Res 005-2015 1/6/2015 RESOLUTION NO. R 05-2015 Resolution determining the public necessity for acquisition of property for the purpose of permanent and temporary utility easements necessary to complete the Permanent Reuse Pipeline North Project and authorizing the purchase or condemnation. Possible action will include the consideration of the use of eminent domain to condemn the property. WHEREAS, the City of Wichita Falls finds it is in the public's best interest to provide potable water to the citizens of Wichita Falls via the Permanent Reuse Pipeline Project; and, WHEREAS, the City of Wichita Falls finds that the acquisition of the property interests for the Permanent Reuse Pipeline Project would be for a public use and is a public necessity; and, WHEREAS, the City Council finds that property interests must be acquired for this project, and in accordance with state law, the City must offer the fair market value to the owners for the acquisitions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The City Council determines that the property interests as depicted on the attached Project Aerial Location Map, Tract Ownership Map, and also indicated and described on the attached Field Notes and Drawings are necessary for the City's Permanent Reuse Pipeline Project which is a public use and a public necessity, and City Staff are authorized to bargain in good faith for the purchase of the property interests with just compensation to be offered to the property owners in an amount determined by an independent certified appraiser to be the fair market value.
