' %N ORDINANCE REQUIRING ALL SWIMMING POOLS TO
BE FENCED AND EQUIPPED WITH SELF- CLOSING GATES;
PROVIDING A PENALTY.
IAIHEREAS, a number of swimming pools constructed within
the corporate limits of the City of Wichita Falls is increasing;
a nd
WHEREAS, the presence of these pools constitute an at-
traction for children; and
WHEREAS, safe- guards are required to protect children.
BE IT ORDAINED BY THE BOORD OF 1"1DERMEN OF THE CITY OF
WICHITA FALLS
Section 1. Every person in possession of land within
the corporate limits of the City of Wichita Falls, either as owner,
purchaser under contract, lessee, tenant or licensee upon which
is situated a swimming pool shall at all times maintain upon the
lot or premises on which the swimming pool is located and complete-
ly surrounding the swimming pool, lot or premises a fence, wall
or other solid structure designed to prevent small children from
inadvertently wandering into the pool, said fence or other solid
structure shall not be less than four feet {41) in height, with no
openings therein, other than doors or gates, larger than six inch-
es (OD square. Pll such doors opening directly into such enclo-
sure shall be equipped with self - closing and self- latching devices
designed to keep and capable of keeping such doors or gates secure-
ly closed at all times when not in actual use, said latching devi-
ce to-be attached to the upper quarter of said gate or door; pro-
vided, however, that the door of any dwelling occupied by human
beings and forming any part of the enclosure hereinbefore required
need not be so equipped. Provided further, that swimming pools in
existence on the effective date of this ordinance shall be fenced
in accordance with the requirements hereinbefore set forth on or
before the Ist day of June, 1950, and, thereafter, it shall be un-
lawful to maintain any swimming pool in the corporate limits of
the City of Wichita Falls which is not fenced in accordance with
the requirements of this Section.
Section 2. .xll plans hereafter submitted to the City of
Wichita Falls for swimming pools to be constructed shall_ show com-
pliance with the requirements of the proceeding Section, and the
final inspection and approval of all pools hereafter constructed
shall be withheld until all requirements of the preceeding Section
shall have been complied with by the owner, purchaser under contract,
lessee, tenant or licensee.
Section 3. That any person violating any of the provi-
sions of this ordinance shall be deemed guilty of a misdemeanor,
and, upon conviction, shall be fined any sum not less than five
dollars (5,5.00) nor more than two hundred dollars (_"200.00).
