BE IT RESOLVED BY THE BOARD OF ALDERIIEN OF THE CITY CF !dICt ITA FALLS; THAT, VHE "EAS, the Bard of Aldermen of the City of Wichita Falls, has heretofore ordered the following portion of Street in said City improved by raising, grading, and filling same and installing concrete curbs and paving with one course re- inforced concrete to -wit; all the unpaved portion of Travis Street between the South property line of Ninth Street and the North property line of Tenth Street. WHEi,2AS, by resolution of the Board of Aldermen adopts ed on the day of 1923 it is ordefed that a hearing to all oviners of property ayatuting on said portion of said street, and all others interested, be held in the Council Chamber in the Morgan Buil- ding at 7ZV 9,M on the / 7 day of &,2 ti,/,�,, _ 1923, and that notice thei-eof be given; and, I WHE3EAS, due notice of the time and place of such hea- ring was liven and such liearing held, and all parties, their agents and attorneys, and all others desiring to be heard, have been fully and fair- ly heard, and at such hearing the following protests were made, protesting against the cost of such improvements and that this is an in- opportune time therefor. 1. T',_at all protests and objections, Whether therein specifically mentioned or not, be and they are hereby over - ruled. 2. That the Board of Alde-ru,en finds from the evidence before it that-no property will be damaged b means of or as a result of any of the said improvements. 3. The Board further finds from the evidence before it that the proper rule of apportionment of the cost of such improvement is that applied and shovin on the estimates, reports, and statementsis of the City Engineer filed on the �D_�A- day of 1923, and examined and approved by the :Board, and tha7 such prodlYces and effect substan- tial equality and justice between the various lots and parceld of land" shown and affected thereby and the respective owners thereof and the :Board further finds from the evidence that each parcel or lot of land abutting on said portion of Travis Street will be benefitted in enhanced value by means of such improvements on said portion of Travis Street in an amount in excess of the portion of costs to be assessed against same as shown &n said estimates, reports, and state�aents of the City Engineer.
