AN ORDINANCE AMENDING ORDINANCE 1V0 - -:'1755, AND AMENDING
SECTION 30 .OF ORDINANCE 1641, . SO THAT THE SAME SHALT. READ
AS HEREIN SET OUT; PROVIDING FOR A CITY TRAFFIC CChgMtISS ION,
THE APPOINTMENT OF ITS MEMBERS_, THEIR TERMS OF OFFICE, POWERS
AND DUTIES OF' SUCH COMMIISSION, AND DECLARING AN EMERGENCY.
WHEREAS, objection has been made that the organization
of the present City Traffic Commission as set out in Ordinance
1755, an Ordinance amending Ordinance No. 1641, Section 30, is
such as to make the securing of a quorum difficult; and,
WHEREAS, it is desirable to build good -will for the
Traffic Program for the City of Wichita Falls, and particularly
to educate the public as to the- d es irabi 1 ity of the Traffic
Program promulgated by the City of Wichita Falls; and,
1R1HEREAS, there are various interested citizens in this
community who aye well qualified to assist in this Traffic
Program and in order to protect the safety and welfare of the
citizenship of this community, it is desirable that the mem-
bership of the City Traffic Commission be changed and to that
effect this Ordinance shall supplant Ordinance No. 1755, an
Ordinance amending Section 30 of the Traffic Code which shall
hereafter read as amended.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS:
SECTION 1. That Ordinance No. 1755, an Ordinance amend-
ing Section 30 of Ordinance No. 1641, be
and the same is hereby amended so that it shall hereafter read
as follows:
"Section 30. TRAFFIC COMMISSION ITS POWERS
There is hereby established a Traffic Commission
which shall hereafter be designated as the City Traffic
Commission.
(a) The members of such commission shall be ap-
pointed by the Mayor with the approval of the Board
of Aldermen of the City of 'Wichita Falls, and such
members shall serve without pay.
(b) In appointing such commission the Mayor
shall consider representative citizens who meet the
following qualifieations
(1) One individual who is connected with the
State Highway Department, who resides in the City of
Wichita- Falls, Texas.
(2) One individual who is connected with the
State Highway Patrol, who resides in the City of Wichita
Falls, Texas.

(3) one individual who is connected with the
Wichita Falls Independent School District and who re-
sides in the City of Wichita Falls, Texas.
(4) one individual who is connected with tither
the public press, or some other publicity medium.
(5) One individual who shall be a recognized
member of the Wichita County Bar Association.
(6) One individual who is connected with the
Wichita Falls Citizens; Safety Council, who resides in
the City of Wichita Falls, Texas.
(7) One individual who is connected with the
Retail Merchants Association, or some industry which
has to do with the shipping or transportation of goods
and merchand ise.
(8) Four individuals who have shown interest in
the traffic program of the City of Wichita Falls, Texas,
who reside in the City of Wichita Falls, Texas.
(c) The commission shall elect its Chairman and Vice -
Chairman. The Traffic Engineer shall act as Secretary to
the Commission but shall have no vote thereon.
(d) It shall be the duty of the City Traffic Commission
to pass upon the desirability of all traffic regulations
for the City of Wichita Falls, and they, in turn, shall
report to the Board of Aldermen of such City, the desira-
bility of appropriating funds, expending funds, and pass-
ing municipal ordinances controlling traffic; it shall have
the power to conduct hearings, to take testimony, to sub-
poena witnesses, to administer an oath to witnesses, and
to make any and every kind and character of investigation
that in their opinion would help to solve any traffic
problem within said City.
(e) proposals submitted by the Traffic Engineering

of the City Traffic Commission before they shall be sub-
mitted to the Board of Aldermen.
(f) It is further provided that the City Traffic Com-
mission as herein constituted, may at its discretion re-
quire the attendance at any of its meetings any city em-
ployee, or official., who in the opinion of the Commission
should be available for consultation or advice.
(g) Terms of the Commissioners shall be for three (3)
years, with the present terms thereof staggered as follows:
four (4 ) members . shall be appointed for one year terms;
four (4) members for two year terms, and three (3) members
for three year terms. In his first appointments the Mayor
shall appoint the members and designate the length of their
terms; thereafter their terms shall be fixed at three (3)
years. Any interim vacancy on the Traffic Commission
shall be filled as in the case of an original appointment,

but for the unexpired term.
(h) Any member missing two consecutive regular
meetings for reasons not acceptable to the Traffic Com--
mission, shall upon recommendation of the Traffic Com-
mission be replaced by the Mayor with the approval of
the Board of Aldermen of the City of Wichita Falls.
(i) Before a recommendation will be made to
the Board of Aldermen, it must be approved by a majority
of the Traffic Commission present, and voting; except,
in no case will a recommendation be made to the Board of
Aldermen unless such recommerion has received four af-
firmative votes by the City Traffic Commission."
SECTION 2. Any ordinances in conflict herewith, are
hereby in all things repealed.
SECTION 3. If any portion, section or subsection, of this
ordinance shall be held to be unconstitutional, or void for
any reason, the balance of such ordinance shall remain in full
force and effect.
SECTION 4. The fact that it is desirable to obtain a Com-
mission of the kind and character herein provided for, to im-
mediately start functioning as a City Traffic Commission in
order to protect the public safety and welfare; this Ordinance
is passed as an emergency measure and shall be effective from
and after the date of passage.
