ORDINANCE NO. (� I
AN ORDINANCE PROVIDING FOR A PROCEDURE FOR ALLOWING FOR
DEFERRED CHARGES ON SEWWR AND WATER LINE EXTENSIONS IN ACCOR-
DANCE WITH ORDINANCE NO. 1877, AND DECLARING AN EMERGENCY.
WHEREAS, the City of Wichita Falls by Ordinance No. 1877
passed the first day of December, 1959, established a policy
of extending water and sewer mains and set up pro rata charges
for such extensions; and
WHEREAS, Section I; Article 13 of said Ordinance provided
that all agreements concerning deferred pro rata charges for
water and /or sewer service be executed on the forms approved
by the City Attorney but did not provide for the authority to
make such agr. ecn,6nt; or to include the deferred charges on a
water bill.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE C1TY OF WICHITA FALLS, TEXAS;
SECTION I.
THAT upon compliance with the provisions of Ordinance No.
1877 water and sewer main extensions may be made provided either
the owner of the property or his agent pays the entire sum as
set forth in said Ordinance No. 1877 or executes a promissory
note in a form approved by the City Attorney agreeing to pay mon-
thly installments on the remaining sum due which installments may
be included on the owners water bill; and further agreeing, that
if any installments become delinquent that the City of Wichita
Falls may discontinue water and sewer services to such property
until the amount in default has been paid together with a pena-
lty of ten (10�o) per cent of such amount in default.
SECTION II.
THE fact that Ordinance No. 1877 provided for deferred char-
ges of extensions without setting out the procedure to establish
valid obligations for the payments, and the fact that the City at
the present time is making these extensions creates an urgent pub-
lic need for the preservation of the peace, health and safety of
the property of the City of Wichita Falls an emergency is hereby
declared, and 'upon passage of this ordinance it shall become eff-
ective immediately.
