D. 1954., City Clerk, City of Wichita Falls., Texas City of Wichita Falls ,___. ,_ Ordinance No. ) '2.1 AN ORDINANCE CLOSING IN AND ABANDONING THAT PORTION OF MADISON STREET LYING IMMEDIATELY NORTH OF BLOCK 23, ORIGINAL TOWNSITE OF WICHITA FALLS, WICHITA COUNTY, TEXAS WHICH LIES IMMEDIATELY WEST OF THE RAIL- ROAD RIGHT -of -WAYS CROSSING SAID STREET AT THIS POINT AND ALSO LYING IMMEDIATELY TO THE EAST OF TEXAS STATE HIGHWAY NO. 5,- ,,WHICH IS A CONTINUATION OF NORTH SCOTT STREET IN SAID CITY: WHEREAS, the Missouri --- Kansas -Texas Railroad Company of Texas and Kimbell and Bostic has requested the-Board of Aldermen of the City of Wichita Falls, to close and abandon all of tract portion of Madison Street lying immediately North of Block 23., Original Townsite of Wichita Falls, Wichita County, Texas and also lying immediately to the West of the Railroad right -of -ways crossing Madison Street at this point, and lying immediately east of Texas State Highway No. 5, which is a continuation of North Scott Street In said city; and the board of Aldermen after consideration of the petition and finding that all of the property which will be served by that portion of a said street saht to be closed and abandoned belongs to petitioners and deem it'—to be in the best interest of the property owners that the street be closed and abandoned and that the closing of said street would not effect the rights of the general public in any manner: NOW THEREFORE, be it ordained by the.Board of Aldermen of the City of Wichita Falls, Texas: I. That the portion of Madison Street of Block No. 23, Original Townsite of Wichia bounded on the East by the Railroad Right -of Madison Street, and bounded on the West by T which is a amtinuation of North Scott Street abandoned. II. lying immediately north Falls, Texas being ways crossing said axas State Highway No. 5 is hereby closed and This ordinance is passed for the purpose of assisting the property owners who own the property on each side of said street as above described to secure the better use of their property and for the purpose of releiving the City of Wichita Falls from any further expense and liability for the maintenance and upkeep and said portion of Madison Street hereby closed and abandoned. Rugeley, Director of Public Aorks SUBJECT:: CLOSING PORTION OFF MADISON STREET COMMENT: Referring to the December 3, 1954 request of the Missouri - kansas -Texas Railway Company for a closing of a portion of Madison Street, this is to advise you that to my knowledge this part of Madison Street has never been open to the public use and has for many years been enclosed Yrithin the properties which were formerly occupied by the American Refining Company. The City of Wichita Halls has no utilities ,in this area and inasmuch as this portion of this street is cut off by the ramp to the Forth Scott overpass, I don't see how we could ever need it for street purposes. A. Scott No. 15, Sur., Abstract 307 in the City of Wichita Falls, Wichita County, Texas; also lying immediately west of the railroad right --of-ways passing over Madison Street; and lying immediately east of Texas State High- way No. 5, a continuation of North Scott Street in said city and would show the Honorable Board of Aldermen the following: That all of the property surrounding this portion of Madison Street is owned by the Missouri- Kansas -Texas Railroad Company of Texas except a small portion, which is now owned by Kimbell and Bohner =, who hereby join in this petition as evidence of their consent to the closing of such street. That said portion of Madison Street has never been used as a street and has never been maintained by the City of Wichita Falls, Texas as a street.. That since the portion of Madison Street involved is completely surrounded by the property of petitioners herein and since it would be in the best interest of the property owners and would not effect the rights of the general public in any matter, petitioners hereby pray that the Board of Aldermen close and abandon said portion of Madison street in accordance with this petition.
