The Board of Aldermen of the City of Wichita Falls, Texas, met in special session,
called by the Mayor, on the above date in the Memorial Auditorium Building after 4:00
o'clock P. M. , with the following members present.

W. E. Ryle

H. P. Hodge, Jr. City Attorney
Gerald Carlson Chief Accounting Officer
Alderman Jerry Mathis was absent, as he was in California.
In the absence of the City Clerk and the Acting City Clerk, the City Manager
designated H. P. Hodge, Jr. to perform the duties of the office during this meeting,
as provided in Section 2-42 of the Code of Ordinances.
r Mayor Boyd reported on his meeting with Mayor Jon Rivkin of Lakeside City concerning
the Lake Wichita--Holliday Creek project. City Manager Gerald Fox reported that the
L U. S. Army Corps of Engineers is willing, with the participation of the City, to install
an underground pipe to carry water from the Call Field irrigation canal to Holliday Creek
upstream from Lake Wichita, as part of this project.
RESOLUTION NO. 2027
RESOLUTION CONCERNING TRANSPORTATION OF WATER INTO LAKE WICHITA AND
MAINTENANCE OF LAKE WATER LEVEL AT A CONSTANT ELEVATION.
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS,
THAT:
The City will participate with the United States Army Corps of Engineers in the
cost of installing an underground pipe to carry water from the Call Field irrigation
canal to Holliday Creek upstream from Lake Wichita.
After the completion of such project, the City will utilize this facility and
operate Lake Wichita to the best of its ability to maintain the water level in Lake
Wichita at a constant elevation of 976 feet m.s.l.
Moved by Alderman McAlister that Resolution No. 2027 be passed.
Motion seconded by Alderman Ryle, and carried by the following vote:
Ayes: Aldermen McAlister, Bassett, Russell, Ashbrook and Ryle.
Nays: None
City Attorney Hodge explained the requirements of Senate Bill No. 411, 65th
Legislature, which provided that any governing body may, not later than October 28, 1977,
elect to exempt itself from such statute. Hodge stated he thinks this statute does
1 not apply to Wichita Falls, but recommended that the Board of Aldermen act to exempt
Wichita Falls from this statute.
yRESOLUTION NO. 2028
RESOLUTION ELECTING TO EXEMPT THE CITY OF WICHITA FALLS FROM THE REQUIREMENTS
OF SENATE BILL NO. 411, 65TH LEGISLATURE, VOLUNTEER FIRE FIGHTERS' RELIEF AND
RETIREMENT FUND.
WHEREAS, Senate Bill No. 411, enacted by the 65th Legislature, created a volunteer
fire fighter's relief and retirement fund, and provided that any governing body may,
not later than October 28, 1977, elect to exempt itself from the requirements of such
statute, and provided that such exemption may be rescinded by the governing body at
any time; and,

WHEREAS, although it appears that the City is not presently subject to this
statute, it may in the future become subject to it; in that event, the governing body
at that time should have the discretion to elect whether or not to be exempt from such
statute.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
The Board of Aldermen hereby elects to exempt itself and the City of Wichita
Falls from the requirements of such Senate Bill No. 411.
This resolution is effective from its passage.
Moved by Alderman Ashbrook that Resolution No. 2028 be passed.
Motion seconded by Alderman Bassett, and carried by the following votes:
Ayes: Aldermen McAlister, Bassett, Russell, Ashbrook, and Ryle.
Nays: None.
The Board of Aldermen adjourned the special meeting.
