SECTION 1. The book entitled ('Southern Standard Building Code, 1953-
54 Revision" (A copy of which, authenticated by le Mayor and
the City Clerk, and made a public record by resolutiongoft hesBoard of l of Aldermen,
is on file in the City Clerk1s office) is hereby adopted as the ,Building Code
of the City of Wichita Falls, as fully as if copied at length in this Ordinance,
with the following changes therein:

clude all labor, material, equipment, overheads, and the
contractors profit together with the cost of plumbing,

For the purpose of estimating the total value, the follow-
ing schedule shall be used unless the applicant can demon-
strate that the cost is less than that determined by the
schedule.

(1) Permit fees for construction, alteration and repair of buildings
and structures shall be as follows:

(2) Permit fee for the moving of any building or structure over
10 ft. wide or over 12 ft. long shall be "5.00 for each
building or section thereof.
(3) Permit fee for the demolition of any building or structure
shall be $2.00.

(4) Permit fee for the erection of signs requiring permit shall
be �1.00 per sign or display, except for spectacular signs,
which shall be �2.00 per sign.
(5) Permit fees (when required) for the erection of television
aerials shall be $1.00 each.
(6) Inspection fee for the installation of washed-air, or re-
frigeration, air conditioners projecting over public side-
walks or on roofs of structures shall be $1.00 per unit.
(7) Permit fee for the installation of any heating, refrigeration,
and air-conditioning equipment (except portable package units)
ducts, etc., not included in the value of the general contract
shall be at the rate of 2/10 of one per cent of total cost, with
a minimum charge of "�'1.00.
(8) A permit fee may be refunded to payee upon recommendation of the
Building Official.
(9) In case any work, for which a permit is required by this code,
is started or proceeded with prior to obtaining said permit
the fees specified may be doubled, but the payment of such
fee shall not relieve any person from fully complying with
the requirements of this code.
(3) Amend Section 105 by adding Section 105.8 to read as follows:
FRONT AND SIDE MILDING LINES:
Unless otherwise required by deed restriction or
dedication, all buildings fronting on any street or avenue
in the residence sections of the City of Wichita Falls shall
observe the average existing building line on such streets
and avenues. If the building line is not established by
deed or dedication, and the building line has not been
established by existing buildings, the building line shall be
at least twenty-five feet from the front line of the lot. No
frame buildings shall be erected within three feet of the
interior side line of a lot except that small detached
apartments, garages and garage apartments, and out buildings
on the rear of the lot may be erected one foot from the in-
terior side line and alley line of the lot, provided further
that the roof drips on the property. Buildings with un-
pierced masonry walls may be built to the interior side line
of a lot provided that the roof drains on the lot.
Buildings on corner lots where interior lots have been
platted, or sold, fronting on the side streets, may project
not more than ten feet in front of the line established for
buildings fronting the side street, provided that this regu-
lation shall not be interpreted to reduce the buildable
width of the corner lot separately owned at the time of
the passage of this ordinance to less than 35 feet.
(I�) To amend Section 114 to read as follows.-
VIOLATIONS AND PENALTIES:
Any person, firm, corporation or agent who shall violate
a provision of this code or fail to comply therewith, or with
any of the requirements thereof, or who shall erect, construct,
alter, demolish or move any structure, or has erected, construc-
ted, altered, repaired, moved or demolished a building or struc-
ture in violation of a detailed statement or drawing submitted
and approved thereunder, shall be guilty of a misdemeanor. Each
person shall be deemed guilty of a separate offense for each and

every day or portion thereof during which any violation of any
of the provisions of this code is committed, or continued and
upon conviction of any such violation such person shall be
punished by a fine of not less than $10.00 nor more than w200.00•
(5) Amend Section 301.1 by defining limits of Fire Districts No. 1 and
No. 2 as follows;

(6) Section 107.5 is hereby deleted.
(7) Amend Section 2201.1, paragraphs (a) and (b-1) to read as follows:
(a) One-sixth (1/6) of the width of street that is adjacent
to the curb in front of the building being erected and
for which a permit has been issued. If street in front of
property adjoining such building is to be used for simi-
larly limited storage, a due waiver of claim against the
city for damages on account of such use, issued by the
owner of such property, must be filed with the Building
Official before such use shall be allowed.
(b-1) That such one-sixth (1/6) allocated space or any portion
thereof shall not come within five (5) feet of 'a rail or
railroad track.
(8) Amend Sub-section (b) and first paragraph of Sub-section (d) Section
2201.2, Marquees or Fixed Awnings, to read as follows; and add Sub-
sections (e) and (f):
(b) The supporting frame work of fixed ceiled awnings or
marquees shall be of steel and all combustible materials
used in the construction of such awnings or marquees, shall
be protected with not less than one hour fire resistive
protection as specified in Chapter X. All glazing in
marquees or fixed awnings shall be of wired glass.
(d) No fixed awning or marquee shall extend or occupy more
than two-thirds (2/3) of the width of sidewalk measured
from the building, and except as hereinafter provided
shall not extend more than twenty-five (25) feet along
the building. The overall height of any rnarquee, in-
cluding signs, shall not exceed three (3) feet, measured
upward from the roof of such marquee, and the overall
height shall not exceed five (5) feet.
(e) Unceiled or open type wooden awnings erected over streets,
alleys or sidewalks shall be substantially attached to and
be supported by the buildings. The outer edge shall be
supported by rods or chains anchored to the building and
attached to a one and one-half inch pipe passing through
the outer ends of all awning joists.

(f) The roof deck of all awnings and marquees shall be covered
with Class 1 or 2 Roof Coverings as defined in Section 706.
Sub-section (g), Section 2303.1. shall be added to this
section, as follows;
(g) In all districts, eXcept Fire District No. 1, an all-
metal sign erected on a steel post or column in the
sidewalk space between the property and curb line will
be permitted, provided that the bottom of such sign is
nine (9) feet above the sidewalk, is not over twenty-
four (24) feet high at the highest point, does not
project closer than four (4) feet of the curb line,
and does not constitute a pedestrian or traffic hazard.
Provided also that no such permit will be granted if the
sign can be attached to the building. Such permits will
be granted from year to year and shall be renewed on
January 1 of each year.
(9) Amend Section 2201 by adding paragraph 2201.7:
2201.7 -- AIR CONDITIONERS PROJECTING OVER. SIDEWALKS
All air conditioners projecting over sidewalks shall be
substantially supported by and mounted on steel frame-
work securely attached to the building. Such air-
conditioners and supporting frame work shall be at such
a height that the lowest portion thereof will be a
minimum distance of eight feet above the sidewalk grade.
(10) Amend Section 2204.2 -- WRITTEN APPLICATION MUST BE FILED -
by adding paragraphs (f) and (g) thereto:
(f) If utility lines require adjustment, the mover shall
furnish written evidence that satisfactory arrangements
have been made with the utilities for any required ad-
justments.
(g) The mover shall present written evidence that all city
taxes due have been paid on the property to be moved.
(11) Amend Section 2204.4 by adding the following wording to this section;
"House movers regularly in business shall make a
general bond in the amount of Two Thousand ( ,;2,000) Dollars ✓ `'
conditioned on the terms of this ordinance."
(12) Amend Section 2204.5 to read as follows:
NOTICE IS TO BE GIVEN
Upon the issuance of said moving permit, the House
Mover shall cause notice to be given to the Superintendent
of Fire Alarm, Chief of Fire Department, telephone or
light companies, or others whose property may be affected
by such removal. The rouse Plover shall set forth in all
notices the route that will be taken, time started, and
approximate time of completion.
(13) Section 2301.4 is hereby deleted.
(14) Amend Section 2303.1, Paragraph (a) to read as follows:
(a) No ground sign board constructed entirely of wood material
shall be at any point over twenty-four (24) feet above the
ground level or located in Fire Districts trios. 1 or 2, but
when supports, braces, and the facing of a ground sign are
constructed entirely of steel and sheet metal, or other non-
combustible materials, such ground sign may be erected within
or without the Fire Districts and the battens, ornamental
moulding, platform, and decorative trim may be of wood ma-
terial.

(15) Amend Section 2303.2, paragraph (a) to read as f of lows:
(a) All roof signs shall be so constructed as to leave a clear
space of not less than six (6) feet between the roof level
and the lowest part of the sign and shall have at least five
(5) feet clearance between the vertical supports thereof;
no portion of any roof sign structure shall project within
five (5) feet of an exterior wall nor shall any such sign
be supported directly on an exterior wall.
(16) Amend Section 23-3.4 by adding paragraph (f) as follows:
(f) No projecting sign shall be erected with less than
nine (9) feet clearance from the bottom of the sign
to the sidewalk grade not less than four (4) feet
clearance from the end of the sign to the curb line.
(17) Amend Section 2303.5 -- MARQUEE SIGNS to read as follows;
Marquee signs shall be constructed entirely of metal
or non-combustible material, and provided further, no
such sign shall extend outside the line of such marquee.
Marquee signs may be attached to the sides and front of
a marquee, and such sign may extend the entire length
and width of said marquee, provided such sign does not
extend more than three (3) feet above such marquee and
the total vertical dimension shall not be greater than
five (5) feet.
(18) kiend Chapter XXIII, SIGNS I:ND OUTDOOR DISPLAYS; by adding Section
2305, BOND REQUIRED.
As a condition precedent to the issuance of permits
for signs and outdoor displays, a surety bond in an
amount approved by the Ridding Official shall be
executed by the person or persons desiring such per-
mits. For person or persons regularly engaged in the
sign business the said bond shall be in the amount of
Two Thousand ($2000) Dollars with a Corporate Surety"
Company licensed to do business in the State of Texas. ,
Such bond shall be made payable to the City of idichita
Falls and shall indemnify the City against any damage
to public property, public liability, and damage to
private property which may result during the erection l
of said sign or display. Such surety bond shall also f�
be conditioned upon and liable for strict compliance `
with the terms of this ordinance and the permits granted
thereunder.
(19) Amend Chapter XXIII, SIGNS ld0 OUTDOOR DISPLAYS, By adding Section
2306, TELEVISION AERIALS.
Television aerials not exceeding fifteen (15) feet
in height will not require a permit for erection. For
all television aerials in excess of fifteen (15) feet
in height a permit shall be secured before erection.
Aerials will not be allowed to be erected on flues or chim-
neys or to be anchored thereto. All aerials shall be
securely attached and braced against wind pressure.
Aerials shall not be erected so close to high tension
electric wires that in the event of collapse it would
endanger life. All aerials shall be grounded in accord-
ance with the provisions of the National Electric Code.
0ECTION II. in any part of this ordinance, or of the Southern Standard
Da.ilding Code embodied herein by reference, be held void, such part shall be
deemed severable and the invalidity thereof shall not affect the remaining parts
of this ordinance or said Code.

SECTION III. The Building Code, passed and approved May 19, 1924, and all
amendments thereto are hereby repealed. All other ordinances inconsistent
herewith are repealed only to the extent of such inconsistency.
