PRESENT STOCK OF SHRUBBERY, PLANTS AND TREES ALIVE; PERMITTING WATLRING AT
CERTAIN HOURS ON CERTAIN DAYS BY ZONES; PROHIBITING THE WASHING OF AUTOMOBILES,
TRUCKS, RAILROAD CARS OR ANY TYPE 1,101ILE EQUIPMENT, EXCEPT AS DESIGNATED IN
THIS ORDINANCE; PROHIBITING THE VJASHING OF FILLING STATION APRONS AND FLOORS,
OR THE INTERIORS OF BUILDINGS, TRUCKS OR RAILROAD CARS; PROHIBIT'INIG THE WAST-
ING OF ANY WATER THROUGH DEFECTIVE PLUMBING; PROHIBITING THE USE OF tdAT]l,R FOR
AIR CONDITIONING SY6TE1IS, UNLESS THE SAME ARE EQUIPPED AS HEREIN PROVIDED;
PROHIBITING THE USE AND WASTE OF WATER IN FOUNTAINS, SWIM2IING POOLS UNLESS
RECIRCULATED, GOLF COURSES, MINIATURE GOLF COURSES, OR ANY RECREATIONAL
GROUNDS; PROVIDING TH,,,T WATER USERS OUTSIDE THE CITY LIMITS OF THE CITY OF
WICHITA FALLS SHALL COMPLY WITH THE SAME TERMS AND ILEGULTIONS, THE FAILURE
TO SO COItPLY THEREWITH SHALL AUTHORIZE THE DIRECTOR OF UTILITIES OF THE CITY
OF 'TICIITA FALLS TO DISCONTINUE WATER SERVICE ALTOGETHER; PROVIDING THAT
OTHER MUNICIPALITIES TO WHOM THE CITY OF WICHITA FALLS SELLS WATER MUST
COMPLY WITH THESE TERMS ARID REGULATIONS AND THEY SHALL EE REQUIRED TO IM-
POSE THE SIRE RESTRICTIONS ON THEIR INHABITANTS; PROVIDING FOR THE IATERING
OF CEHETERIES, CHURCH AND BUSINESS LA1.JNS OR YARDS, AND PARKS, TOGETHER IJITH
.BASE BALL AND FOOT iLL FIELDS; IMPOSING A PE TALTY FOR THE VIOLEiTION OF THIS
ORDINANCE; PROVIDING A SAVING CLAUSE AND DECLAIZTNIG AN 1iERG&TCY.
WHEREAS, the City of Wichita Falls and the metropolitan area of the
City of Wichita Falls has depended for many years on surface waters as a sup-
ply of water for the use of its inhabitants and industries; and,
WHEREtLS, the principle source of water supply for the City of
Wichita Falls, that is, Lake Kickapoo in Archer County and Lake ?dichita in
Wichita and Archer Counties, has insufficient water to permit the indiscrimi-
nate use of water by its inhabitants and businesses and in order to safeguard
^nd fully utilize the water supply that the City of Wichita Falls now has on
hand for essential uses, such as household consumption, fire protection,
maintenance of health and samitary facilities and the operation of essential
businesses,,the Board of l.ldermen of the City of Wichita Falls is required to
take immediate steps to prohibit and restrict the use of water for non -essential
uses and to enforce conservation measures which will limit the use of such
water as is now available for only essential uses; NOW THEREFORE,
TEXAS: HE IT ORDAINED BY THE BOARD OF ALDEMIEN OF THE CITY OF 1rdICHI T11 FILLS,
SECTION 1. That for the purpose of this ordinance the City of
Wichita Falls is divided into three (3) zones for restricting water usage,
such zones being as follows:
(1) ZONE ONE - That area north of the Wichita Valley
Railroad tracks and west of Brook Street;
(2) ZONE 'B110 - That area south of the Wichita Valley
Railroad tracks and west of Holliday Street;
(3) ZONE THREE - The balance of the area of the City
of Wichita Falls, being that portion of the City east of Brook Street and
north of the Wichita Valley Railroad tracks, or east of Holliday Street and
south of the Wichita Valley Railroadtracks.
(That attached hereto is a map designating the
three zones above described to show with more particularity the areas in-
cluded in each zone.)
SECTION 2. That the use and withdrawal of water from the City of
Wichita Falls water supply system for the following purposes is hereby pro-
hibited, except as set out in Section 3 hereof:
(1) The sprinkling or watering of trees, shrubbery, or
grass through the use of a hose or otherwise; provided, however that nurseries
shall be allowed to use a minimum amount of water to keep their present stock
of shrubbery, plants and trees alive.
(2) The washing of automobiles, trucks, railroad cars,
or any other type of equipment; provided however that service stations, car
dealers and fleet owners shall be allowed TWENTY THOUS1dTD (20,000) gallons
of water per month for all purposes and providing further, that they maintain
and use automatic cut-off nozzles when cars or trucks are being washed.
(3) The washing of filling station aprons or floors
and interiors of buildings, trucks, or railroad cars; provided however that
the fire marshal may permit the reasonable use of water for the wadling of
filling station aprons and floors essential to public safety and the pre-
vention of fire hazards.
(4) The wasting of any water through defective plumbing;
defective plumbing being defined as plumbing that has been permitted to remain
out of repair, such as leaking water closets, surface leaks, underground leaks,
defective faucets or taps.
(5) Evaporative cooling systems capable of moving more
than 1800 cubic feet of air per minute must be equipped with recirculation
pumps. Refrigerated or mechanical cooling systems must be equipped with
recirculation pumps and such systems shall not require make up water at a
rate exceeding 5% of the recirculation rate. It is further provided that
all air conditioners producing 1800 cubic feet of air per minute, and smaller,
of the evaporative type, and without pumps, -h all be fed by a water inlet of
not more than 1/8 inch opening.
(6) The use of water in fountains, ornamental or other-
wise, swimming pools unless recirculated, wading pools, golf courses, miniature
golf courses, or any recreational grounds, except as herein provided.
It is the intention of these prohibitions to be all
inclusive in that it shall cover every person, firm or corporation using water
from the City of Wichita Falls supply system, whether the particular indivi-
dual has a contract for water service with the City of Wichita halls or not.
,any use of water for the purposes or in the manner
prohibited in this section shall be deemed to be a waste of water and any
person, firm, or corporation violating any provisions of this ordinance �h all
be deemed guilty of such offense and shall be punishable as hereinafter pro-
vided.
SECTION 3. 'That in order to permit a limited use of water for the
purposes stated in this section, the following exceptions to the above restric-
tions are hereby made:
(1) Persons residing in ZONE ONE whose property is
numbered by street designation as an even number may water on Honday and Friday
of each week between the hours of 6:00 a.m.
nd 9:00 p.m. on said days. Persons residing in such zone
whose property numbers are odd shall be allowed to water on Tuesday and Sat-
urday of each week between the hours of 6:00 a.m. .

(2) Persons residing in ZONE 7,40 whose property is an
even number by street designation shall have the privilege of watering on
Wednesday and Sunday of each week between the hours -of 6:00 a.m. and ' ^^
d 9:00 p.m. on said days. Persons re-
siding in such zone whose property is an odd number by street designation may
water between the hours of 6:00 a.m. ours

(3) Persons residing in ZONE THREE whose property is an
even number by street designation shall have the privilege of watering on
Plonday and Friday of each week between the hours of 6:00 a.m. arz-u -;--
and 9.-00 p.m. on said days. Persons re-
siding in such zone whose property is an odd number by street designation may
water between the hours of 6:00 a.m.
_5• . and 9:00 p.m. on Tuesday and Saturday of each week.
(4) Churches, schools, tourist courts, public buildings,
parks, football and base ball fields, may each elect to water any day of the
week between the hours of 8:00 a.m. and 5:00 p.m., but may water any given
area on only one day per week, with no watering whatsoever on Sunday; providing
however that watering in the cemetery may be between the hours of 6:00 a.m. and
8:00 p.m. on any day of the week without restrictions.
(5) Persons residing in any zone may wash a private
motor vehicle on the day and during the hours designated for watering.
SECTION 4. That each and every police officer of the City of Wichita
Falls, sh all, in connection with his duties imposed by law, diligently enforce
the provisions of this ordinance.
SECTION 5. That the provisions of this ordinance shall apply to
users of water from the City of 71 chita Falls water supply system which are
outside the City of Wichita Falls and the provisions of this ordinance may be
enforced by the discontinuance of the water service in the event of a violation
of said terms and provisions of this ordinance.
The municipalities to whom the City of Wichita Falls sells
water from its supply system or reservoirs shall likewise comply with the terms
and provisions of this ordinance in their respective jurisdiction in order to
obtain water service from the said City of Wichita Falls water supply system
or reservoirs.
SECTION 6. That any person, firm or corporation violating the
terms and provisions of this ordinance shall be deemed guilty of a misdemeanor,
and upon conviction, shall be fined a sum of not less than TEN 'I'D N0/100
($10.00) DOLLi'.RS and not to exceed TWO HUNDRED YZTD N0/100 (�200.00) DOLLIRS.
If a person is guilty of a second violation of this ordinance, the Director
of Utilities of the City of Wichita Falls shall be authorized to cut off the
water service serving the premises where such violation occurs.
SECTION 7. This ordinance shall become effective this the -

day of Jule D. 1953, and shall continue in full force and effect until
repealed or amended by the Board of Aldermen of the City of 14ichita Falls.
SECTION 8. livEEREAS, the City of Wichita Falls is faced with an
inadequate supply of water in its reservoirs for use by the general public
and in the interest of conservation of such water as is presently available
for the general benefit of the public, conservation of health and fire pre-
vention, an urgency and an emergency is created for the immediate preserva-
tion of the public peace, health, safety and general welfare, requiring that
this ordinance shall take effect immediately from and after its publication
and it is accordingly so ordained.
SECTION 9. If any part or marts of this ordinance are for any
reason held to be invalid, such decisions shall not affect the validity of
the remaining portions of this ordinance.
