f C" ORDINANCE NO. AN ORDINANCE REGULATING ALL PERSONS, PARTNERSHIPS, ASSOCIATIONS, AND CORPORATIONS ENGAGED IN THE BUSINESS OF PURCHASING SECOND-HAND PERSONAL PROPERTY, EXCEPT CERTAIN ENUMERATED ITEMS, FOR THE PURPOSE OF RESALE TO THE GENERAL PUBLIC BY REQUIRING ALL SUCH PERSONS, PART- NERSHIPS, ASSOCIATIONS AND CORPORATIONS TO KEEP AND MAINTAIN A REGISTER AS PROVIDED HEREIN, REPEALING CHAPTERS SIX (6) AND EIGHT (8) OF THE CODIFICATION OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS, 1941, ORDINANCE 1361 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR A SEVERABILITY CLAUSE AND PROVIDING FOR A PENALTY. WHEREAS, there are thousands of dollars worth of personal prop- erty stolen each year within the corporate limits of the City of Wichita Falls that are never recovered, and WHEREAS, there is at the present time no effective means avail- able to trace said stolen property from the persons responsible for these losses to the reputable merchants who unsuspectingly purchase said personal property for resale to the general public . NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That pursuant to the authority expressly granted in Section 7 ( J ) of the Charter,_oX Wichita Falls, Texas, from and after the day of A. D. 1960, all persons, partnerships, assoc ations, and corpora cans engaged in the business of purchasing second-hand personal property for the purpose of resale to the general public shall keep a well-bound book In which all transactions involv- ing second-hand personal property except the specific items listed in Section II of this ordinance, are recorded at the time the same occur. Such register shall show: (A) An accurate description of the personal property purchased. (B) Name and address of the seller. (C) The time and amount for which the personal property is purchased. (D) The final disposition made of such personal property and if sold, then the date of such sale, to whom sold and the amount for which such personal property was sold. SECTION II. F' I The items of personal property exempt under this ordinance are as f olldws: (A) All items of personal property covered, by the Certificate of Title Act, Vern, Ann. Civ. $tat, Art. 1436-1 and all amendments thereto. (B) All items of personal property covered by the Water Safety Act, Ver. Ann. Civ. Stat. Art 1722-A and all amendments thereto. (C) Furniture and the following household appliances, to wit: kitchen ranges, kitchen stoves, refrigerators, washing machines, clothes dryers, deep freezers and dish-washers. SECTION III. All persons, partnerships, associations, and corporations required by this ordinance to maintain a register shall keep the same available for inspection by the Chief of Police of the City of Wichita Falls or any member of the Police Department of the City of Wichita Falls designated by the Chief of Police to make said inspection, at all reasonable times and shall produce said register upon request and explain any entries made therein to the Chief of police of the City of Wichita Falls or any member of the Police Department of the City of Wichita Falls designated by the Chief of Police to make said inspection. h v 4 v ♦ SECTION IV Any person, partnership, association, corporation, or any agent of such person, partnership, association or corporation violating any provision of this ordinance shall be guilty :,f a misdemeanor and upon conviction shall be fined not less than Twenty-Five and no/100 ($25.00) Dollars nor more than One Hundred and no/100 ($100.00) Dollars. Each day this ordinance is violated shall be a separate offense. SECTION V It is the intention of the Board of Aldermen that each separate provision of this ordinance shall be deemed independent of all other provisions herein and it is the further intention of the Board of Aldermen that if any of the provisions of this ordinance be declared invalid for any reason, all other provisions thereof shall remain valid and enforceable . SECTION VI Chapters Six (6) and Eight (8) of the Codification of Ordinances of the City of Wichita Falls, Texas, 194.1, Ordinance 1361 and all other ordinances in conflict herewith are hereby expressly repealed. 1960.PASSED AND APPROVED, This day of '{ . r , A.
