ORDINANCE NUMBER IV
AN ORDINANCE CLOSING AND ABANDONING THAT PORTION
OF GALVESTON STREET FROM THE EAST PROPERTY LINE OF
TEXAS STREET TO THE WEST PROPERTY LINE OF DENISON
STREET, IN THE CITY OF WICHITA FALLS, WICHITA
COUNTY, TEXAS; AND RESERVING ALL UTILITY EASEMENTS
THEREON AND THEREUNDER.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS:
SECTION 1. That that portion of Galveston Street
from the East property line of Texas
Street to the West property line of Denison Street,
in the City of Wichita Falls, Wichita County, Texas,
be and the same is hereby closed and abandoned to
public use as a street.
SECTION 2. There is, however, retained in, on, under
and over such street, an easement for all
public utilities, including, but not limited to, water,
sewer, lights, gas and telephone lines or conduits.
SECTION 3. BE IT FURTHER PROVIDED that the C i ty of
Wichita Falls, or any utility company,
or owner, shall have the right to enter into and upon
such property for the purpose of constructing, re-
constructing, removing or developing any sewer and /or
other utility line or conduit, or to lay any parallel
line necessary thereto; providing further that no
buildings shall ever be erected over any utility ease-
ment that is buried in the ground on such property.
