Ordinance, closing and abandoning a portion of Arthur Street north
of Avenue V and a portion of an alley between Arthur Street and
Garfield Street out of Block 118, Highland Addition, Wichita Falls,
Wichita County, Texas
WHEREAS, JHW Land Joint Venture has requested the closing and
abandonment of 12,090.925 square feet of an undeveloped portion of Arthur Street and
5,534 square feet of an undeveloped Alley between Arthur Street and the 3100 block of
Garfield Street out of Block 118 in the Highland Addition; and,
WHEREAS, all affected utility companies, adjacent property owners, and the City
departments have reviewed this request and have recommended conditi onal approval
to close and abandon the portions of Arthur Street and the Alley subject to retention of
all easements; and
WHEREAS, it has been determined to be in the best public interest to close and
abandon said street and alley as herein indicated on the attached Exhibit “A” Location
Map, Exhibit “B” Requested Street Closure, and Exhibit “C’ Requested Alley
Closure.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The portions of Arthur Street and the Alley located North of Avenue V and
between Arthur Street and Garfield Street out of Block 118, Highland Addition
depicted and described in the attached Exhibit “A” Location Map, Exhibit
“B” Requested Street Closure, and Exhibit “C’ Requested Alley Closure
consisting of approximately 12,090.925 square feet and 5,534 square feet,
will be closed and abandoned with the retention of all utility easements.
2. The City Manager is authorized to execute a quitclaim deed to convey the
property with the retained utility easement.
