SECTIOI�jf I.
(a) The term "city" as used in this ordinance shall mean
city

ordinance shall mean and include any street, alley, avenue, boule-
vard, drive, Public way, or high

(c) The term "taxicab" as used in this ordinance shall
mean every motor vehicle transporting passengers for hire, other
than motor vehicles operating, under a permit Or certilficate of the
Railroad Commission of the State of Texas or the Interstate Comimerce

COMM-Ission; p2ovided, however, the term "taxicab" shall not apply to
motor busses operated within the City of _--iichita Falls under a
wr-ittel-I franchise from the City o� Wichita Falls, Texas, over a
fixed or definite route.
(d) The term "person" as used in this ordinance, shall
include both singular and plural,d anshall ,mean a.ad embrace any

and ;he term "operator", whenever used in this ordiiiancel shall
mean any person, 0 -)artLnership or

society which has the control

benefit of the collection of revenue derived from the o
I peration of a
taxicab or taxicabs on or over the streets of the City of diclaita
Falls, whether as owner or otherwise; provided, the terf,,, "driver",
as hereinafter defined, shall not be included within this definition.
(f) The term "driver" or "chauffeur", as used in this
ordinance, shall mean every person who actually drives or manipu-
lates a vehicle used as a taxicab, as herein defined, whether as
owner or as agent, servalit or euilployee of an "owner", as rrerein
defined.
(g) The tern "taximeter", as used in this ordinance,
shall mean a machine adapted automatically to calculate, at a
yiredeter;ained rate or rates, and to register tyre charge for the
use of a taxicab.
(h) The tern: "waiting tune", as used in this ordinance,
shall mean such time as may be consuried or lost at the special
instance and request of a passerLger, after such r)assenger has first
engaged and entered a taxicab to ? is -,e a trip and before reac LIg
his final dest nation; and no charge shall be Tirade agairrst a
oasse119er for any time lost on account of any other delay whatsoever.
(i) The term "taxi sub -terminal", as used in this ordi-
nance, shall mean and include any place other than a taxi -termi vial
at which the drivers or chauffeurs of taxicabs, shall receive calls
from a disy)atcher as said calls are relayed from a taxi-teri;iinal
or taxi -stand, and it shall likewise mean and embrace that space
and area used by taxicabs 1ti1hile waiting for raasseigers.
( j) The term, "Taximeter service irisy,ector", as used in
this ordinance shall mean the em,Dloyee of the city that is designated
by the City i,ianager to supervise the oLLoeration and chec'_ing of tax'
meters and the operation of to,,=.icabs in the city of °dichita Falls,
Texas, �,1hose duties shall be to see that the terns of t ais ordinance
are carried out and to report violations of this ordinance and to
file complaints where there is evidence of violations.

T±-rere shall be a-p.)ointed by the City 1. anager of 'Vlichita
�{'a11s, with the appiroval of the 3oard of Aldermen, a city taximeter

service inspector. His duties shall be to e-.force the 1,rovisions
Of t',Ii s ordill-ance and all other valid ordinances heretofore and
hereafter written witx res--I)ect to regulating any and all public
transportation in the City of 4vichita Fails, Texas, and to furnish
the city council and City Manager with inf orm_ ation concertling taxi-
cabmeters whenever that body calls for such information or as
provided in this ordinance.
SEICTIOI-s III: T.,_XIHL]TERS
From and after the effective date of this ordinance there
shall be placed on each taxicab operated within the city limits of
the City o_c Wichita Falls, Texas, what is known as a taximeter
wliereby said taximeter registers automatically and sets the charges
for taxicab- assenoers within the corporate limits of the City of
'Wichita r'a11s, -'exas . Said taximeter shall be visible to passengers
at all times day and night; and, after sundown, the face of the
taximeter shall be illuminated or lighted. Such taximeters shall
be set on the rates as hereafter designated.

Beginning /1,1c /-i cA, /, J `VS I , The ;hoard of aldermen
shall require the installation and use of a taximeter in each taxi-
cab o-erating in the City of '0ichita Falls, at which time the
following schedule of rates alid fares shall become effective and
shall supersede the schedule of rates and fares ,provided for:
(1) The rate of fare for one person shall be thirty-five
cents (350) for the first one and one half (1) miles or fraction
thereof traveled by him; and ten cents (100) for each additional
one half Mile or fraction thereof traveled by him; and for each
additional passenger transported on the same trip, the charge
shall be twenty-five cents (250), provided all passengers are in
sane _party.
(2) For each one minute of waiting time during each trip
the rate shall be five cents (50).

(a) There shall be designated by the city cab operators
and ap,)roved by the City Traffic .Engineer open parr`-ing stands for
taxicabs in such ;lace or places upon the streets of the City of
Wichita Falls as may be deemed necessary for the 7_se of taxicabs
operated in the city. No oyaen stands s iall be established without
taxiing into consideration the need for such stands by the companies
and the convenience to the general public. JTo sub -terminal and/or
open stand shall be established in front of any place of business
without the consent of the abutting ;.property owner or in any place
where such stand would create a traffic hazard.
(b) Open stands shall be used by the different drivers
on a first come first served 'oasis. The driver skull pull on to the
open stand from the rear and shall advance forward as the cabs ahead
mull off. Drivers shall stay within five feet of their cabs; they
shall not solicit passengers; or, engage in loud or boisterous talk
while at an open stand. in this ordinance shall be construed
as Jreventing a -)assei.,lLer from boarding the cab of .-_is choice that is
parked at o.)en stands.

It shall be unlawful for any driver, passenger, or o-perator
or any other person to tamper with or cheat the taximeter situated
on the taxicabs Within the corporate limits of the City of Wichita
Falls, Texas. 3y tampering is meant breaking into the taximeter
and interfering with the normal operations of said taximeter.

It shall be unlawful for any driver, operator, or other
person who is duly licensed to operate a 'taxicab within the City of
Wichita Falls to fail to use or place in use taximeter on such taxi-
cab when passenger or pas:-e.«gers are in taxicab fr_ oin and after the
effective, date of this ordinance.
(a) Every driver, chauffeur, operator or other Jerson
duly licensed to operate a taxicab in the Jit% of Wichita Falls,

Texas, shall put in use said taximeter and shall if in the daytime,
lower the flag t)laced on said cab for the pu2-pose of indicating the
presence of a zassenger or passengers in said cab, and ii at night-
time (nighttime being for the pt;r )ose of this ordinance all times
beginning thirty minutes after sundown and continuing until thirty
minutes before sunrise) turn off the light placed on said cab for
the pur)ose of indicating the )resence of a )assen,,er or passengers
therein; said "flag" to be lowered and said light to be turned uff
immediately upon the entrance of any passenger or passengers and
remain as a signal until said cab has been empt_-ed. Eriij)ty taxicabs
thus being indicated in the daytime by the flag being up and at
nighttime by a burning light.
(b) .any police officer of the City of dicizita Falls,
Texas, is authorized and er_ipowered to arrest any drivers, chauffeur,
operator or other pe_fson driving or operating any taxicab who
violates any of ti'le provisions hereof, and may arrest any driver,
chauffeur, operator or other )ersoii duly lice.used to overate a
taxicab ;within the city limits of tdichita rails, Texas, who while
so operating the same with a passenger or passengers in said cab,
fails to have the "flag" lowered to indicate the presence of said
passenger or passengers, if in the daytime, or w1io fails to have the
signal light off to indicate the -_)resen.ce of said passenger or
yassengers, at all other tulles beginning thirty (30) Anutes after
sundotvn and continuing until thirty, (30) minutes before sunrise.

or inconsistent with the provisions of this ordinance are hereby
repealed; Drovided that said repeal shall ap,.,ply only to the eXtent
of conflict or inconsistency.
Any person, fir,,A, or corJoration who violates any
)rov.ision of this ordinance shall be guilty of a ..iisderieanor, and
u-?--n conviction, shall be fined in any sum not less t-km-n ten
