the plans and specifications. Bends,
when specified, shall be so made that the coriduit will not be injured
nor itc internal diameter chan,,ed. Bends shall be, of ,n,i ''orm
ture, and the inside radius of curvature of any bend shall not be less
than ten (10) tiy.es the internal diameter of the conduit where lead or
lead and steel -covered conductors are used, and not less than six (6)
times the internal diameter where rubber -covered conductors are used.
All couplings and connections shall be tight and waterproof. Each
length of conduit shall be reamed and threaded on each end. All
conduit and fittings shall have the burrs and rough places smoothed
and shall be cleaned and swabbed before the cable is installed. Cable
shall be installed in such manner that no foreign materials are per-
mitted to enter the conduit. Conduit installed vertically on the side
of the pole shall be attached to the pole with galvanized pipe straps.
10.0 WIRING
10.1 PLASHING BEACON OPERATION, No wiring is required for the
controller except the connection to its terminals of (1) the power

Wires, (2} the wires of the cable Leading to the signal, and (3) the
ground wires. The power and signal wires shall be attached to the
terminals of the controller i.sa accordance with the Wiring Diagram
oil the inside of the d:)or of the controller housing, thd the ground
wires in accordance with the plan sheet, "13rourding Details." The
ends of the common or whitc> coded wire and. the positive or black
coded wire of the signal cable, opposite to those ends that are con-
nected to the controller, shall be connected to the common and posi-
tive terminals respoctively in the si,nal housing. In NON-ADJUSTABLE
Flashing B�:acon housings the two negative terminals shall be connected
together and the two positivb terminals connected together by means of
bus -bass or Jumper wires, unloss they are connected together when
furnished.
10.2 FEED -TIME SIGNAL OPERATION. No wiring ire required for
the controller except the connection to its te=..Inals of (1) the
power wires, (2) the wirers of the cable leading to the signal, and
(3) the ground wires. The ground wires shall be attached to the
terminals of the controller in accordance with the plan sheet,
"Grounding Details," and the power and signal wires shall be attached
to the terminals of the controller and the signal in accordance with
instructions in the "Controller Manual" to be furnished with the con-
trollov. Any modifications will be covered under Special Provision
to Item 10, Special Specification "Installation of Highway Traffic
Signals."
10.3 SPLICES
1. Splices will not be Permitted in the wires of the
signal cable or other wires in the wiring of NON-ADJUSTABLE signals.
2. Splices will be permitted in the wires of the signal
cable in the junction of the arms supporting the different facers of
AL'JUSTABLF signals. Such splices shall be made with devices which
meet the requirements of the National Electrical Code. The joint shall
be cov?red with an insulation or
ual to that on the conductor.
10.4 TF.fMINALS. The ends of all wires which are to bo attached
to terminal posts shall be provided with solderless terminals that meet
the requirements of the National Electrical Code.
10.5 WIRE. The minimum size of conductors shall be as follows,
subject to the further limitation that the maximum voltage drop of
any one of the following shall not be more than five (5) per cent:
1. From power source to controller or flashing mechanism,
Number eight (8) American Wire Gauge. The power
common shall be white coded wire.
2. From controller or flashing mechanisms to signal heads
or beacon heads, Number twelve (12) Am,ericen.Wtre Gauge.

All wire and cable furnished by the Contractor
shall, ?unless otherwise specified, conform to
the pertinent specifications of the National
Electrical Code and shall be insulated for six
hundred (600) volts.
10.6 ENCLOSED WIRING. There shall be no exposed wires, cables,
or conductors within ten (10) feet above the ground surface and there
shall be no suspended wires, cables, or conductors within fourteen and
one-half (14.5) feet of the surface. Power tap lines carried down
the signal poles shall be placed in conduit as hown on the ,plans.
11.0 GROT2,DII G
The signal housi-ng, controller housing, signal common, and service
common shall be grounded as shown in the plan sheets, "Groundias ]Dv,, -
tails,," and "Construction Details for fixed -time Signals" or "Con-
struction Details for Flashing Beacons." The Power Company shall also
ground the service common at its pol3 from which the power is taken.
All grounding, devices specified shall conform to the requirements of
the National Electrical Code.
12.0 SEALING
After the signal cabl= connecting the signal and the controller
is in place, the unfilled portions of the openings which wrF.:• provided
for the entrance of the cable to the signal head and the condulet attach-
ed to the metal pip,; conduit shall be sealed with a sealing compound ap-
proved forthe"°iurpose by the National Electrical Code. The sealing
compound used shall have a melting point of not less than two hundred
(200) degrees FahrenhQit, and shall.not be affected by the surrounding
atmosphere or moisture.
13.0 POLES
All T;oj.,n used for installation of the signal shall be Southern.
Yellow Pine and shall conform to the American Standards Association
Specifications for Southern Pine Top Dimmension Poles or Equal. All
poles shall have a minimum top diameter of eight (8) inches and shall
have an 8# creosote oil treatment.
14.0 CONCRFTE
When concrete foundations for poles or concrete block type
anchors are specified on the plans, the concrete shall be Portland
Cement concrete mixed in the following proportion:

All aggregate shall be clean; the cement shall be an accepted
standard brand; and the grater used for mixing shall be potable. All
materials ahall be subject to inspection and approval by the District
Engineer before they are used, and the concrete shall be thoroughly
mixed and placed in accordance with the plans and specifications and
as directed. by the District Engineer.
No concrete shall be placed when the atmospheric temperature is
at or below 40OF (taken in the shade away from artificial heat) an -
lens permission to do so is given by the District Engineer, When slUch
permission is given, in cases where the temperature drops below floor,
the Cop -tractor shall take such precautions that may be prescribed to
prevent freezing of the concrete.
15.0 CONCRETE FOU14DATION FOR POLES

the concrete shall be
specifications and shall be placed to neat lines. After the excavation
for the pule has been completed, the pile shall be placed in the hole,
adequately braced it the position sho-vm on the plans, and the remainder
of the excavato d srace filled with concrete. After all the concrete
has been placed and the top struck off, it shell be covered with a.
niece of wet burlap,, which shall be kept wet for a period of at, least
eighteen (18) hours. The bracing for the. poles shall be left In place
for a minimum period of twenty-four (24) hours after the concrete has
been placed, during which time, the cable shall riot be attached to t1t3
poles nor shall the poles be subjected to any applied strain.
16.0 GUY ANCHORS
16.1 EXPANDING TYPE. Expanding Type anchors shall be Chance
Wejlock 8" -4 way or equal. (Hubbard Catalog No. C-84-W)
16.2 CREOSOTED PINE ANCHOR LOG TYPE. Creosoted Pine Anchor
Logs snail conform to the American Standards rissociatiorl Specifications
for. Southern Pine Top Dimension Poles or Equal. `The anchor logs shall
receive an Si- creosote oil treatment, and shall be a minimum size of
8" diameter and 5'-0" long.
16.3 CONCRETE BLOCK TYPE. The concrete shall be in accordance
with item 14.0 of these speciZications, and It stall be placed to neat
lines. The hole excavated for the anchor shall be filled to a dep{1-h
of eight (8) inchr)s with concrete, the anchor rod placed, and the hole
filled with concrete to the depth shown on the, plane. After the con-
cret:; has been placed, it shall -be covered with a piece of thoroughly
wet burlap which shall be kept wet for a minimum period of at least
eighteen (18) hours. When it is necessary to rewet the burlap, it shall

be removed from the hole and no water shall be poured into the hole.
After a minimum period of eighteen (18) hours, the rem--.6ining unfilled
portion of the excavated hole shall be backfilled with earth in layers
nct to exceed ten (10) inches in depth and thoroughly compacted. No.
strain shall be placed on the anchor rod for a minimum period of
twenty-four.(24) hours after it iib placed in the concrete.
16.4 ANCHOR RODS. Arichor rods s Za.11 be galvanized and shall be
5/8" round for lengths of 6'-0" to 8'-0" inclusive, and 3/4" round fcr
lel'gtlis of 9' -0" and 10' -0" . The length of each anchor rod shall be
determined by its depth in the ground and the angle it makes with the
ground. Each anchor rod shall be provided with a 4" square galvanized
washer.
17.0 (XY WIRE ATTACHMENT TO ATJCHOR RODS
The guy wires shall not be attached to the anchor rcd until after
the si}jal is suspended at the height above thti roadway shown on the
plans, subject to the further limitation that where Concrete Block
Type anchors are used, the guy wires shall not be attached to the anchor
red until the concrete shall have been in place for a mir_i?:ituri period of
twenty-four (24) hours. The guy wire shall then be attached to the
anchor in accordance with the plans and pulled to a taut strain.
18.0 PAINTING
1'he r:,eter socket, metal pipe conduit, all exposed conduit fit-
tings, and guy guards shall be given two coats of aluminium paint
after they are..i:n place. No painting will be required for Controller
Housing or Signal Head except those parts on which the paint has been
scratched or marred, and such parts shall be _Lven two coats of high-
graue black enamel.
When Crosswalk lines and Stop lines are shown on the plans, they
shall be painted with two coats of white paint.
19.0 EXCAVATION
19.E SIZE OF EXCAVATIOW. The size of the excavation for poles
where concrete foundations are not used. shall be as small.as practicable
topermit proper•lplacing of the holes. Excavation required for concrete
foundations for -poles and for otter parts of the installation shall be
of the size shown on the plans.
19.2 BACKFILLING. Earth backfill shall be placed in layers
not tc exceed ten (10) inches in depth and thoroughly compacted.
Excess excavated material shall be disposed of as directed by the
District Engineer.
20.0 PREMiRVATION OF SOD, SHRUBBERY, AND TREES
The Contractor shall assume full responsibility for the preserva-

tion ::f all sod, shrubbery, and trees at the site, during the installa-
ticn and where necessary to remove any scd, shrubbery, or tree branches,
he shall obtain permission from the oiY_ier. All sod and shrubbery:;that
are ren,Dved shell be carefully preserved and replaced in their original
positions. Da=,ged s,Dd ar shrubbery shall be replaced by the Contractor
at his own expense.
'21.0 RFMOVAL AND REPLACEMTT OF PAVE14ENT) CURBS, AND WALKS
Tho Contractor shall secure permission from the proper authority
and the a.pprc:-vul of the District Engineer before cutting into or re -
Moving any pavement, curbs, or walks which -might be required in making
the installa•cion. After the work is completed, the Contractor shall
restore any pavement, curbs, or walks which have been removed t:: the
equivalent of their original condition a,.d tc-1 the satisfaction of the
District Engineer.
22.0 EXTRA WORD
Additional work, made necessary by changes and alterations u'f
plans or f quantities or for other reasons, shall be defined as
"Extra Work" and shall be performed. by the Contractor in accordance,
with these specifications and as directed; provided, however, that
before any "Extra. Work" is begun, the additional compensation for its
execution shrill be agreed upon in writing:, by the District Engineer and
the Contractor.
23.0 REMOVAL OF DEIYC^1IVL WORK
All work cr matorials which have been rejected shall be ro nodied
or roziovad rand replaced in an. acceptable manner by the Contractor at
his ,)wn expense.
24.0 DISPOSITION OF KEYS FOR C014TROLIEIRS AND INSTRUCTION MANUAL FOR CONTROLLER
When the project is complete, the keya for the controller. boos
in.4s shall bra delivered tc the District Engineer. The Instruction
Manual for Controllers furnished for Fixed -time Signals shall be left
inside the controller housing;.
25.0 FINAL CLEANING UP
Upon completion of the work and before the project is accepted
and pavement made, the Contractor shall remove all rubbish, debris,
and barricades from the site, restore in an acceptable manner all pr,;-
'perty, both public and private, which has been damaged during the

26.0 AWARD AND EXECUTION OF CONTRACT
. 26.1 CONSIDERATION OF BIDS. For the purpose of award, after
the proposals are opened and read, the summation of the products
of the quantities shown in the -proposal by the unit prices bid will
be considered the amount of the bid. The summations will then be
compared and the results made public. Until the award of the con-
tract is made, the right will be reserved to reject any or all pro-
posals and to waive such technicalities as may be considered for the
best interest of the State.
26.2 AWARD OF CONTRACT. The award of the contract, if it
be awarded, will be to the lowest reasonable bidder. The award,
if made, will be within thirty (30) days after the opening of the
proposal, but in no case will an award be made until the responsi-
bility of the bidder to whom it is proposed to award the contract
has been investigated.
26.3 EXECUTION OF CONTRACT AND BOND. Within fifteen (15)
days after written notification of award of contract, the Contrac-
tor shall execute and file with the Commission a contract and bond
on the Form provided, in the full amount of the contract price,
executed by a surety company authorized to do business in the State
of Texas, as.a guarantee of the faithful performance of the con-
tract and the payment of all obligations which may be incurred for
material and labor used in the performance of the work.
26.4 APPROVAL OF CONTRACT. Contracts will be signed by the
State Highway Engineer.
26.5 FAILURE TO EXECUTE CONTRACT. Should the successful
bidder refuse or neglect to execute and file the contract and
bond within fifteen (15) days after written notification of the
award of the contract, he will be automatically disqualified.
26.6. BEGINNING OF WORK. The Contractor shall not begin
work until authorized by the Engineer in writing to do so.
