And whereas, on the 1,7th day of November, A. D., 19322
iii the r8zh Distriot Court of Wichita County, Texas, W. N1. Lewis
recovered judgment against the City of Viichita Falls in the sum
of Twenty Five Hundred (;p2500.00) Dollars, together with the
.costs of suit and interest at the rate of six per cent (6 %) and,
Whereas, there is due on said judgment the sum. of
Three Thousand Twenty -five and No /100 03,025.003 Dollars and
Cost, and
Whereas, said cause is now pending in the Supreme
Court on writ or error and will likely be passed upon in the
near future, and
Whereas, it is the opinion of the City Attorney that
said judgment will be affirmed against the City of Wichita Falls
thereby placing the cost of same at approximately Three Thousand
Two Hundred ($3,200.00) Dollars.
Now, therefore, be it resolved by the Board of Aldermen
as follows:
That said City Attorney be and he is hereby authorized
and Tully empowered to compromise and settle said judgment for
the sum of Fifteen Hundred Twelve and 50/100 (�1 12.50) Dollars
with all appellate costs to be paid by the plaintiff.
And be it further resolved that the City Clerk is here-
by authorized to pay the said W. M. Lewis the sum of Fifteen Hun-
dred Twelve and 50/100 ($1512,50) Dollars in full settlement of
said judgment on being presented with the proper release of the
same which has been approved by the City Attorney.
Ana that said sum so paid in liquidation of said judg-
ment be included in the budget of the City of Wichita Falls for
the year of 1934 ana. 19;37.
