Ord 1680 2/8/1954 ORDINANCE NC. / 7 C � AN ORDINANCE PROVIDING FOR THE SU EMISSION T10 THE QUALIFIED VOTERS OF THE CITY OF WICHITA FALLS, TEXAS, THE QUEST[ON OF REPEAL OF THE FIRErEN'S AND POLICEMEN'S CIVIL SERVICE LAW, AS THE SAME APPLIES TO THE CITY OF WICHITA FALLS; PROVIDING FOR THE FORM OF BLLI,OT TO BE USED; SETTING THE DATE AND TIME FOR THE }+TFCTION AND DECLARING AN EMERGENCY. WHEREAS, by Ordinance No. 1h)18, passed and approved the 1st day of December 1947, the City of Wichita Falls submitted to the people of said City the desirability of adopting the Civil Service Law, and WHEREAS, the 52nd Legislature authorized the resubmission of such issue to the qualified voters of cities with a population of less than 70,000 inhabitants according to the last preceding Federal Census, and WHEREAS, the City of Wichita Falls has heretofore adopted the Civil Service Law as set out in Article 1269 m of the Revised Civil Statutes of Texas, and the same has been in full effect in said City for a period of two years, and WHEREAS, the City of Wichita Falls according to the last preceding Federal Census had a population of less than 70,000 inhabitants, and WHEREAS, various interested persons have requested the submission of the repeal of the provisions of the Civil Service Law to the popular vote in said City; NOW THEREFORE, BE IT ORDAINED BY THE ECARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, AS FOLLOWS: SECTION 1. That there shall be submitted to the qualified voters of the City of Wichita. Falls, Texas, the question of the repeal of the provisions of House Bill No. 34, the same being Article 1269m of the Revised Civil Statutes of Texas, insofar as the same is effective in the City of Wichita Falls. SECTION 2. That the question of the repeal of the provisions of Article 1269m of the Revised Civil Statutes of Texas, as applied to the City of Wichita Falls shall be submitted at a special municipal election b be held on the 16th day of March, A. D. 1954. Said election to be held at the regular polling places in each of the election precincts of said City. SECTION 3. The polls shall be open from 8:00 a.m. to 7:00 p.m. and the election shall be conducted by the election judges and other election officials appointed by the Board of Aldermen for conducting elections in said City, and shall be otherwise conducted in accordance with the general election laws of the State of Texas. The ballots used in said election shall be in the following form: "FOR THE REPEAL OF THE FIRE EN 1 S AND POLICFNI2, '6 CIVIL SERVICE LAW AS APPLIED `10 THE CITY OF WICHITA FAT,TS UNDER AUTHORITY OF ARTICLE 1269m, AS AMENDED, OF THE REVISED CIVIL STATUTES OF TEXAS." "AGAINST THE REPEAL OF THE, 'I R.EliEM;'S LTD POLICEMEN'S CIVIL SERVICE LAW AS APPLIED TO THE CITY OF SIC_ ITA FAITS UNDER AUTHORITY OF ARTICLE 1269m, AS AME DED, OF THE REVISED CIVIL STATUTES 02 MICAS." "Strike out the provision you do not favor." SECTION 5. This ordinance shall be immediately published in the Record Mews in Wichita Falls, Texas, which is designated as the official newspaper for the City of Wichita Falls, and a copy of the same shall be posted at each precinct thirty (30) days before said election, and the same shall be notice of said election. SECTION 6. The fact that it would be to the public benefit to hold this election at the same time another election has been called on the issue of Firemen's and Policemen's Minimum Wage Scale in the City of Wichita Falls, creates an emergency and it is hereby declared that the foregoing ordinance is an emergency measure on the zrounds of urgent public need and necessity, and this ordinance shall become effective immediately upon its passage and approval by the Board of Lldermen.
