Resolution approving filing of application for Amendment of
Certificate of Adjudication No. 02-5123
WHEREAS, the City of Wichita Falls, Texas (the “City”) holds rights to divert and
use state water pursuant to Certificate of Ad judication No. 02-5123 (the “Certificate”);
and,
WHEREAS, the City desires to amend the Certificate to add municipal and
industrial purposes of use to the 16,660 acre -feet per year of water currently authorized
for irrigation purposes on the Wichita Rive r as described in the Certificate; and,
WHEREAS, the City also seeks to amend the Certificate to add a diversion
reach on the Wichita River downstream of the current Wichita River diversion point
described in the Certificate; and,
WHEREAS, the Texas Water Code and the Rules of the Texas Commission on
Environmental Quality (the “Commission”) require proof of authorization to execute and
prosecute applications for amendments to the Certificate .
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS THAT:
1. The Director of Public Works is hereby authorized on behalf of the City
Council to execute such applications as are necessary to be filed with the Commission
to amend the Certificate.
2. The Director of Public Works is hereby authorized and directed on behalf of
the City Council to file said application and to appear and arrange for the appearances
of persons representing the City at the hearings and other proceedings on the
applications before the Commission, and otherwise dir ect prosecution of the
applications on behalf of the City Council.
