Dear Mr. Fain:
You are today conveying to the City-of Wichita
Falls a tract of 267 acres of the J. Taylor, Abstract
652, and B. E. Mordecai, Abstract 290, Surveys, - Archer
County, in which you own the full mineral title, for
the new Archer County Lake .
In the event the City of Wichita Falls acquires
by condemnation or otherwise any land in Section 1,
S.P .R.R. Co. Survey, Abstract 440, lying between the
land needed for the lake and your land to the South, we
agree to convey such land to you in exchange, acre for
acre , for a like quantity of the 267 acre tract above
mentioned. It is understood that the land conveyed to
you shall also, carry full mineral interest.
For such part of the 267 acres as we do not ex-
change acreage with you, we agree to pay you the sum of
$17- 50 per acre in cash.
We agree to hold without recording the deed which
you- have delivered to us - until 'we determine what part , if
any, of Section 1, S.P.R.R. Co. Survey, Abstract 440,
South of the land needed for the lake is acquired by the
City.
