ORDINANCE AMENDING CHAPTER 7, ENTITLED "BUILDINGS," AT
SECTION 7 -15, SUBSECTION (6), CONCERNING SECTION 108.2.2,
TERMS OF OFFICE OF THE CONSTRUCTION BOARD OF
ADJUSTMENT AND APPEALS; PROVIDING FOR INCLUSION IN THE
CODE; FINDING AND DETERMINING THAT THE MEETING AT WHICH
THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, Chapter 7 of the Wichita Falls Code of Ordinances, entitled
"Buildings," at Section 7 -15, Subsection (6) concerning 108.2.2, "Terms," establishes
the term of office for the Construction Board of Adjustment and Appeals, but does not
specify a length of term after initial appointment of said members; and
WHEREAS, it is desirable to amend said subsection to provide for a term of
office.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS:
SECTION 1. That Chapter 7, entitled "Buildings," at Section 7 -15, Subsection (6)
concerning Section 108.2.2, "Terms," be amended so that such section shall read as
follows:
"108.2.2 Terms.
Of the regular members first appointed, three (3) shall be appointed for
terms of one (1) year, three (3) shall be appointed for terms of two (2)
years and three (3) shall be appointed for terms of three (3) years. The
two (2) alternate members shall be appointed for two (2) year terms.
After the initial appointment, members to the Board shall be appointed
for three (3) year terms. In no case shall a member serve more than six
(6) consecutive years. Continued absence of any member from required
meetings of the Board shall, at the discretion of the applicable governing
body, render any such member subject to immediate removal from
office."
SECTION 2. That it is the intention of the City Council of the City of Wichita
Falls, Texas, that the provisions of this ordinance shall become a part of the Code of
Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may
be renumbered or relettered to accomplish such intention.
SECTION 3. That it is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
