AN ORDINANCE GRANTING MISSOURI-KANSAS-TEXAS RAILROAD
C014PANY OF TEXAS THE RIGHT , PRIVILEGE AND FRANCHISE
TO CONSTRUCT, MAINTAIN AND OPERATE A SPUR TRACK IN,
UPON, OVER AND ACROSS LAKE STREET AND IN, UPON, OVER
AND ACROSS AN ALLEY SITUATED IN BLOCK E OF THE N
GRANGER AND BALLOW ADDITION TO THE CITY OF NTICHITA
FALLS, WICHITA COUNTY, TEXAS, AND "TO OPERATE ITS
TRAINS, ENGINES AND CARS THEREON
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS:
x� Section 1. That the Plissouri-Kansas-Texas Railroad
1 Company of Texas, its successors and assigns , be and it is here-
by grEnted the right , privilege and franchise to construct ,
maintain and operate a spur track in, upon, over and across _
Lake Street and in, upon, over and across an alley, both tracts '
being situated in Block E of the Granger and Ballow Addition out

of the J. A. Scott Survey No. 12 in the City of Wichita Falls , )31

Wichita County, Texas, the center line of the said spur track
over and across said tracts of land being more particularly de-
scribed as follows:
Commencing at the point of intersection of the
center line of Lake Street with the center line of
the TIssouri-Kansas-Texas Railroad Company of Texast
Henrietta Subdivision main track, distant 89.5 feet
measured northerly along the center line of Lake
Street from its point of intersection with the cen-
ter line of Granger Street;
Thence northwesterly, along the center line of
said main track, a distance of 14 feet to point of
beginning at the point of switch of said spur track
at main track chaining station 7066 plus 36.5 ;
Thence northwesterly, through a number six (6)
turnout to the left , a distance of 15.06 feet to a
point of ending on the west line of Lake Street;
Thence continuing northwesterly, through a 4
number six (6) turnout to the left, a, distance of
32.44 feet to a point of frog; ,
Thence northwesterly, by tangent to last de- ;
scribed frog, a distance of 7.5 feet to a point of
curve;
Thence northwesterly, by arc of curve to the
left, having a radius of 229.19 feet, a distance of
80.07 feet to point of beginning on the east line
of said 12-foot alley;
Thence continuing northwesterly, by arc of
curve to the left, having a radius of 229 .19 feet,
a distance of 3.93 feet to a point of tangent;
Thence westerly, by tangent to last described
curve, a distance of 8.09 feet to point of ending
on the west line of said 12-foot alley, same being
the east lane of Lot No. 3 in said Block E, distant

9.5 -feet measured northerly along said east line of
Lot No. 3 from the southeast corner thereof;
All as shown on print of drawing No. A-26,160,
Engineering Department , Dallas, Texas, dated July 10,
1956, attached and made a part hereof.
Section 2. It shall be the duty of said Railroad
Company, its successors and assigns, to, at all times, main-
tain at its expense said street and alley crossed by said
spur track between the rails thereof and . for two (2) feet on
each side of said spur track.
Section 3. Said- Railroad Company, its successors
and assigns, shall save the City of Wichita Falls harmless
from all damages, .or claims for damages, resulting from the
construction, maintenance and operation of said spur track
constructed hereunder or resulting from any operation of cars
thereon.
Section 4. That the right , privilege and franchise
hereby granted is for a period of twenty-five (25 ) years from
the date of this ordinance.
Section 5. This ordinance shall take effect and be
in force from and after its passage.
