AN ORDINANCE PERMANENTLY ABANDONING A PORTION OF A DRAINAGE
EASEMENT ON LOTS THREE (3) , FOUR (4) , SEVEN (7) , AND EIGHT (8) ;
BLOCK TWENTY (20) OF THE SUNSET TERRACE SECTION 2 ADDITION TO THE
CITY OF WICHITA FALLS, TEXAS, BY REDUCING THE WIDTH OF SAID
DRAINAGE EASEMENT TO TEN FEET.
WHEREAS, there has been heretofore dedicated a drainage
easement along the South seven and one-half feet (S 72' ) of
Lot three (3) and the North seven and one-half feet (N 74' )
of Lot four (4.) in Block Twenty (20) of the Sunset Terrace Sec-
tion 2 Addition to the City of Wichita Falls, Texas, and also a
drainage easement along the South seven and one-half feet (S 74' )
of Lot Seven (7) and the North seven and one-half feet (N 74' )
of Lot Eight (8) of Block Twenty (20 of said subdivision; and
WHEREAS, it was originally planned to use an open ditch
drainage but the developers of Sunset Terrace have now installed
a pipe with standard inlets creating no need for an easement
greater than ten feet (10' ) in width.
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS:
That the drainage easement along the South seven and one-
half feet (S 7?") of Lot Three (3) and the North seven and one-
half feet (N 72' ) of Lot Four (4) and along the South seven
and one-half feet (S 74 ) of Lot Seven (7) and along the North
seven and one-half feet (N 74' ) of Lot Eight (8) of Block Twenty
(20) of the Sunset Terrace Section 2 Addition to the City of
Wichita Falls, Texas , be relinquished and abandoned, SAVE AND
EXCEPT such drainage easement is expressly retained over and
across the South five feet (S 5' ) of Lot Three (3) and the North
five feet (N 5' ) of Lot Four (4 ) and the South five feet (S 5' )
of Lot Seven (7) and the North five feet (N 5' ) of Lot Eight (8)
all in Block Twenty (20) of said Sunset Terrace Section 2 Addi-
tion to the City of Wichita Falls, Texas .
The Mayor of the City of Wichita Falls, Texas, is hereby
duly authorized to execute an instrument of release in compliance
with this ordinance.
