The City Engineer is hereby directed to have plans, profiles, specifications and estimates embracing the foregoing materials and plans of improvement prepared, and to file the same with the Board of Aldermen, the City Engineer Wang so directed, there being no City Manager. III. The same payable by the benefitted property and owners thereof shall be payable in six (6) equal installments, the first; of which shall be due on or before thirty (30) days after date of com- pletion and acceptance by the City of such improvements; the second (2) shall be due on or before one (1) year after such date; the third (3) on or before two (2) years after such date; the fourth (4) on or before three (3) years after such date; the fifth (5) on or before four (4) years after such date; the sixth t6)ron or before five (5) years after such date; the entire amount of the sums shall bear interest from the date of ouch completion and acceptance and until paid at the rate of eight ( %) per cent per annum, payable annually, but such property, and the owners thereof, shall have the privilege of paying any or all of such installments at any time before; maturity, and. the failure to pay any installment upon the maturity thereon shall at the option of the owner and holder of the certificate of spacial assessment issued in evidence thereof, mature the entire amount then unpaid;, and the sums payable by the respective lots or parcels of property. anutting upon the said improvement and benefitted thereby,. shall be. assessed against such lots or parcels and against the owners thereof, and shall be a personal liability of such owner and a first and prior lien and charge against such property, superior to all other -tiens, claims and charges and demands of v..atsoever kind, excepting only State, County and Municipal taxes. No assessment shall be levied against any lot or parcel of land, or the owner thereof, in excess of the special benefits to such lot or parcel of land in enhanced value thereof by means of such improvement, and no assessment shall be levied until after the notice and hearing as provided in the Gharpter and Laws in force and effect in this city, and in the ordinance and proceedings of the Board of Aldermen applicable thereto. R E S O L U T I O N RESOLUTION APPROVING AND ADOPTING PLANS, PROFILKS.,'. SPECIFICATIONS AND ESTIMATES OF THE PROPOSED IMPROVEMENT OF GIDDINGS STREET FROM THE NORTH PROPERTY LINE OF AVENUE C TO THE NORTH PROPERTY LINE OF AVENUE G IN THE CITY OF WICHITA FALLS, TEXAS AND DIRECTING THE CITY CLERK TO ADVERTISE FOR COMPETITIVE BIDS FOR THE MAKING AND CONSTRUCTING OF SUCH IMPROVEMENT. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS: THAT WHEREAS, by resolution passed on the 16th day of June, 1924, the Board of Aldermen of the City of Wichita Falls declared the necessity (f improving Giddings Street from the North property line of Avenue C to the North property line of Avenue G, by rais- ing, grading and filling same, and paving same and installing concrete curbs and gutters, with the materials and in the manners and methods stated in. the said resolution, and gave the method by which It was proposed that pa yment be made therefor, and direct- ing the City Engineer to have plans, profiles, specifications and estimates of the proposed improvement prepared; and WHEREAS, the said City Engineer has prepared such plans, profiles, sg-ecifioations and estimates and has filed the same with the Board cf Aldermen, and the same have been inspected and examined and corrected, where necessary; I. That the said plans, profiles and specifications and estimates, be and they are hereby adopted and approved as those under, by and in accordance with which said improvements &all be made and constructed. 2. The resolution was read in full by the City Clark, Alderman Young made the following motion: "I move that the rules of the Charter requiring resolutions to be read on three separate days and postponing the taking effect of resolutions be suspended and dispensed with." The Rea& luti on f ollows : RESOLUTION AUTHORIZING THE EXCHANGE OF $6,000.00 CITY OF WICHITA FALLS STREET IMPROVEMENT FUNDING WARRANT - NOTES, SERIES 1924, FOR $6,000.00 OF SCRIP WARRANTS HERETOFORE ISSUED BY THE CITY AGAINST THE STREET IMPRO VEMENT. "•FUND OF THE CITY IN COMPLIANCE WITH THE CHARTER AND ORDINANCES IN FORCE. PROVIDING FOR THE CANCELLATION OF THE ORIGINAL SCRIP WARRANTS, AND DECLARING AN EMERGENCY. WHEREAS, on March 17th, 1924 the Board of'Aldermen passed an ordinance providing for the issuance of City of Wichita Falls Street Improvement Funding Warrant- Notes, Series 1924, in the amount of $52,000.00, and at that time providing for the periodical exchange of said Funding Warrant -Notes for like amounts of scrip warrants legally issued against the Street Improvement Fund of the City, Including warrants issued prior to March 17, 1924 and to be issued after said date pending the completion of a Street Improvement Program commenced during the year 1923 and not to be completed until during the fiscal year 1924; and WHEREAS, at this time there have been issued and registered In pursuance of said program, since the last installment delivery and exchange, scrip warrants in the aggregate amount of $5,202.83, which are available for the exchange contemplated in the original ordinances; and WHEREAS, certain facto exist which show that all of said scrip warrants were issued in conformity with all Charter requirements, among which facts are the following: (a) All warrants hereinafter particularly listed, were issued either to a contractor in payment of an estimate or were issued to work- men, laborers or employees of the City, working under its own super- vision and employment, known as "direct labor ", or for current supplies for said work; (b) In each instance where the warrants were issued to pay for direct labor, the plans and estimates of such improvement work were submitted to and were approved by the Board of Aldermen before the work was authorized; (o) In the only instance where a warrant was issued to a contractor, it was based on a contract involving more than $1,000.00 and such contract was awarded to the lowest responsible bidder after legal advertisement; and WHEREAS. certain facts exist concerning the individual warrants, among which are to -wit: Warrant No. B -4933, dated May 31, , 1924, issued to Plains Paving Company in the amount of $1,161.46, was based on a legal contract for the paving of Indiana Avenue, made between the contractor and the City, November 12, 1923 and issued to pay the final estimate under said contract. Of the remaining warrants listed below, $4,041.37 (with the exception of an item of $5.04 for postage) were issued in payment of direct labor, performed directly for the City, which was based upon sub- contraote between the City and Contractors, by virtue of which the City assumed the burden of doing certain excavating work on the follow- ing streets: (1) Eighth Street, between Denier Street and Filmore Street. (2) Burnett Ave., between Eighth St. and Wichita River Bridge. (3) Seymour Road, between Santa Fe Ave. and City Limits. After such hearing is closed anyone desiring to appeal therefrom shall prosecute and appeal to any Court havirg juris- diction within twenty (20) days from the date such hearing is closed and final assessment levied and not thereafter, and all persons, firms, corporations, estates, and other parties shall after the expiration of twenty (20) days from the levying of such assessment, be forever barred and estopped from in any manner doubting or resisting same or asserting any error, irregularity, mistake or invalidity therein.
