Resolution authorizing the purchase of a digital imaging particle
analyzer from Fluid Imaging Technolog ies in the amount of
$71,150.00
WHEREAS, the particle analyzer at the Cypress Water Treatment Plant is in
need of replacement in order to improve the efficiency of the operation; and,
WHEREAS, the City Council finds that this purchase is exempt from the State
requirements for competitive bidding pursuant to Tex. Local Gov’t Code §
252.022(a)(2) because it is a procurement necessar y to preserve or protect the public
health and safety of the residents of the City of Wichita Falls by improving the quality of
potable water; and,
WHEREAS the City Council finds that this purchase is exempt from the State
requirements for competitive bid ding pursuant to Texas Local Government § 252.022
(a)(7)(A), which exempts from competitive bidding purchases of “items that are
available from only one source because of patents, copyrights, secret p rocesses, or
natural monopolies;” and,
WHEREAS, the City Council finds that purchasing a particle analyzer to improve
water quality is in the best interest of the citizens of the City of Wichita Falls.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
City Staff is authorized to execute all documents necessary to purchase a digital
imaging particle analyzer from Fluid Imaging Technologies in the amount of
$71,150.00.
