Res 76 6/12/1950RESOLUTION APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF AVENUE K AND PORTIONS OF SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF WICHITA FALLS, TEXAS, FIXING TIME AND PLACE FOR HEARING TO OWNERS OF ABUTTING PROPERTY AND OTHERS INTERESTED, DIRECTING THE CITY CLERK TO GIVE NOTICE AND PROVIDING SUNDRY OTHER MATTERS INCIDENT THERETO. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has heretofore ordered that the portions of streets and avenues in the City of Wichita Falls, Texas, hereinbelow described and hereinafter enumerated and designated by unit or district numbers, be improved by raising, grading and filling same and by installing concrete curbs and gutters where same are not already installed on proper grade and line, and by constructing thereon a Seven Inch Flexible Base Course with Texas State Highway Department Type Q-Modified-Asphalt Pavement, together with incidentals and appurtenances, including four inch concrete sidewalks and storm sewers and drains where same are shown and provided for on the plans; all of which said improvements are to be constructed where shown and in strict accordance with the plans and specifications now on file with the City; and, WHEREAS, bids were duly advertised for and received, were fully tabulated, canvassed and considered, and the bid of Stuckey Construction Company, having been found to be the lowest and most advantageous, was accepted by the City of Wichita Falls;• and, WHEREAS, a form of contract to be executed by the City has heretofore been executed by Stuckey Construction Company and is now on file with the City; and, WHEREAS, the Board of Aldermen of the City of Wichita Falls has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof and such estimates have been examined; THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Such estimates be, and they are hereby, adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of street and avenue, with the amount or amounts per front foot proposed to be assessed for 1 - such improvements against abutting property and the owners there- of on each such portion are as follows, to wit: On AVENUE K from Polk to Santa Fe, SAVE AND EXCEPT those intersections of Avenue K with other streets which have already been permanently paved or improved, known and designated as Unit or District No. 1: the estimated cost of the improvements is 2:4A/o4,e, ; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Avenue K and against the owners thereof is $2.20; the estimated amount per front foot to be assessed against those parcels of property which abut on said portion of Avenue K but which front on some street other than Avenue K and against the owners thereof is $1.46. On AVENUE U from Kemp to Grant, known and designated as Unit or District No. 2: the estimated cost of the improvements is $ 7 /17.7/ ; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Avenue U and against the owners thereof is $2.20; the estimated amount per front foot to be assessed against those parcels of property which abut on said portion of Avenue U but which front on some street other than Avenue U and against the owners thereof is $1.46. On SPEEDWAY STREET from Holliday to Bridwell, known and designated as Unit or District No. 3: the estimated cost of the improvements is $ /o, o 2 z./c; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Speedway Street and against the owners thereof is $2.20; the estimated amount per front foot to be assessed against those parcels of property which abut on said portion of Speedway Street but which front on some street other than Speedway Street and against the owners thereof is $1.46. On TAFT STREET from Avenue H to Avenue J, known and des- ignated as Unit or District No. 4: the estimated cost of the improvements is $ 6, /76./2_ ; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Taft Street and against the owners thereof is $2.20; the estimated amount per front foot to be assessed against those parcels of property which abut on said portion of Taft Street but which front on some street other than Taft Street and against the owners thereof is $1.46. On NORTH THIRD. STREET from N. Broadway to Grand Avenue, known and designated as Unit or District No. 5: the estimated cost of the improvements is $ 6, 3 0,e1,oa ; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of North Third Street and against the owners thereof is $1.83; the estimated amount per front foot to be assessed against those parcels of property which abut on said portion of North Third Street but which front on some street other than North Third Street and against the owners thereof is $1.22. On POLK STREET from Bullington to Kings Highway, SAVE AND EXCEPT the intersection of Polk Street with Talunar Lane, known and designated as Unit or District No. 6: the estimated cost of the improvements is $ .s7i6 z. o z ; the estimated amount per front foot to be assessed against those parcels of property which abut and which front on said portion of Polk Street and against the owners thereof is $2.20; the estimated amount per front foot to be assessed against those parcels of property which abut on said portion of Polk Street but which front on some street other than Polk Street and against the owners thereof is $1.46. 2 - III. A hearing be given and held by and before the Board of Aldermen of the City of Wichita Falls to all owning or claiming any property abutting upon said portions of streets and avenues, as well as all owning or claiming any interest in any such property. Such hearing shall be given and held on the Z4 C` day of June, A. D. , 1950, at 7 otclock, . M. , in 4-ca Room in Memorial Auditoriumm in the City of Wichita Falls, Texas, and the City Clerk is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with and under the terms of the powers and provisions of Chapter 106 of the Acts of the First Called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon' s Texas Civil Statutes, under which law these proceedings are taken and had. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Wichita Falls, Texas, the first publication to be made at least ten (10) days before the date of said hearing. IV. The City Clerk is directed to prepare, sign and file with the County Clerk of Wichita County, Texas, a notice in accordance with the provisions of the Act passed at the Fifth Called Session of the Forty-First Legislature of the State of Texas and shown. as Chapter 21 of the Acts of said Session of the Legislature, said Act having been passed in the year 1930, now shown as Article 1220a of Vernon' s Texas Civil Statutes.
