Ordinance rezoning approximately 8.2 acres at 800 Kemp
Boulevard and a portion of Blocks D, H, I & J of Kemp’s West End
Addition from Limited Office (LO) and Planned Unit Development
(PUD) to a newly created Planned Unit Deve lopment (PUD) to
allow a restaurant and farming
WHEREAS, the Planning and Zoning Commission considered the proposed
rezoning request at its April 8, 2015 meeting, and voted unanimously to recommend
approval of this request; and ,
WHEREAS, the City Council has reviewed this request and has determined that
the herein described zoning amendment is in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. Approximately 8.2 acres of Kemps West End Abstract 300 – J (800 Kemp
Boulevard) and Blocks D, H, I & J of Kemp ’s West End Addition, as depicted on the
attached map herein incorporated in this ordinance as Attachment “A”, is hereby
rezoned from Limited Office (LO) and Planned Unit Development (PUD) to Planned
Unit Development (PUD) to allow a restaurant and farming and shall be regulated as
follows:
Use and Development Regulations:
A conceptual plan represented by a Master Plan for development entitled “Planned Unit
Development Site Plan” is herein incorporated as part of this ordinance as Attachment
“B”. The development regulations shall be as follows:
1. Land use regulations:
A. Parcel A:
Primary uses, allowed by right:
1. Restaurant without a drive-through;
2. Production of produce;
3. Farming;
4. Uses permitted in Section 3120 of the Zoning Ordinance, City of Wichita
Falls, Single-Family Residential (SF-2) zoning district, as amended;
5. Uses permitted upon approval of a conditional use, in Section 3130 of the
Zoning Ordinance, City of Wichita Falls , Single-Family Residential (SF-2)
zoning district, as amended.
Accessory uses allowed in conjunction with the primary uses only:
1. Office space;
2. Nursery;
3. Keeping of small animals such as fowl, rabbits, and guinea pigs for
commercial purposes;
4. Retail/seasonal sale of produce and other items;
5. Light agriculture purposes;
6. Special events including but not limited to urban farming educational
classes, site rental, and outdoor dining.
B. Parcel B:
Primary uses, allowed by right:
1. Production of produce;
2. Farming;
3. Uses permitted i n Section 3120 of the Zoning Ordinance, City of Wichita
Falls, Single-Family Residential (SF-2) zoning district, as amended;
4. Uses permitted upon approval of a conditional use, in Section 3130 of the
Zoning Ordinance, City of Wichita Falls , Single-Family-2 Residential (SF-
2) zoning district, as amended.
Accessory uses allowed in conjunction with the primary uses above only:
1. Greenhouses;
2. Nursery;
3. Keeping of small animals such as fowl, rabbits, and guinea pigs for
commercial purposes;
4. Retail/seasonal sale of produce and other items;
5. Light agriculture purposes;
6. Special events including but not limited to urban farming educational
classes, site rental, and outdoor dining.
2. Development Regulations: All development shall be consistent with Section 3140
Single-Family Residential (SF-2) development regulations, as amended, and except
as indicated below:
A. Side Setback, other than land uses allowed in Single-Family Residential (SF-2)
zoning district: 30 foot minimum
B. Rear Setback, other than land uses allowed in Single-Family Residential (SF-2)
zoning district: 30 foot minimum
C. Sign Regulations: Signs shall be regulated by the Zoning ordinance with the
same restrictions as applied in t he Commercial Corridor (CC) district, Section
3925 of the Zoning Ordinance, City of Wi chita Falls, as amended.
3. Master Plan For Development: The configuration of the parking lot, location and
configuration of the pond, location of the greenhouses, and location of the crops
shall be generally as indicated on the Master Plan for Development, Attachment “B”,
subject only to the changes which may need to occur due to engineering
considerations design and review and aesthetic constraints, as constructed and
measured drawings are prepared prior to actual development. Additionally, the
developer may make minor changes in accordance with Section 3690 (Planned Unit
Development District – amendments and changes) of the Zoning Ordinance of the
City of Wichita Falls, as amended.
4. Other Requirements: All regulations of the zoning ordinance which have not been
specifically addressed in this ordinance shall apply to this Planned Unit
Development Ordinance and are hereby made a part hereof and included herein.
