The hearing to property owners with reference to paving Fil- more Street from Avenue I. to Avenue X, was called and after hearing all protests the following motion was put in order. Nayes: None. R E S O L U T I O N RESOLUTION CLOSING HEtiRING 'ITH REFYTRE TUE TO IIPROVETTENTS AIM ASSESS1.1ENTS THEREFOR ON A PORTION OF FILMORE STREET IN THE CITY OF VVICHITA, FALLS, TEXAS. WHEREAS, by resolution passed and adopted on the 23rd day of June 1924, it was ordered that rilmore Street from its inter- section with the inter- IT Property Line of Avenue I, to its intersection with the North Property Line of Avenue Y, be improved in the manner set forth in the said resolution; and thereafter contract was let and entered into with the Plains Paving Company for the making and cons- truction of such improvements; and thereafter the City Engineer filet roll or statement showing thereon the various parcels of property abutting upon said street, with the names of the owners thereof, as far as known, and showing the amounts to be assessed against each parcel, and showing other matters and things, and such statement hav- ing been examined and approved, it was by resolution ordered that hear- ing be given to all owners of abutting property and to all others in- terested and a time and place was fixed therefor; and at said time and place, to-,..."it, the 28th duly of July 1924, at 7:30 o'clock P. I�., in the Council Cha:.:ber in the ::*organ -building in the City of Wichita Falls, Texas, said hearing was duly had and held, notice of the time and place thereof and of such hearing having been theretofore given in due and proper manner and for the length of time as was proper; Ind at said hearing the following protests were made, to -wit: Mrs. W. 17. l�'uller, owning lots 2 & 3, Block 106 fronting 100 feet on the Nest side of said Street, protested that: cost was ex- cessive and this is inopl)ortune time to assume the expense. And all parties desiring themselves to be heard their agents representa--ives and attorneys, were fully and fairly heard, and evi- dence was introduced and considered; and the -3oard of Aldermen having. heard the evidence and having considered same, and having heard and considered ail protests and objections made, whether herein enumeratd or not , is of the opinion that all protests and objections should be over - ruled, and that said hearing should be closed; and all errors and other matters requiring corrections or rectification having been corrected and rectified; M THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDEFJTEN OF THE CITY OF 'vi1ICHITA FALLS, TEXAS, THAT; . I. All protests and objections, whether herein enumerated or not, be, and the same, are hereby overruled. II. The Board of Aldermen from the evidence finds that in each and every case the property abutting upon the said improvements -will be enhanced in value by means of such improvements, in a sum in excess of the amount proposed to be assessed against it therefor; and further finds that the apportionment of the cost of the said improvements made and app- lied and shown on the Engineer's roll or statement is. substantially in proportion to the benefits received by means of the improvements, and that such apportionment is just and equitacle, and results in substantial justice and equality between the various parcels o: property and the own- ers thereof, considering burdens imposed and benefits received. III. That the said hearing be, and it is hereby closed, and it is ordered that each parcel of property abutting upon the said imp- rovements and the owners of such property be assessed in the sums shown on the said roll or statement opposite the description of the respective parcels under the column "Total Assessment" and itemized in the columns preceeding such column; and it is directed th at ordinance levying such assessments in accordance with the terms and provisions of the proceed- ings of the City with reference to said improvements and in accordance with the law and charter be- prep axed. IV. The Board of Aldermen further finds that the sums assess- ed against the respective _)arcels of property do not exceed the amount or proportion authorized by charter and provided by the proceedings of the City; and further finds all other matters and thinEs necessary and prerequisite to this resolution and to such assessments. PROVIDING FOR THE CANCELLATION OF THE ORIGINAL SCRIP WARRANTS, AND DECLARING 21 yI:1ERGENCY. %C S WHEREAS, on '-,arch 17th, 1924, the Board of Aldermen passed an ordinance providing for the issuance of City of Wichita Falls Street Improvement Funding 'F`darrant- Notes, Series 1924, in the amount of 4, y�62,000.00, and at that time provided for the periodical exchange of said Funding Warrant -Notes for like amounts of scrip warrants legally issued- against the Street Improvement ±und of the City, including warrants issued prior to March 17, 1924, and to be issued after said date pending the completion of a Street Improvement Program commenced during -the year 1923, and not to be completed until during the fiscal year 1924; and WHEREAS, at this time there have been issued and registered in pursuance of said program, since the last installment delivery and exchange, scrip warrants in the aggregate amount of y�6,352.20, which are available for the exchange contemplated in the original ordinance; and 6Vi'E1EAS, certain facts exist which show that all of said scrip warrants were issued in conformity with all Charter requirements, among which facts are the following: (a) All warrants hereinafter particularly listed,.were issued either to a contractor in payment of an estimate or were issued to work- men, laborers or employees of the City, working under its own super- vision and employment, known as "direct labor ", or for current suppliEs fdr said work; (b) in each instance where the warrants were issued to pay for direct labor, the p ! ans and estimates of such improvement work were submitted to and were approved by the Board of Aldermen before the work was authorized: (c) In the only instance vvhere a warrant was issued to a contractor, it was based on a contract involving more than '1,000.00 and such contract was a%rarded to the lowest responsible bidder after legal advertisement; and _,_'.SAS, certain facts exist concerninz; the warrants, among which are to-wit: All of the warrants listed herein in the amount of X6,352.20 (with the exception of two items of •; 7.20 and .;5.04 for posta;e) were issued _in payment of direct labor, performed directly for the city, which was based i2pm sib- contracts between the city and contractors, by virtue of which the city assumed the burden of doing certain e:.ca- vating _work on the following streets: (1) Eighth Street from Denver to Filmore; .(2) Burnett Street from :ighth to the 'Jichita = ?iv er Bridge; (3) Seymour ?oad from Santa ,'e to the City limits.
