Ord 1974 12/18/1961 • ORDINANCE NO. J 7 AN ORDINANCE AMENDING SECTION L. OF ORDINANCE NO. 1416 SO AS TO ALLOW HOLDERS OF PACKAGE STORE PERMITS, RETAIL DEALERS ON-PREMISES LICENSES AND RETAIL DEALERS OFF-PREMISES LICENSES, WHO HAVE BEEN IN BUSINESS FOR A PERIOD OF AT LEAST MONTHS IN AN AREA WHEN THAT AREA IS ANNEXED TO THE CITY LIMITS OF THE CITY OF WICHITA FALLS TO CONTINUE IN BUSINESS IN THAT LOCATION, AND DEFINING THE WHOLESALE LIQUOR DEALERS WHO ARE EXCEPTED FROM ORDINANCE NO. 1416 AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Section 1. That Section L. of Ordinance No. 1416 is hereby amended so as to hereafter read as follows In recognition of the principle of continuance of non-con- forming use, when an area is annexed to the City limits of the City of Wichita Falls , Texas, that contains businesses which have been operating in said area for a period of no less than, months under a Package Store Permit, a Retail Dealer ' s on-Premises License or a Retail Dealer 's Off-Premises License as defined by the Texas Liquor Control Act, those businesses which have existed for such period of time shall be allowed to continue in the same location with the right to transfer said Permit or License . That Ordinance No. 1416, as amended, shall not apply to liquor wholesalers with the following types of license: General Distributor ' s License , Local Distributor ' s License, Branch Distributor 's License or Wholesaler ' s Permits, as the same are defined by the Texas Liquor Control Act. Section 2. Ordinance NO . 1884 and all other Ordinances in conflict herewith are hereby expressly repealed. Section 3. The fact that, after the City introduces an annexation ordi .ance , retail beer and liquor businesses may be established before such annexation becomes final, and the fact that the establishment of places of business of this nature outside of the district defined in Ordinance No. 14.16, as amended, would jeop- ardize the peace and health of citizens within the residential districts of said City, creates an emergency, and this Ordinance is hereby declared an emergency on the ground of 'urgent public need for the preservation of peace, health and safety of property, and this ordnance shall take effect from and after its passage and approval.
