ORDINANCE NO.
AN ORDINANCE PROVIDING 'FOR THE SUS`•IISSION TO THE QUALIFIED VOTERS
OF THE CITY OF WICHITA FALLS, TEAS, THE QUESTION OF 'IHE ADOPTION OR REJECTION
OF A PROPOSED I NIMUN SALARY OF $ 275.00 PER MONTH FOR FIREMEN AND
PULICE!4EN EMPLOYED BY SUCH CITY UNDER AND BY VIRTUE OF THE AUTHORITY OF ARTICLE
1583-2 OF THE PENAL CODE OF THE STATE OF TEXAS; SETTING THE DATE FOR THE ELEC-
TION THEREON, AND DECLARING AN E RGENCY.
WHEREAS, there has been presented to the Board of Aldermen of this
City a petition on behalf of the Fire and Police Departments of the City, signed
by not less than 25 per cent of the total number voting in the last preceding
municipal election, such signatures having been certified as sufficient, and such
petition requesting the submission of a proposed minimum salary; and
WHEREAS, theBoard of Aldermen desire to order an election as re-
quested in such petition and in compliance with Article 1583-2 of the Penal
Code of the State of Texas; now therefore,
.Si IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS. AS FOLLOWS:
SECTION 1. That there shall be submitted to the Qualified voters
of the City of Wichita Falls, Texas, the question of the adoption or rejection
of a minimum salary of $ 275.00 for firemen and policemen employed by
said City.
SECTION 2. The question of the adoption or rejection of such
minimum salary of 0 2?5.00 for the firemen and policemen shall be
submitted at a special municipal election to be held on March 16, A. D. 1954.
Said election shall be held at the regular polling places in the City of
Wichita Falls by the duly appointed judges and clerks of such elections.
SECTION 3. The polling places shall be open from 8:00 a.m. to
7:00 p.m. and the election shall be conducted by the election judges and other
election officials appointed by the Board of Aldermen for conducting elections
in said City of Wichita Falls, d shall otherwise be conducted in accordance
with the general election of the State of Texas.
SECTION 4. The ballots used in such election shall be in the
following form:
"FOR THE PROPOSED MINIMUM SALARY OF -> 275.00 PER MONTH FOR
FIREMEN AND POLICEMEN."
"AGAINST THE PROPOSED MINIMUM SALARY OF $275.00 PER MONTH FOR
FIREMEN AND POLICEMEN."
"Strike out the proposal that you do not want."
SECTION 5. This ordinance shall be immediately published in the
Record News in Wichita Falls, Texas, which is designated as the official news-
paper for the City of Wichita Falls, and a copy of same shall be posted at
each precinct thirty (30) days before such said election and the same shall be
notice of said election.
SECTION 6. The fact that Article 1583-2 of the Penal Code of the
State of Texas provides that an election shall be called within ninety (90) days
after a petition for the same has been filed with the governing body of the
City of Wichita Falls, which was the 14th day of December 1953, and certified
as sufficient on the 22d day of December 1953, makes it necessary and creates
an emergency, and it is hereby declared that the within and foregoing ordinance
is an emergency measure on the ground of urgent public need and statutory
requirement for the calling of an election as provided by said act, and the
rule requiring that an ordinance go into effect thirty (30) days after passage
is hereby suspended and this ordinance shall become effective immediately upon
its passage and approval by the Board of Aldermen.
