Min 04/09/1976135 Wichita Falls , Texas Memorial Auditorium Building April 9, 1976 Item 1 The Board of Aldermen of the City of Wichita Falls, Texas , met in called session on the above date in the Council Room of the Memorial Auditorium Building at 2 :00 o'clock P.M. , with the following members present: J. C. Boyd , Jr. Mayor Hardy McAlister X Dr. Guillermo Garcia Bill E. Gowan X Aldermen Ray Ashbrook X W. E. Ryle X Jerry F. Mathis X Gerald Fox City Manager H. P. Hodge, Jr.City Attorney Wilma J. Thomas Deputy City Clerk Gerald Carlson City Clerk Mayor Boyd stated that this meeting had been called at the request of Roy Parish for a recount of votes cast for Place 6 at the election held April 3, 1976. Alderman McAlister questioned the purpose of $10.00 per box. It was pointed out by the City Manager that it was to pay the recount committee. Alderman Mathis inquired who his representative would be since he had been sworn in. The City Attorney explained that he could either be there in person or that he could designate someone in writing to be his representative. Alderman Ryle inquired if the recount showed a change in the results, who would pay for the cost of it. The City Manager stated it would be the City. RESOLUTION NO. 1796 RESOLUTION ORDERING A FULL RECOUNT OF ALL VOTES CAST FOR THE OFFICE OF ALDERMAN, POSITION NO. 6 AT THE MUNICIPAL ELECTION HELD ON APRIL 3, 1976, APPOINTING THE RECOUNT COMMITTEE, AND SETTING THE DATE FOR THE RECOUNT. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The written application requesting a full recount of all votes cast for the position of Alderman, Position No. 6, at the municipal election held on April 3rd, 1976, which application was filed by Roy W. Parish with the Mayor on April 6th, 1976, is proper and in compliance with Article 9.38a of the Texas Election Code. It is therefore ordered that such recount shall be conducted ; the recount shall begin at 8:00 o'clock A.M. on Monday, April 12th, 1976 and shall be completed as soon as practicable thereafter. The report of the Recount Committee shall be presented to the Mayor on April 19th, 1976; the Board of Aldermen shall, at its meeting on April 20th, 1976, consider the report of the Recount Committee, and shall declare the result of the election for the office of Alderman, Position No. 6, on the basis of the revised returns as shown by said report. The recount will be conducted in the office of the Deputy City Clerk in the Memorial Auditorium Building. The Recount Committee shall be composed of Mrs . Elwyn Ponder, Mrs. Raymond Sims and Mrs. Vance Harbor; Mrs. Elwyn Ponder is designated to serve as chairman of such committee. The City Clerk and the City Attorney are directed to prepare and distribute all necessary notices and orders as required by the Texas Election Code, in order legally to carry out the recount. 136 Item 1 cont'd . Moved by Alderman McAlister that Resolution No. 1796 be passed. Motion seconded by Alderman Garcia, and carried by the following vote: r, Ayes : Aldermen McAlister, Garcia, Gowan, Ashbrook, and Ryle Nays : None (Alderman Mathis did not vote since he is now holding this position) Moved by Alderman Gowan that the meeting be adjourned. Motion seconded by Alderman McAlister, and carried unanimously. The Board of Aldermen adjourned at 2:15 P.M.
