Ord 1732 9/8/1955ORDINANCE NO. 1732 AN ORDINANCE AMENDING SECTION 1 AND SECTION 2 OF ORDINANCE NO. 1731, PRESCRIBING THE PROHIBITED HOURS OF THE LOITERING OF MINORS, AND THE RESPON- SIBILITY OF PARENTS OF MINORS, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS: That SECTION 1 of Ordinance No. 1731 is hereby amended so that the same shall hereafter read as follows: SECTION 1. Loitering of Minors Prohibited. It shall be unlawful for any minor under the age of twenty (20) years to loiter, idle, wander, stroll, or play in or upon the - public streets, highways, roads, alleys, parks, playgrounds, or other public grounds; public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, between the hours of 11 :00 P.M., and 4:00 A.M., of the following-day', Central Standard Time, on Sundays, Mondays., Tuesdays, Wediies'd.ays, .Thursdays and Fri- days, and between the hours of 12:00 midnight 'on Saturdays and 4:00 A.M.; one- Sundays; provided, however, that the pro- visions "of this Section do-not apply to a minor accompanied by his or her parent, guardian, or an adult person, or where the minor is upon an emergency errand or legitimate business, directed by his or her parent,guardian or other adult person, having the care and custody of the minor; and provided,how- ever, that the provisions of this Section do not apply to a minor when any school, or schools, has a night contest on said day in the City of Wichita Falls, by any high school, or college, and on such date of said Home Game of any team: having such a regular scheduled contest on its home grounds, such hours are hereby extended to 12 :30 A.M., and 4 :00 A.M., of the following day. Each violation of this Section shall constitute a sep- arate offense. That SECTION 2 of Ordinance No. 1731 is hereby amended so that the same shall hereafter read as follows: SECTION 2. Responsibility of Parents. It shall be un- lawful for the parent,guardian or other adult person having the care and custody of a minor under the age of twenty (20) years, to knowingly permit such manor to loiter, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks,,playgrounds, or other public grounds, public places, and public buildings, places of amusement and enter- tainment, vacant lots, or other unsupervised places, between the `hours of 11:00 P.M., and 4:00 A.M., of the following day, Central Standard Time, on Sundays, Mondays, Tuesdays, Wednes- days,Thursdays, and Fridays, between the hours of 12 :00 mid- night on Saturdays 'and'4.00 A.M., on Sundays.; provided, how- ever, that the provisions bf this Section do not apply when the minor is accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, orother adult person having the care and custody of the minor, and provided, however, that the provisions of this Section do not apply to the minor when.any school, or schools, has a night contest on said day in the City of Wichita Falls, by any high school or college, and on such date of said Home Game of any team having such a regular scheduled contest on its home grounds, such hours are hereby extended to 12:30 A.M., and 4:00 A.M., of the following day. mom° Each violation of the provisions of this Section shall constitute a separate offense. SECTION 3. This Ordinance is passed as an emer- gency measure, and the Board of Aldermen does by the vote by which this ordinance is amended and passed, hereby de- clare that an emergency exists, which makes it imperative that this amended ordinance shall become effective forth- with, the nature of said emergency being as follows: That it is necessary to preserve the public peace, safety, health, morals, and welfare by restricting the presence of minors in the streets and other public places for the purposes of curtailing juvenile delinquency by making this ordinance effective immedia&ely.
