Ord 1706 11/22/1954ORD INANCE NO .r I� AN ORDINANCE CREA7ING A BOARD OF LITERARY REVIEW TO BE KNOWN AS THE BOARD OF REVIEW FOR JUVENILE READERS; PROVIDING THE NUMBER OF MEMBERS, THEIR ELIGIBILITY AND METHOD OF APPOINTMENT; PROVIDING THE DUTIES AND AREAS IN WHICH THE BOARD SHALL NOT ACT; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. There is hereby created a board. of literary re-- view for the City of Wichita Falls which shall be known and desig- nated officially as'The Board of Review for Juvenile Literature and Entertainment." SECTION 2. The Board of ,Review shall consist of nine (9) r members, each of whom shall be a resident citizen of the City of Wichita Falls. The members shall be appointed by the Mayor, with the approval of the Board of Aldermen. The Mayor shall designate one of the members as Chairman and one as Vice Chairman and one as Secretary upon the appointment, the same to be with the approval ..of the Board of Aldermen. Members serv.e.. for..a _period of - two (2) years unless removed for a cause. All vacancies shall be filled by the Mayor with the approval of the Board of Aldermen as herein- before provided. In addition there shall be three (3) ex officie members of the Board of Review, as follows: a member of the Legal Department of the City of Wichita Falls, to be selected by the City Attorney; a representative of the Police Department of the City of Wichita Falls, to be designated by the Chief of Police; a member of the Board of Aldermen to be appointed by the Mayor with the approval of the majority of the Board of Aldermen. SECTION 3. Promptly after the passage of this ordinance and the appointment of the Board of Review, the Chairman shall call a meeting of such board and the board shall make such rules and regulations for the orderly conduct of its affairs as it may see fit, consistent with the provisions of this ordinance. SECTION 4. It shall -�be the duty of the Board of Review to keep informed of the contents of literary and pictorial publications found in the City of the nature described in Ordinance No. and call to the- ._attention of the proper prosecuting authorities any literary ox-pictorial publication which the Board believes E - l� should be investigated by the prosecutor to determine whether or not it tends to the corruption of the morals of minors or to incite minors to disregard the law of the land. The board shall have the right to express its views as to the propriety or legality of any publication read by minors, but the board shall not have the right to enforce its views by any direct or indirect threats to prosecute any persons who disagree with the board, whether such threats are made openly or covertly to the publishing, distributing or retailing trade.. The board may take whatever means it believes necessary to suppress any literature which it believes detrimental to minors. SECTION 5. If any section, subsection or any part of this ordinance shall be held to be unconstitutional or inoperative, such invalidity shall not affect any of the remaining portions thereof, it being the express intention of the Board of Aldermen to enact constitutional and operative provisions and they would not have included any unconstitutional ox inoperative provision if they had known of such invalidity at the time the ordinance was adopted. SECTION 6.
