AN ORDINANCE ABAIOGNING AND CLOSING THAT PORTION OF THE ALT.
IN BACK 22 OF THE J. A. KEMP ADDITION OF THE CITY OF WICHITA FALLS, AS IS
MORE PARTICULARLY DESCRIBED HEREIN; RETAINING ALL UTILITY EASEMENTS AND
PROHIBITING THE CONSTRUCTION OF ANY HJILDINGS OVER ANY SEWER LINE THERETO.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS:
SECTION 1. That portion of the alley in Block 22 of the J. A.
Kemp Addition of the City of Wichita Falls, Wichita County, Texas, lying
between Lots 1, 2, 3, and 4 on the North and Lots 11, 12, 13, and 14 on
the South, be and the same is hereby closed and abandoned as a public alley
except as hereinafter set out.
SECTION 2. The City of Wichita Falls retains an easement in, on,
over, and under any part of said alley for the purpose of maintaining, install-
ing or repairing any utility, wire, pipe, or any other method of transporting
any form of public utility commodity.
SECTION 3. This abandonment however is subject to not only the
retention of utility easements as set out in Section 2 herein, but also no
building of any kind or character shall ever be built over the sewer line
now located in said alley unless the consent of the City is first obtained
for such construction.
SECTION 4. The alley herein is closed for the reason that the
streets in said addition have been heretofore changed and the same is no
longer of any use as a public alley to the public, save and except for
utility easements.
