Afl uRDINANCE AUTHORIZING 'A CHARGE FOR FURNISHING COPIES OF ACCIDENT
aEPORTS BY THE POLICE DEPARTMENT OF THE CITY OF WICHITA FALLS, PRO-
VIDING FOR THE COLLECTION AND DISPOSITION OF SUCH CHARGES, AND DE-
CLARING AN EMERGENCY.
WHEREAS, the Police Department is constantly being requested
by interested persons to furnish copies of investigating officer 's
reports on accidents , and the furnishing of such copies creates a
financial burden on the Police Department; and,
WHEREAS, it would be in the public interest to establish a
reasonable charge for the furnishing of such copies in order to cover
the cost thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS:
SECTION 1. The Chief of Police is hereby authorized to furnish
a copy of the Police Investigation Report, made by the Investigating
Officers at the scene of an automobile accident to the following
persons only: to any party involved in an accident, either as driver ,
passenger or as a person whose property has been damaged as a result
of an automobile accident , or, when authorized in writing by any such
party involved in an accident, to a representative of the insurance
carrier fo the party so involved or to the attorney for such party
involved or their insurance carrier.
SECTION 2. There shall be a charge of Two Dollars (32.00)
per copy for each copy of the Investigating Officer's Report of inves-
tigation made at the scene of an automobile accident. Such charge is
to be paid in cash to the Chief of Police or his represeritat.iv0 land
shall be deposited in the general fund of the City of Widhita Falls.
SECTION 3. The authorization set out in Section l' shall
apply only to the report made by the investigating officers concerning
an automobile accident, and shall not include any written statement
obtained from any person, and shall not include any report made by w
any person involved in any way in an automobile accident .
SECTION 4.. Because of the daily demand made on the Police
Department for copies of such reports, there is created an emergency,
and upon final passage of this ordinance the same shall take effect
immediately, and it is so ordered.
