AN CRDINANCE CALLING A SPECIAL ELECTION ON DAY OF

O SECTIONS 5 AND 16 (a) OF THE URBAN R ENE iAIAL LAW OF TEXAS;
DESIGNATING THE PLACES AT WHICH SAID ELECTION IS TO BE HELD;
APPOINTING ELECTICN OFFICIALS THEREFCR; PROVIDING FOR THE FORM
OF NOTICE THEREOF AND THE FORM OF BALLOT FOR USE IN SAID ELECTION;
AND DECLARING AN EMERGENCY.
S�JfiEREAS, pursuant to a Resolution duly adopted on the 12th
day of May, 1958, and a Notice duly published in the May 13 and
May 20 issues of the Wichita Falls Record News, in the City of Wichita
F a l'l s, Wichita County, Texas, the official newspaper of the
City of Wichita Falls, and a newspaper enjoying a general circula-
tion throughout said city, and in accordance with said Resolution,
the Board of Aldermen of the City of Wichita Falls, Texas, on the
14th day of July, 1958, at a called session of the Board of Aldermen
convened at its regular meeting place in the City Council Room of
the Memorial Auditorium in Wichita Falls, Texas, and held a public
hearing on the question of whether or not said Board of Aldermen
will order an election as required by the Urban Renewal Law of the
State of Texas, to determine if the Board of Aldermen should adopt
a certain Resolution under said Law, substantially in the form set
forth in the form of notice contained in Section 3 hereof; and,
14'lri- EREAS, such public hearing was continued to the next regular
meeting of the Board of Aldermen of the City of Wichita Falls, held
at the same place and in a like manner, on the 28th day of July,
1958, at which time further hearing was had on the proposed Urban
Renewal matters; and,
WHEREAS, such hearing was not closed but was continued and ex-
tended until the next regular meeting of the Board of Aldermen, to
be held on August 11, 1958; and,
',WHEREAS, at a regular meeting duly convened on the 11th day
of August, 1958, the said public hearing on the Urban Renewal matter
was not closed but was continued and extended until the next regular
meeting of the Board of Aldermen on September 8, 1958; and,
',.!HEREAS, on the 8th day of September, 1958, the said Board of

aldermen dull,,' convened in regular session, again took up the matter of
Urban Fenewal and the said public hearing, was again continued and elctended
to the next regular meeting of the Board of Aldermen to be held on the 22d
day of Seat e;,ber, 1958; and,

after due consideration of said question and of the matters

Board of Aldermen of the City of Wichita. Falls, Texas, should
adopt a resolution substantially in the form set forth in the form
of notice contained in Section 3 hereof.
SECTION 2. The said election shall be held in accordance with
the provisions of the Constitution and Laws of the State of Texas,
and only duly qualified resident electors of the City of Wichita
Falls, who own taxable property within said city and who have duly
rendered or have been assessed on the same for taxation, shall be
qualified to vote.
SECTION 3. That notice of said election shall be given by
posting a copy of the notice containing a sub-
stantial copy of this ordinance at the City Hall and at a public
place in each of the election precincts of the City not less than
thirty (30) days prior to the election. The notice to be given
shall include substantially the following:

BOARD OF ALDERMEN OF A CERTAIN RESOLUTION PURSUANT TO

"Section 1. It is hereby found and determined that one or
more slum or blighted areas exist in the City
of 'dichita Falls.
"Section 2. It is hereby found and determined that the re-
habilitation, conservation, or slum clearance
and redevelopment, or a combination thereof, of such slum
or blighted area, or areas, is necessary in the interest of
the public health, safety, morals or welfare of the residents
of said cite.
it Section 3. It is hereby further determined that the City
of ','Iichita Falls shall exercise the powers
granted to the City by the Urban Renewal Law of the State
of Texas, except the Urban Renewal Project Powers as de-
finzd in said Urban Renewal Law.
"Section 4. It is further determined to be necessary and
in the public interest that the City of 1,11ichita
Falls elect and accordingly, the City hereb� elects to have
said Urban i enewal Project powers exercised y the Urban

Renewal Agency of the City of Wichita Falls, which agency
is created by said Urban Renewal Law.
"SECTION 5. The findings, determinations and elections
herein made are made in accordance with

porate limits of said city, owning taxable property within

PROPOSITION
"The voter shall vote on the proposition by scratch-
ing or marking out the expression that he does not wish
to vote for, thus leaving the one not so scratched or
marked out, as indivating his vote on such proposition,
in accordance with the Election Code, as Amended.

SECTION 5. The City Clerk is hereby authorized and directed
to cause to be printed, and at the proper time,
to be available at all polling places within said City, an adequate
supply of the official ballot herein prescribed, for use at said
special election, substantially in accordance with the applicable
provisions of the Laws of Texas and the City Charter with respect
generally to special elections in said City.
SECTION 6. That said election shall be held in each of the

SECTION 7. The great public importance and pressing need to protect
the public pea-c, property, health, and safety from the
spread of slum and /or bl i cl-,t conditions which exist in various areas
of the City of Wichita Falls, creates an urgency and an imperative pub-
lic necessity and creates an emergency and, accordingly, this ordinance
is passed as an emergency measure and shall take effect immediately
upon its passage, and it is so enacted.
