The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date with the following present: Frank Collier, Mayor R. E. Shepherd N. M. Clifford � B. A. Moved by Alderman Young that the Gulf Refining Company be permitted to construct two additional storage tanks on their prop- erty at the corner of Lamar and 16th Streets. Motion seconded by Alderman Stayton and carried. Moved by Alderman Clifford that E. B. Bailey be permitted to build and operate a drug store at 1513 - Ieel' Street under the usual provisions to-wit: 711 That the said E. B. Bailey, his successors, administrators assigns and legal representatives shall hold the City of Wichita Falls, harmless from any damages that"may arise from the operation of said drug store and that the said Bz `4* Bailey shall cease to operate said drug store when so ordered by the Board of Aldermen of the City of Wichita Falls, Texas. Motion seconded by Alderman Patton and carried. ORDINANCE NO. 487 AN ORDINANCE A ENDING SECTION ONE OF ORDINANCE 398 TERI21); THE ':'EIGHTS AND 1JEASURES ORDINANCE. Moved by Alderman Shepherd that Ordinance 487 be passed on its second reading. Motion seconded by Alderman Stayton and carried.•by following vote. Yeas Shepherd, Patton Young, Clifford Staytosl. Nayes: None. Moved by Alderman Patton that Luke Powell be permitted to install- and operate a curb filling station at 903- 7th Street under the usual provisions to -wit: That the said Luke Powell, his successors, administrators, assigns and legal representatives shall hold the City of Wichita Falls harmless from any damages that may arise from the operation of said curb filling station, and that the said curb filling station shall be installed under the saps &vision of the City Engineer, and the said Luke Powell shall cease to operate said curb filling station when so ordered by the Board of Aldermen of the City of Wichita Falls, Texas. Motion seconded by Alderman Clifford and carried. Moved by Alderman Shepherd that the bill of Robt. C. Ledbetter covering witness fees and expenses in connection with the C. R. Nichols law suit in the amount of 474.97 be allowed. Motion seconded by Alderman Stayton and carried. -Itfffffff Moved by Alderman Young that the bill of W. E. Fitzgerald for $500.00 covering attorneys fee in Nichols case be allowed. Motion seconded by Alderman Clifford and carried. ORDINANCE NO. 479 AN ORDINANCE ABANDONING AND VACATING A CERTAIN ALLEY INTERSECT- ING BLOCK EIGHT NOT OCCUPIED BY THE WICHITA VALLEY RAILWAY COMPANY AND THE DEAD END OF NINTEENTH STREET BETWEEN THE EAST SIDE OF AUSTIN STREET AND THE WEST SIDE OF MILLS STREET, ALL IN THE CITY OF WICHITA FALLS, TEXAS. Motion seconded by Alderman Clifford and carried. Moved by Alderman Shepherd that the following resolution be adopted. Motion seconded by Alderman Clifford and carried by the fol- lowing vote: - Yeas: Shepherd, Stayton, Patton, Young, Clifford. Nayes: None. R E S O L U T I O N That the mayor, Frank Collier, be and he is authorized, em- powered and directed by said City Council of Wichita Falls, Texas, now in session to cause to be prepared and to execute in the name of said City of Wichita Falls, Texas, a good and sufficient assignment of a certain deed of trust lien given by C. W. Hedges and wife, to Geo. W. Thorburn, Trustee for said City of Wichita Falls, Texas, on July 18th 1921, and which deed of trust . is of record in the Deed of Trust Records of said County at Page 425, of Vol. 32, and which deed of trust was given to said Trustee for said City to secure the payment mf by the rantor therein of a certain paving indebtedness in the principal sum of 4900.00, and as evidenced by one note for that sum, signed by grantor and wife and payable to said City, there I mss► now due thereon the sum of $1,080.00 principal and interest; said note and deed of trust having been given in payment for and to secure paving abutting the following described property in Wichita Falls, Texas, viz: Lots eight and nine in Flock No.48 of the Floral Heights Add- ition to the City of Wichita Falls, Texas, and the said Frank Collier, Mayor as aforesaid, is further empowered and directed to deliver said assignment to the State Trust Company, a corporation, upon the payment by it of the sums of money how due on said note, above mentioned. Moved by Alderman Shepherd that the City Clerk be instructed to draw a warrant in favor of Montgonrry and Ward, Engincers for $300.00 to cover witness fees and profession)bervices rendered in the C. R. Nichols law suit. Motion seconded by Alderman Patton and carried. Moved by Alderman Shepherd that due to errors of the Tax Ass - essor the following valuation be reduced for the year 1923, and taxes on excess value be remitted. Frank Queisser personal property from 41,3bo.00 to $1,000.00 Mr. Jackson, Lot 4, Collins sub -div. Block 251, from $3.000.00 to $2,500.00. Jim Jones, Lot 1, Block 38, Southland Addition be reduced from 01,000.00 to $500.00. Wichita Petroleum Co., Cadillac car' be reduced from $2,000.00 to $1,000.00. Motion seconded by Alderman Stayton and carried. Moved by Alderman Shepherd that the I4ayor be authorized to sign a contract with H. C. Burt & Co., for the purchase of $50,000 worth of Water No. 1 Bonds at 99 and accrued interest. Motion seconded by Alderman Stayton and carried. The Board of Aldermen then adjourned.
