WHEMS, the 3oard of aldermen of the City of 4ich ita
galls, has heretofore ordered that Collins Avenue between the ':lest Prop-
erty Line of Brook Street and the East Curb Line of Baylor Street, be
improved by raising, grading, and filling some and installing concrete
curbs and paving some and after due notice and hearing, special assess -
ments were levied against the various lots and tracts of land _._nd the
owners thereof abutting upon the said portion of said street, and con-
tract for the makinj and construction of the said improvements was en-
tered into with L. E. j hitham and Company.

performed its said contract and the said improvements have been made
and constructed in accordance with the said contract and the specifi-
cations therefor, and to the entire satisfaction of this 3oard.

That the said improvements on said portion of said
Street be and the same are Thereby accepted and 1. E. hitham and Com-
pany and the sureties on its construction bond are Thereby released of
any further obligation for or on account of the contract or bolted for
the making and constructin6 of said improvements.

That this resolution does not €.yid shad not in &4
wise effect the bond of the said company for the maintenance of the
s&i d improvements, but duch maint("ahce bond shall and does remain in
full force and effect.
III.
That the ,jayor and City Clerk be and they are here by
authorized, instructed, and directed to issue to E. ohitiiam and Com-
pahhy certificates of special assess-ent in evidence of the various ass -
ess"ents levied against the respective lot or parcels of land abutting
upon said portion of said street, and tie owhers thereof, and against
which special assesswent has been levied, reciting the descriptiun of
such property, the amount of the assesswent against same, the o0ner
thereof, the terms of pal"ent tlheieof, the rate of interest, the date
of completion and acceptance of the said improvements, the lien of the
said assessment and the personal obligation and liability of the o%ve r
of the property, and reciting that k11 proceedings with reference to
making such improvements have been regularly had in accordance with
the law, the Charter of said City, the terms of the certificate, and
that all prerequisities to the fixing of a lien and claim of personal
liability evidenced bey the certificates have buen performed and cont-
aining other appropriate Laid pertinent recitals, and in accordance with
