Ord 1914 6/13/1960ORDINANCE NO. 1914 AN ORDINANCE CREATING A PLANNING BOARD FOR THE CITY OF WICHITA FALLS, PROVIDING FOR THE APPOINTMENT OF ITS MEMBERS; SETTING OUT THEIR POWERS AND DUTIES; PRESCRIBING THE NUMBER AND QUALIFICATIONS OF ITS MEMBERS AND THEIR TERM OF OFFICE; MAKING DEPARTMENT HEADS AND OFFICIALS OF THE CITY AVAILABLE TO THE PLANNING BOARD; PRE- SCRIBING THE POWERS AND DUTIES OF THE PLANNING BOARD; PRESCRIBING THE JURISDICTION OF THE PLANNING BOARD AND ADOPTING ARTICLE 974a, REVISED CIVIL STATUTES OF TEXAS, AUTHORIZING CITIES TO REGULATE THE PLATTING OF SUB - DIVISIONS WITHIN THE CITY AND WITHIN FIVE (5) MILES OF THE CITY LIMITS; REPEALING ORDINANCE NO. 1684 AND DECLARING AN EMERGENCY. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION I. There is hereby created a Planning Board for the City of Wichita Falls composed of fifteen (15) members, each of whom shall be a resi- dent tax- paying citizen of the City of Wichita Falls, and who shall serve without pay. SECTION II. The Mayor shall appoint the members of said Board, and each person so appointed must be approved by the Board of Aldermen of the City of Wichita Falls before becoming a member thereof. The terms of said members shall be for a period of three (3) years; however, the initial terms shall be staggered so that one -third (113) of said Board shall be appointed each year. The Mayor with the approval of the Board of Aldermen shall nominate one of said members as chairman and one of said members as vice - chairman of said Board. The terms of office of the members of said Board shall commence upon the approval of said appointment by the Board of Aldermen and shall terminate whenever the members replacement has been appointed and approved by the Board of Aldermen. All vacancies shall be filled by appointment of the Mayor with the consent and approval of the Board of Aldermen and shall be for the remainder of the term of the vacating member. Any member of the Planning Board may be removed from his office at any time by a five - seventh (5/7) majority vote of the Board of Alder- men and no reason need be given for such removal. 1 SECTION III. Statutes of the State of Texas authorizing and empowering cities to regulate the platting and recording of subdivisions or additions situated within the corporate limits, or within five (5) miles of such city, the same being Article 974a of the Revised Civil Statutes of Texas, as amended, are hereby adopted for and on behalf of the City of Wichita Falls, and the City of Wichita Falls, acting through its duly authorized officials shall have all the rights, powers, privileges and authority authorized and granted by and through said statutes. SECTION IV. All department heads and officials of the City shall be available to the Board for adivice and consultation, and they shall co- operate with and render such services for the Board as shall come within the scope of the duties of such department heads and officials. All such department heads and officials shall attend meetings of the Plann- ing Board upon the written request of the Planning Board or its duly authorized official or officials. SECTION V. For the purpose of transacting any business five (5) members of the Planning Board shall constitute a quorum, and all actions of the Planning Board shall be approved by a vote of the majority of the members present, but in no case shall less than five (5) affir- mative votes be effective to carry any action of the Planning Board. SECTION VI. The Planning Board shall have the power and it shall be its duty: (a) To make studies and project plans for the improvement of the City, with a view for future development and extension and to recD- mmend to the Board of Aldermen all matters for the development and advancement of the City's facilities and, particularly shall pass upon the application for plats requested under Article 974a of the Revised Civil Statutes of Texas. (b) To make plans and maps of the whole or any part or ortion of the City and of land outside the City located within five (5 miles of the City limits and any other land outside the City which, in the opinion of the Planning Board, bears a relation to the planning of the City and to make changes in, additions to, and extensions of such plans or maps when it deems the same advisable. (c) To confer with and advise private property owners pertain- ing to location and erection of private structures with the view of having same conform to the over -all city plan and to advise with the building inspectors and Department of Public Works in the perfor- mance of their duties. (d) To aid and assist the Board of Aldermen in the preparation of budgets and determination of sources of funds and in the procur- ing of financial and other assistance for the City from the State and Federal Governments and their agencies, for each and all of the purposes herein enumerated. 2 (e) To act with and assist all other municipal and governmental agencies, and particularly the Board of Aldermen of the City of Wichita Falls, in formulating and executing proper plans of municipal develop- ment and growth. (f) To plan and recommend the location, plan and extent of city alleyways, viaducts, bridges, subways, parkways, airports, automobile parking places and other public grounds and public improvements; for the location of public buildings, schools, and other public properties, and of public utilities, including bus terminals, railroads, railroad depots, and terminals, whether publicly or privately owned, for water, lights, sanitation, sewerage, sewage disposal, drainage, flood con- trol, transportation, communication, marketing and shipping facilities, power and other purposes, and for the removal, relocation, widening, extension, narrowing vacation, abandonment or change of use of any of the foregoing public places, facilities or utilities. (g) To select and recommend to the Board of Aldermen, routes of streets, avenues and boulevards, fmcluding the opening, widening and abandoning of the same, or of any alley, or the changing thereof to conform with the city's system, present and future, with reference to traffic. (h) To investigate, consider, and report to the Board of Aldermen upon the lay -out or platting of any new subdivision of the City or of property situated within five (5) miles of the City limits, and to recommend the approval of all plans, plats, or re -plats of additions within the City limits or within five (5) miles of the same, or of the rejection of either. (i) To suggest to the Board of Aldermen of the City plans for clearin the City of slums and blighted areas. (jJ To make any recommendation that seems expedient with reference to future zoning plans or laws, and with reference to the use of the present zoning of the City. (k) In all of its deliberations the Board shall take into consider- ation the advice or recommendations of the Park Board of the City of Wichita Falls, as the same has been created by Ordinance No. 1512. (1) The Board shall from time to time recommend to the Board of Aldermen the passage of such ordinances as may be necessary to carry- ing out its program. SECTION VII. Ordinance No. 1684 and any other ordinances in conflict herewith are hereby expressly repealed. SECTION VIII. Due to the fact that this ordinance repeals Ordinance No. 1684 which created a Planning Board and unless this ordinance is effective immediately there would be no Planning Board in existence for a period of thirty (30) days after the passage of this ordinance creates an ur- gent public need for the preservation of the peace, health and safety of the property of the City of Wichita Falls, and an emergency is hereby declarad so that upon the passage of this ordinance the same will become effective immediately, and it is so ordained.
