THE DISCRETION OF 'IT-IE COURT HAVING JUTtISDICTION. EACH AND EVERY VIOLATION OF
THE PROVISION OF THIS ORDINANCE SHALL CCIISTITUTE A SEPARATE OFFENSE; REPEALING
ALL ORDINANCES OR PARTS OF O?DINA-'CES IN C0Nf11TICT '�JT'U r111IS 0 0INA,ICE; AND
PROVIDING A SAVINGS CLAUSE.
BE IT GI-0AINI ED 13Y THE :L-CAi' D' 021 ALD :MI 0 THE CITY OF WICHITA FALLS, TEXAS:
SECTION 1, Permits. It shall hereafter be unlawful for any person,
persons, firm or corporation to keep certain animals or fowls of any kind or
sex or description within the city limits of the City of Wichita Falls who
does not possess an unrevoked permit from the health officer or his authorized
representative of the City of Wichita malls. Only persons who comply with the
requirements of this ordinance shall be entitled to receive such a permit.
A permit may be temporarily suspended by the health officer or his
authorized representative on violation by the holder of any of the terms of t'_nis
ordinance, or revoked after an opportunity for a hearing by the health officer
upon serious or repeated violation or violations. The annual permit fee for
the keepers of animals or fowls shall be One (`?'1.00) Dollar. Honeys received
from the issuance of permits shall )e used to assist in the cost of inspection
service, and the printing of forms for same.
SECTION 2. Exceptions. (a) It shall at any time be unlawful to keep
a hor, or hogs, a pig or pigs,.wi.thin the city limits of '�7ichita Falls, Texas.
(b) Permits will not be required for the keeping of
chickens or turkeys in a brooder or battery or for the keeping of poultry tJUhin
the business district for sale if said poultry areas are kept in accordance with.
the Sanitary Code of the State and the Ordinances of the City of Wichita Falls.
(c) Dogs and cats shall be excepted from the provisions
of this ordinance.
SECTION 3. Inspection of Places of Keeping of Animals and Fowls:
At least once every three 3 moms the health officer or his authors:ed repre-
sentative shall inspect every area or place for which a permit has been issued
for the keeping of animals and fowls. In case the health officer discovers
the violation of any item of sanitation, he shall make a second inspection
after the lapse of such time as he deems necessary for the defect to be remedied,
and the second inspection shall be used in determinin* compliance with the re-
quirements of this rrdinance. Any violation of the same item of this ordinance
on such second inspection shall call for immediate suspension of the permit.
The person or persons, firm or corporation keeping,animals
or fowls within the corporate limits of the City; of Wi.ch:1_ta falls shall upon
request of the health officer or his authorized representative, permit access
to the area or places of keepiinz of animals or fowls.
SEC�CON 11. He7—ulations and Sanitation Requirements for the Keeping
of Any Poultry, Fowl or Fowls. it shall oe unlawful for any person, persons,
firm or corpor. atToH-to violate any o ' the follo�Ang:
(a) Keep, harbor, maintain or permit the presence on
any lot or parcel of land within the City of .ichita Falls any poultry or fowl
of any kind, sex or description, other than not more than one for each ten square
Feet of floor or around area, ni.geons excepted.
(b) beep any poultry,, :fowl or fowls i-rthin any structure
in the City of Wichita Falls without scraping the floor of the mom, coop, box
or compartment and thoroughly cleaning the area within which such foul or fouls
are kept at least once every forty-eight (48) hours and so maintaining such
structure or enclosure that no offensive odors are emitted therefrom.
(c) Keep any chickens or turkeys within any structure the
interior of which is not w'_zitewashed at l-ast once every six months and wihout
snra,;r.nr; cr.:de oil or some disinfectant on the roosting places at least, once in
each calendar month to di.scoura.ge insects, fleas, mites and flies.

SPECK. It shall. be unlawful fbr ary person, pe_ ss,osrrr or corporation to
vio7_ate any of the following:
(a) To feed, breed, stable, pasture, or keep any cow or
cows, goat or goats, horse or horses, sheep or any other animal of Like species
in or or any lot, -pen, b,:7ildins , parcel of land, stable or other enclosure, in
the Ui.ty of ?•,ichi to -'all.s, Texas, any part of which lot, pen, wilding, stable,
parcel of land or other enclosure, is nearerthan 100 feet to any %)uild.ing occl pied
oar a.ny person or persor_s any part of the dad- or n=. ht. A mi.ni.mur of 1;00 square
feet of area shall be req,,i red for each animal, and nct none than two i 2) animals

other pests.
SECT",01,T 6. Hereafter, each and evens lot, pen, 'building, stable or
other enclosure in the City, of `:,ichi_ta Falls, Texas, in or ar_ which any of the
above naried animals or other species are kept, fed, bred, stabled, pastured
or housed, shall have a suital:le manure box or container in which all manure and
dronpinf-s shall be placed daily. Each such box or container shall be securely
screened or otherwise protected fron flies, ver:ma_n and rodents, and si a7.7. be
cleaned out and disinfected at least once a weep. Hanure frcm such boxes or
containers shall_ not be left in open stacks but reroved or buried.
SECTION 7. Enforcement. This ordinance shall be enforced by the 1'ealth
Officer of tine City of ch�_ta Falls or his authorized representative.
SECT CN 8. Penalties. Any person w:-:o violates any of this

ordinance shall be fined not more than NTo Hundred (4>200.00) Dclla rs at the dis-
cretion of the court having jurisdiction. Each and every violation of the pro-
visions of this ordinance shnl constitute a separate offense.
SECT ON 9. Repeal and Hate of Effect. All ordinances and parts of
ordinances in conflict with this o drdiinarce are-�.ereby repealed and from and after
thirty (30) days from the date of pa--sa-e of this ordinance all person or persons,
firm or corporation or association desiring to keep fowls or animals ,.7ithin the
city limits of 7-li chi.ta Falls, Texas, must corform with the requirements of this
ordinance.
SECTION 10. Unconstitutionality Clause. Should any section, paragraph,
sentence, clause, or phrase of this ordinance be declared unconstitutional or
invalid for any reason, the remainder of said ordinance shall not be affected
thereby.
