AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO. 1416 SO AS
TO ALLOW HOLDERS OF PACKAGE STORE PERMITS, RETAIL DEALERS ON -PRE-
MISES LICENSE AND RETAIL DEALERS OFF- PREMISES LICENSE, WHO ARE IN
BUSINESS IN AN AREA WHEN THAT AREA IS ANNEXED TO THE CITY LIMITS
OF THE CITY OF WICHITA FALLS TO CONTINUE IN BUSINESS IN THAT LOCA-
TION, AND DEFINING THE WHOLESALE LIQUOR DEALERS WHO ARE EXCEPTED
FROM ORDINANCE NO. 14169, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS:
SECTION 1. That Section 4 of Ordinance No. 1416 is hereby
amended so as to hereafter read as follows
In recognition of the principal of continijance of non -con-
forming use, when an area is annexed to the City Limits of the
City of Wichita Falls, Texas, that contains businesses operating
under a package store permit, a retail dealers on- premises license
or a retail dealers off- premises license as defined by the Texas
Liquor Control Act, those existing businesses shall be allowed to
continue in the same location with the right to transfer said per-
mit or license.
That Ordinance No, 1416, as amended, shall not apply to li-
quor wholesalers with the following types of license:
General Distributors License, Local Distributors License,
Branch Distributors License or Wholesalers Permits, as V
the same are defined by the Texas Liquor Control Act.
SECTION 2, The fact that the City has recently annexed areas
containing retail beer and liquor buildings and the fact that the
sale of into,,.icating liquors has already been authorized and legal=
ized within the corporate city limits of the City of Wichita Falls,
Texas, and that the establishment of places of business outside of
the district defined in Ordinance No. 1416, as amended, would jeo-
pardize the peace and health of citizens within the residence dis-
tricts of said City, creates an emergency, and this ordinance is
hereby declared an emergency on the ground of urgent •public .need
for the preservation of peace, health and safety of property, and
this ordinance shall take effect from and after its passage and'
approval.
