ORDINANCE NO.
AN ORDINANCE PERMANENTLY CLOSING AND ABANDONING CENTER STREET IN
BLOCKS 12, 13, 16 AND 17 OF THE KEMP AND NEWBY SUBDIVISION OF THE
SOUTHEAST QUARTER OF J. A. SCOTT SURVEY NO . 11 IN THE CITY OF WICHITA
FALLS, TEXAS, BETWEEN THE SOUTH LINE OF EAST SCOTT STREET AND THE
NORTH LINE OF ROLAND ROAD, BUT RESERVING UNTO THE CITY OF WICHITA
FALLS, TEXAS, ANY AND ALL EXISTING UTILITY EASEMENTS THEREON.
WHEREAS, on September 9, 1889, J. A. Kemp and A. Newby
filed a plat of Blocks 12, 13, 16 and 17 of the Kemp and Newby Sub-
division of the southeast quarter of J. A. Scott Survey No. 11,
Wichita County, Texas , together with other land adjoining thereto,
which plat is recorded in Book N, Page 208, Deed Records of Wichita
County, Texas , and on said plat there was shown a street 50 feet in
width running in a northerly and southerly direction between Blocks
12 and 13 and Blocks 17 and 16, which street was called "Center Street:"
Thereafter, on May 26, 1922, J. A. Kemp replatted said Blocks , in
which plat Center Street was omitted.
WHEREAS, the above described portion of Center Street has
not been used or maintained by the City of Wichita Falls as a public
street for a period of over thirty years, and this portion of Center
Street is not used nor useful to the public as a public street.
THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. That the following described portion of Center
Street in the City of Wichita Falls , Texas , be and the same is hereby
closed and abandoned for use as a public street, to-wit :
Being a part of J. A. Scott Survey No. 11, Wichita County,
Texas , with a beginning point in the South right-of-way line
of East Scott Street, said point being 1729 ' West of the
East line of said J. A. Scott Survey No. 11; Thence South
to the North property line of Roland Road; Thence West 501 ;,
Thence North to the South property line of East Scott
Street; Thence East 501 to the place of beginning.
SECTION 2. That the City of Wichita Falls , Texas , reserves
unto itself any and all utility easements that may or might now exist
in its favor over or through any portion of said above described
portion of Center Street.
