Min 09/16/2014 CITY COUNCIL MINUTES September 16, 2014 Page 1 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building September 16, 2014 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with the following members present. Glenn Barham - Mayor Ben Hoover - Councilors Annetta Dotson - Brian Hooker - Michael Smith - Tim Ingle - Tom Quintero - Jim Dockery - Assistant City Manager Julia Vasquez - Acting City Attorney Tracy Norr - City Clerk Darron Leiker - City Manager (Absent) - - - - - - - - Mayor Barham called the meeting to order. - - - - - - - - Item 2a - Invocation Deacon Jim Bindel, Our Lady Queen of Peace, gave the invocation. - - - - - - - - Item 2b - Pledge of Allegiance Mayor Barham led in the Pledge of Allegiance. - - - - - - - - Item 3 – Presentations – Proclamation – National Day for Kids, Boys and Girls Club Mayor Barham read a proclamation establishing September 20, 2014 as National Day for Kids. Vincent Rodriguez, Youth of the Year, thanked the Mayor and City Council for recognizing this special day for kids in Wichita Falls. He highlighted the events for National Day for Kids in Wichita Falls. - - - - - - - - CITY COUNCIL MINUTES September 16, 2014 Page 2 Item 4 - Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda. Marion Stade, 4801 Greenbriar, said she found out the city expanded to add a program to help people who could not pay their water bills. She also found out the water treatment plant is now selling effluent water. She asked if the council is double -dipping because they are selling additional water as well as increasing rates. It seems that when the council wants to do something, they listen to the people. She sugges ted that the pay increase be as small as possible and that upper management take a small er increase to allow other employees to get larger increases. - - - - - - - - Item 5 – 6c– Consent Items Assistant City Manager Jim Dockery gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Smith that the Consent Agenda be approved. Motion seconded by Councilor Ingle and carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Smith, Ingle, and Quintero. Nays: None Item 5- Approval of Minutes of the September 9, 2014 Special Meeting of the Mayor and City Council Item 6 – Resolution #97-2014 Resolution No. 97-2014 Resolution Rejecting the Bid for the 2014 Wichita River Flood Control Clearing Project Item 7a-c –Receive Minutes Minutes of the following boards and commissions were received: (a) Wichita Falls Park Board, June 26, 2014 (b) Wichita Falls Economic Development Corporation, July 11, 2014 (c) Wichita Falls 4B Sales Tax Corporation, July 25, 2014 - - - - - - - - Item 8 – Public Hearing on the 2014-2015 Preliminary Budget Mayor Barham opened the public hearing at 8:45 a.m. Jim Dockery said this is the required public hearing prior to consideration of the budget. He gave an overview of the budget. CITY COUNCIL MINUTES September 16, 2014 Page 3 Jim Ginnings, 5201 Taft Boulevard, said many were pleased to see the preliminary budget. He commended staff for creating the balanced budget. He said the inclusion of the step and merit increases equal four to four and one half percent, which exceeds the consumer price index inflation rate. The budget is responsible and gives a nice increase to employees. He said the council would do well to represent the general view of the citizenry who do not want a tax increase. Tony Ramirez, 4865 Matterhorn, spoke in support of the pay increase. He said he has been an employee for 22 years and has worked with other government agencies who are impressed with the leadership of Wichita Falls. He said he hopes the future leadership of Wichita Falls will continue to have the same support. He asked the council to be proactive and consider the pay increase. Beverly Ellis, 1605 Parkdale, expressed her concern over the proposed tax rate and budget. She discussed budget issues from past years and said employees may deserve a pay increase but not at the cost of increased service rates. She said the money for purchase of mobile laptops could have been used somewhere else. No other comments were given and the public hearing was closed at 9:02 a.m. Item 9a – Ordinance #39-2014 Ordinance No. 39-2014 Ordinance Adopting the Annual Budget for the Fiscal Year Beginning October 1, 2014 and Ending September 30, 2015, Approving Revisions to the FY 2013-14 Budget, and Declaring an Emergency Moved by Councilor Dotson that Ordinance No. 39-2014 be passed. Motion seconded by Councilor Smith. Motion amended by Councilor Smith to adopt the preliminary budget, including the amendment in the attachment to the ordinance which includes the proposed tax and pay raise increases. The amendment was seconded by Councilor Hooker. Councilor Quintero asked if there is an option to abstain. Mayor Barham said there are no provisions for abstention in the council rules. The motion to amend carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Quintero, Ingle, and Smith. Nays: Councilors Ingle, Quintero. Nays: Councilors Ingle, Quintero. - - - - - - - - CITY COUNCIL MINUTES September 16, 2014 Page 4 Item 9b – Ordinance #40-2014 Ordinance No. 40-2014 Ordinance Levying, Assessing, and Fixing the Tax Rate for the Use and Support of the Wichita Falls Municipal Government and Providing for the Interest and Sinking Fund for the 2014-15 Fiscal Year; and Declaring an Emergency Moved by Councilor Smith that Ordinance No. 40-2014 be adopted to increase the property tax rate by the adoption of a tax rate of $0.65526, which is effectively a 4.33 percent increase in the tax rate. Motion seconded by Councilor Dotson and carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Quintero, Ingle, and Smith. Nays: Councilors Ingle, Quintero. - - - - - - - - Item 9c – Ordinance #41-2014 Ordinance No. 41-2014 Ordinance Adopting the Five Year Capital Improvement Plan for the Fiscal Year Beginning October 1, 2014 and Ending September 30, 2019 Moved by Councilor Hooker that Ordinance No. 41-2014 be passed. Motion seconded by Councilor Dotson and carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Quintero, Ingle, and Smith. Nays: None - - - - - - - - Item 9d – Ordinance #42-2014 Ordinance No. 42-2014 Ordinance Amending Wholesale Water Rates of the City of Wichita Falls, Providing for Limited Codification, and Declaring an Emergency and Effective Dates Moved by Councilor Ingle that Ordinance No. 42-2014 be passed. Motion seconded by Councilor Dotson. The motion carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Quintero, Ingle, and Smith. Nays: None - - - - - - - - Item 10e – Resolution #102-2014 RESOLUTION NO. 102-2014 Resolution Authorizing the City Manager to Execute the Engineering Services Agreement with Biggs and Mathews Incorporated for Procurement, Design, and Construction of Ultraviolet Equipment for the Direct Potable Reuse Project in an Amount Not to Exceed $112,000 Moved by Councilor Hooker that Resolution No. 102-2014 be passed. Motion seconded by Councilor Quintero and carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Quintero, Ingle, and Smith. Nays: None - - - - - - - - Item 10f – Resolution #103-2014 RESOLUTION NO. 103-2014 Resolution to Approve Change Order No. 1 for the Terminal Area Project at Wichita Falls Regional Airport to Trinity-Hughes/Sundt in an Amount of $238,169 Moved by Councilor Smith that Resolution No. 103-2014 be passed. Nays: None - - - - - - - - CITY COUNCIL MINUTES September 16, 2014 Page 8 Item 11a – Staff Reports There were no staff reports. - - - - - - - - Item 11b – Items of Concern to Members of the City Council Members of the City Council presented the following matters: Councilor Dotson thanked the staff for the budget process. She asked if staff foresees additional water rates in the next six to eight months. Mr. Dockery said unless there is a future water supply development project that is identified, there are not anticipated rate increases. Councilor Quintero said the Missile Road project meeting was held. He thanked staff for answering questions. He said he believes the water infrastructure is critical to future growth for Wichita Falls. He said he would like to look at the agreement with TxDOT for grass cutting along Highways 287, 277, and I-44, particularly along City View Drive and Airport Drive. He asked who removes unused electrical poles. John Burrus said he could follow up on ownership if he is given the locations. Councilor Quintero also added his thanks to the staff for the work on the budget. Mayor Barham thanked the staff for the work on the budget. He pointed out that everybody’s total tax bill will decrease, even with this tax increase. - - - - - - - - Item 12 – Executive Session City Council went into Executive Session at 10:15 a.m. in accordance with Texas Government Code §551.071 and §551.072.
