Ord 1764 3/12/1956Section 2. It shall be the duty of said Railroad Company, its successors and assigns, to, at all times, main- twin at its expense said street and alley crossed by said spur track between the rails thereof and for two (2) feet on each side of said spur track. Section 3. Said Railroad Company, its successors and assigns, shall save the City of Wichita Falls harmless from all damages, or claims for damages, resulting from the construction, maintenance and operation of said spur track constructed hereunder or resulting from any operation of cars thereon. Section 4. That the right, privilege and franchise hereby granted is for a period of twenty -five ( 25) years from the date of this ordinance. Section 5. In resolving this matter, it will be necessary that the I-» T retain the right and franchise to construct such a spur track in, upon, over and across Park Street, Block B of the Granger and Ballow Addition. Our attorneys prepared an ordinance which I am attaebing hereto. If this ordinance, as prepared by our attorneys is satisfactory to the City of Vichita Falls., I respectfully request that you handle it with the City.Council in the usual manner for authority and execution.
