WHEREAS, the City Engineer has certified that the paving
and otherwise improving of Garfield Street from its intersection with
the center line of Tenth Street to its intersection with he north
durb line of ,avenue "E", has been completed by the Plains Paving Com-
pany in accordance with the plans and specifications therefor, and
the City Engineer recommends the acceptance of the said work by the.
City.

hereby accepted by the City of Wichita Falls, Texas, and the .'`ayor be
and is hereby authorized and directed to execute Special Assess1:1ent
Certificates evidencing the indebtedness of the owners of the prop-
erty abutting on said portion of street, in the name of the City of
dichita Falls, and the City Clerk is hereby authorized and directed
to attest same and to impress thereon the seal of the City of rdichita
Falls, 'Texas, and to deliver said Special .assessment Certificates to
Plains raving Company, as set forth in the contract for the above named
improvements, all in accordance with the ordinances and resolutions
heretofore adopted and passed by the City of dichita 'Falls with ref-
erence to the above described improvements.

cifications and estimates embracing~ the foregoing materials and plans of
improvement prepared, and to file the same with the Board of Aldermen, the
City Engineer being so directed, there being no City .."anager.
III.
The said improvements shall be paid 1:or in the following manner,
to6owit :
The benefited and abutting property, and the oviners thereof, shall
be assessed and ppLy forvall of the cost of installing curbs and .lot exceed-
ing ninety per cent of the remaining cost of such improvements, and the City
of ichita lulls shall pay the remainder.
The sums payable by the benefited property and the owners thereof
shall be �payable in six equal installments, the first of which shall be
due on or before thirty (30) days after date of completion of said work and
its acceptance by the city; the second shall be due on or before one year
after such date; the third on or before two years after such date;axk the
fourth on or before three years 9fter such date of completion and acceptance;
the fifth on or before four years after such date of completion and acc-
eptance; the sixth: on or before five years after such date of completion
and acceptance. The entire amount of the sums shall bear interest from the

(80) per centum per annum, payable annually, but such property, and the owners
thereof, shall have the privi i ege 0-11 paying any or all of such installments
at any time before ;futurity, and the failure to pay any installment upon
the maturity thereof shall at the option of the owner and holder of the cer-
tificate of special assessment is -_ued in evidence thereof, mature the entire
amount then unpaid; and the sums payable by the respective lots or parcels
of property abutting upon the said improvements, and benefited thereby, shall
be assessed against such lots or parcels and against the owners thereof, and
shall be a personal liability of such owner and a first and prior lien and
charge against such property, superior to all other liens, claims and charges
and de.aands of whatsoever kind, excepting only State, County and I,unicipal
taxes.
No assessment shall be levied against any lot or parcel of land, or
the orner thereof, in excess of the special benefits to such lot or parcel
