SIT,IT OPJ7AIIJED b�Y THE �:OAt OFAL;�E -DO O of THE CITY O:� vTICH1`jA FALLS: 1. This ordinance shall be termed the Loading Zone Ordinance for the City of Wichita Falls. 2. As used herein the following definitions are given: a. A loading zone is defined as a apace in front of a business location to be used for the purpose of loading and unloading merchandise by the owner of the business adjacent thereto, and may be used by any carrier for the purposes of loading or unloading merchandise to be delivered or shipped from such location. Such space may also ie used to park the truck of the owner which he uses in the loading and unloading of merchandise. b. An alley entrance is defined as a building that abutts on and has an entrance to an alley, either public or private, that provides access to a street or other thoroughfare for vehicles used in har ling and loading and unload- ing merchandise. c. Soace as used herein is defined as an area of twenty-one (21) feet parallel to the curb or in the eirent that the space is in an area where annle par:>ing is penitted, the same shall be eleven (11) feet parallel to the curb. 3. Upon the date of the passage of this ordinance loading zones with the space provided in paragraph 2 of this ordinance shall be immediately estab- lished by the City Traffic Commission for those concerns now doin7 business and enumerated in paragraph 5 of this ordinance. �--_bsequently, if other concerns of the same type are established, suc1 business shall be entitled to a sirw.lar amount of space as a loading zone, but not until after a hearing before and approved b7y the City Traffic Commission, and not until the applicant therefor has shown that he handles mere} andise for sale or distribution, ghat he maintains equipment for the transportation, loading and unloading of such merchandise, and that mer^handise must be b-ought in or out of the building adjacent to the loading zone. 4. Ho vehicles other than those used in the loading and unloading of merchandise and in the transportation thereof shall be parked in any load- ing zone. 5. The allocation of loading zones shall be made by the City Traffic Com?i!ission to business establishments on the followi.nf- basis: Appliance Stores With alley entrance, no space. AUiout alley entrance, one space. Army and Navy Stores WitF aMy entrance, no space. Without alley entrance, one space. Automobile Dealers With Garages in Connection Driveway only, Automobile Garages Driveway only. Automobile Storage Concerns One entrance and one e exit. Auto Stores — I al ey entrance, no space. Without alley entrance, one space. Bus Lines Paring space for not to exceed three buses at each authorized stop. Cleaning and Dye Works %iith ai7ey_entrance, no space. This ordinance shall not abrogate the City's liability or duty under any presently existing contract where the person who has obtained the loading zone is paying the City of vdichita halls a rental on a monthly basis for such loading zone, provided, that upon the termination of any such contract the sane shall not be renewed. Such contracts are to be terminated immediately upon nonpayment o.-' any rental due thereunder. 7. In the event that any loading zone granted under this ordinance is not being used for the purpose of loading and unloading merchandise, there- after and after a hearin.- thereon 1:,y the City traffic Gommission, such loading zone may be by such Commission ordered discontinued. 8. In no instances shall additional space be granted for a loading zone other than that set forth in paragraph 5 hereof unless the applicant there- for shall show that the same is reasonably necessary for the ordinary- conduct of his business, and that it will not unduly interfere with traffic on the City Streets. 9. No charge or fee shall be made for the use of loading zones pro- vided for in paragraph 5 of this ordinance. - 4 - 2.0.
