The iiayor presented for consideration by the Board a reso- lution entitled: "RESOLUTION AUTHORIZI1G THE Ez:CHANGE OF w10,000.00 CITY OF VIICHITA FALLS STR77ET I'MPROVEIIE.NT FUNDING 4"JARRANT- NOTES, SERIES 1924, FOR $10,000.00 OF SCRIP WARRANTS HERETOFORE ISSUED BY THE CITY AGAINST THE STREET IM- P OVELIM T FUND OF THE CITY IN C 012L IANCE 1�VITH THE CHARTER AND ORD- IN22TCES IN FORCE, PROVIDING FOR THE CANCELLATION OF THE ORIGINAL SCRIP VIARR=:ITTS, AND DECLARING AN F.I'.RGENCY% The resolution was read in full by the City Clerk. Alderman Young made the following motion: "I move that the rules of the Charter requiring resolutions to be read on three separate dz.ys and postponing the taking effect of resolutions be suspended and dispensed with ". The motion was seconded by Alderman Patton. The motion to suspend the rules was passed by the unanimous vote of a! 1 members of the Board, to-wit: Yeas: Aldermen: Young, Patton, Clifford, and Curd. The 1,iayor asked to be recorded as voting Yea. Nayes: None. Alderman Patton made a motion that the resolution be placed on its final reading and passage. The motion was seconded by Alderman Curd. PROVIDING FOR THE CANCELLATION '14ARRANTS, AND DECLARING AN EMERGENCY ". CITY OF 'dICHITA FALLS L924, FOR $10,000.00 AGAINST THE STREET THE CHARTER AND ORDI- OF THE ORIGINAL SCRIP WHE- ?EAS, on 1 arch 17th, 1924, the Board of Aldermen passed an ordinance providing for the issuance of City of 1".1ichita {alls Street Improvement .Funding Warrant- Notes, Series 1924, in the amount of q` X52,000.00, and at that time provided for the periodical exchange of said Funding 'darrant -Notes for like amounts of scrip warrants legally issued against the Street Improvement Fund of the City, including warrants issued prior to March lY, 1924, and to be issued after said date pending the completion of a Street Improvement Program commenced during the year 1923 and not to be completed until during the fiscal year 1924; and WHEREAS, at this time there have been issued and registered in pursuance of said program scrip warrants in the aggregate amount of X10,064.11, which are available for the exchange contemplated in the original ordinances; and ',dHF, =EAS, certain facts exist which show that all of said scrip warrants were issued in conformity with all Charter requirements, among which facts are the following: (a) All warrants hereinafter particularly listed, were issued either to a contractor in payment of estimates or were issued to work- men, laborers or employees of the City, working; under its own super - vis ion and employment, e:nown as "direct labor ", or for current supplies for said work; (b) In each instance where the warrants were issued to pay for direct labor, the plans and estimates of such improvement work were submitted to and were approved by the Board of Aldermen before the work was authorized: (c) In the only two instances where warrants were issued to con- tractors, they were based on contracts involving more than X1,000.00 and such contracts were awarded to the lowest responsible bidder after legal advertisement; and WHEREAS, certain facts exist concerning the individual warrants, among which are to -wit: Warrant No. 13 -5280, dated !,lay 5, 1924, issued to Plains Paving Company in the amount of X3525.82, was based on a legal contract for the paving of Indiana Avenge, made between the contractor and the City November 12, 1923. darrant No. B -94, dated April 14, 1924, issued to Plains Paving Company in the amount of w951.00, was based on a legal contract for the paving of Ohio liven: -_e, made between the contractor and the City, November 5, 1923. Of the remaining warrants listed below, X5518.79 were issued in payment of direct labor, performed directly for the City, which was based upon a sub - contract between the City and Plains Paving Company, by virtue of which the City Assumed the burden of doing certain excava- ting work on the Ohio Avenue and Indiana Avenue Improvement program. The remaining 968.50 of warrants were issued for supplies and printing incidental to said contracts; ViME, LAS, all of said scrip warrants were based upon vouchers duly certified by the head of the appropriate depart lent, and issued by the City Clerk, countersigned by the =: ayor, and now constitute valud, legally incurred and subsisting obligations of the City, which original scrip warrants are described as follows, to-wit : DATE 4�8/24L 4/8/24, 4/19/24 IT 1t T! Williams " 21.00 T o t a l X10,064.11 THEREFORE BE IT ?ESOLVED BY 111EE BOh ?D OF AIDE= .TEN OF `_SH ` E CITY OF WICHITA FALLS, TEXAS; (1) That the City Olerk, T,Zayor and City Treasurer be and they are hereby authorized and directed to veceive from the holde_ or holders thereof, the said original scrip warrants described above and to issue in lieu there- of to' the said holder or holders Funding `:arrant -Votes Numbers twenty -seven (27) to thirty -six (36) , of City of Wichita y'alls Funding Warrant- Notes, in the denomination of One Thousand 01,000.00) Dollars each, aggregating Ten Thousand ( 10, 000.00) Dollars; that simultanecusly with said exchange of se- curities, said officials shall cancel said above described scrip warra=nts and shall make any and all certificates - necessary to properly reflect the legality of said original scrip warrants and said Funding Warrant- Notes; that due to the fact that the holder of said scrip warrants is surrendering an excess of warrants over and above the 10, 000.00 of Funding T arrant- _dotes delivered to it, said holder shall be entitled to a credit of Q64.11 on the next installment delivery of Funding Warrant 'rotes which together with the credit of y 762.02 which said holder received in the delivery of April 7, 1924, makes a total credit in its favor of 031.13. - (2) The fact that there is a very urgent public need for the post - ponement of the payment of the indebtedness as herein above provided, and in order that this may be accomplished without unduly burdening current rev- enues for the improvements which are neBded for the health, safety and prop- erty of the tax - payers of the City, creates an emergency and public necessity that this be declared an emergency measure as provided in Section 47 of the Charter demanding that the rule requiring that ordinances (and ?resolutions) be read on three several days be suspended and that this resolution be eff- ective and in force im.iediately from its passage, and it is so resolved.
