Ord 1754 4/23/1956ORDINANCE NUMBER AN ORDINANCE CREATING A CITY - COUNTY WELFARE BOARD FOR THE CITY OF WICHITA FALLS; PROVIDING FOR THE APPOINTMENT OF ITS MEMBERS; SETTING OUT THEIR POWERS AND DUTIES; PRESCRIBING THE NUMBER AND QUAL- IFICATIONS OF ITS MEMBERS AND THEIR TERM OF OFFICE AND THEIR JOINT APPOINTMENT BY THE CITY OF WICHITA FALLS AND WICHITA COUNTY, TEXAS; MAKING DEPARTMENT HEADS AND OFFICIALS OF THE CITY OF WICHITA FALLS AVAILABLE TO THE WELFARE BOARD; MAKING THE RECORDS OF THE WICHITA GENERAL HOSPITAL AND OF ANY OTHER AGENCIES OF THE CITY OF WICHITA FALLS AVAILABLE TO SAID BOARD; PRESCRIBING THE POWERS AND DUTIES OF THE CITY-COUNTY WELFARE BOARD AND PRESCRIBING ITS JURISDICTION: AND DECLARING AN EMERGENCY, WHEREAS, The Commissioners Court of Wichita County, Texas, have heretofore, on the 9th day of April, A. D. 1956, passed and entered on the Minutes of the Commissioners Court the following described Order: 110R DER "At'a meeting of the Commissioners Court'of Wichita County, Texas, held on the 91L'1h day of April, 1956, with the following members present: Hon. Guy H. McNeely, County Judge Kelley Gilbreath; Commissioner; Precinct Noe 1 G; Clark Gresham, Commissioner, Precinct No. 2 E; E; Boyles; Commissioner; Precinct No. 3 H, H. Haynes, Commissioner, Precinct No. 4 (6433 -C) Motion made by Mr. Gresham and seconded by Nlr a ' Haynes that Alvin Hill of Burkburnett, Precinct No; 2, and Mrs, Abbey Cooper of Electra, Pre- cinct No. 41 be named To act as members of the City - County Welfare Board created by Ordinance 1716, City of Wichita Falls Ordinance Code with the same powers as given by said Ordinance No, 1716. The terms of these two members shall be for two years from this date. It being agreed by the City of Wichita Falls arid the County of Wichita that the County shall have the right to fill the next vacancy on the City -- County Welfare Board and the person appointed to fill such vacancy sh=ill hold office for the remainder of the unexpired term of the person vacating his place on said City - County Welfare Board. It being further agreed that the Commissioners Court of Wichita County shall have the right to name three members of the City- County Welfare Board and the Board of Aldermen of the City of Wichita Falls shall have the right to name four members of the Board in the manner provided by'Ordinance No. 1716 of the City Ordinance of Wichita-Falls., Texas. Motion carried unanimously," A certified copy of which is attached hereto to further iden-, tify said Order; and WHEREAS, the City of Wichita Falls has heretofore-appointed and created a Welfare Board under Ordinance No. 1716, consisting of five (5) members; and WHEREAS, it is necessary for the protection of the public health and to protect the further expendituPe of funds of said City and County, to amend said Ordinance No, 1716 to conform to the present Order of the Commissioners Court quoted above, together with the thinking of the present Board of Aldermen of the City of Wichita Falls; and in order to promote the public welfare of said City and County, it is advisable that Ordinance No. 1716 be amend- ed. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: THAT Ordinance No. 1716 be and the same Is hereby amend- ed so that it shall hereafter read as follows: SECTION 1. That there is hereby created a City - County Welfare Board for the City of Wichita Falls, Texas, in coopera- tion with Wichita'County, Texas, composed of (not less than) seven (7) persons, four of whom shall'be resident tax paying citizens of the City of Wichita Falls, Texas, and three'of whom shall be resident tax paying citizens of Wichita County, Texas, without the requirement of corporate residence, and each shall serve without pay. SECTION 2. The Mayor of the City of Wichita Falls shall appoint four (4) members to the Board and each person so appointed must be approved by the Board of Aldermen of the City of Wichita Falls before becoming a member thereof (Persons heretofore ap- pointed shall continue in office). The Commissioners Court of Wichita County, Texas, may in any manner that it sees fit appoint three (3) members to the said City- County Welfare Board as soon as practicable. ' a. After the final passage of this Ordinance, the Mayor, with the approval of the Board of Aldermen, shall certify to the Commissioners Court of Wichita County, Texas, the four (4) members to such board who have heretofore been appointed and are now accepted as members of said Board, and the terms of said membership shall be staggered for one, two and three years so that not more than two persons shall be appointed in any one year to replace individuals appointed and acting as members of such board udder appointment by the Mayor of the City of Wichita Falls, Texas. b, The Commissioners Court of Wichita County, Texas; having heretofore appointed Mr. Alvin Hill of Burkburnett, Texas, and Mrs. Abbey Cooper of Electra, 'texas, as members of the - City- County Welfare Board, for a term of two years from this date, said appointment is hereby accepted by the City of Wichita Falls, Texas,'and in'the future the Commissioners Court of Wichita County, Texas, shall appoint one (1) member per year to said City - County Welfare Board who shall serve for a period of three (3) years and hence, not more than one (1)'person shall be appointed to said Board, in the future, annually, by the Commissioners Court of Wichita County, Texas. c. The terms of office of the members of such Board shall be staggered so that the City of Wichita Falls will appoint one new member to the Board in 1957 and the Commissioners Court of said County of Wichita shall appoint one new member to the Board in the year of 1957, and that thereafter appointments shall be made by either the City or County, as vacancies shall occur or terms of office shall expire on the part of the members theretofore appointed by each agency. d. In the event of a vacancy on the Board the same shall be filled by the Mayor with the consent of the Board of Aldermen, or the Commissioners Court, as the case may be, and such appointment shall'be for-the'remaInder•of the term of the vacating member. e. Any member of the City- County Welfare Board may be removed from his office at any time by a five - seventh majority vote of the Board of Aldermen of the City of Wichita Falls, Texas, in the event said Board of Aldermen ratified the appointment of such member, or by`a five- seventh majority vote of the City - County Welfare Board, as the case may be, with- out any reason being given therefor. - 2 - SECTION 3. All department heads and officials of the City shall be available to the Board for advice and consultation and they shall cooperate with and render such services for the Board as shall come within the scope of the duties of such.de- partment head and officials. All such department heads and of- ficials shall attend meetings of the City -- County Welfare Board upon written'request of the Board, or its duly authorized. official or officials. SECTION 4. The City - County Welfare Board shall elect one of its members as Chairman and one as Vice - Chairman, and shall elect one of its members as Secretary, who shall keep the Minutes of the Proceedings of such Board and shall take care of the cor- respondence or communications necessary to the conduct of the Board, The Chairman or Vice - Chairman in his absence, shall pre- side at all meetings of the City - County Welfare Board and all communications to the Board shall be addressed in care of the Chairman. The Secretary of the Board shall send both the ,County and the City a report of each of its meetings. SECTION 5. The City - County Welfare Board shall have the power and it shall be its duty: (a) To make studies and project plans for the proper development of 'a Welfare project of the City of Wichita Falls, with a view of cutting down the costs now paid by the City and County in the care and treatment cf indigent persons; (b) To make plans and studies of the operation of the Wichita General Hospital in said City with the view of giving the parties all advice and recommendations towards the economical operation of such hospital;. (c) To confer with and advise the County and City Officials and the Board of Aldermen on all matters affecting the public health of this City;. (d) To aid and assist the Board of Aldermen of the City of Wichita Falls in the preparation of budgets and determination of sources of funds and in the procuring of financial and otherlass13tance for the City in its maintenance and operation of its. health and welfare agencies; (e) To act with and assist all other municipal and governmental agencies and particularly the Board of Aldermen of the City of Wichita Falls, in the proper plans for municipal government and growth_in the field of public health and welfare; (f) The Board shall from time to time recom- mend to the Board of Aldermen the passages of such or- dinances as may be necessary for the carrying out of its program. SECTION 6. The City - County Welfare Board as herein con- stituted shall, in all things cooperate with the jointly appointed Board of the Wichita General Hospital, which operates such hospital. SECTION 7. The fact that the City of Wichita Falls and *-he Commissioners Court of Wichita County, Texas, do not now have a ,oint City - County Welfare Board advising them, creates an emer- 'gency for the protection of the public health and the general wel- fare of this City and this ordinance shall be and is declared to be an emergency ordinance and is effective from and after the date of its passage.
