AN ORDINANCE REQUIRING ANY PERSON, FIRM OR CORPORATION CONSTRUCTING
A BUILDING ON ANY LOT OR LOTS ABUTTING ON A CITY STREET, TO CONSTRUCT A
SIDEWALK ACCORDING TO THE SPECIFICATIONS ADOPTED BY THE CITY OF WICHITA FALLS
AND ON FILE IN THE OFFICE OF THE CITY ENGINEER; AND PROVIDING THAT A PERMIT
TO CONSTRUCT THE SIDEWALK MUST BE OBTAINED FROM THE CITY ENGINEER; AND PRO;=
VIDING FOR EXCEPTIONS TO THE CONSTRUCTION OF SIDEWALKS; AND DECLARING AN
EMERGENCY.
,�r� BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS,
TEXAS.
SECTION 1. Any person, firm or corporation constructing a building
or buildings for any purpose on a lot or lots abutting on a city street shall
construct a sidewalk in accordance with the specifications adopted by the
City of Wichita Fails and on file in the office of the City Engineer.
SECTION 11. That no person, firm or corporation shall construct'
reconstruct, alter, remove or replace any sidewalk or driveway on any public
property, within the City of Wichita Falls, without first obtaining from the
City Engineer a permit to do so, and all such persons shall construct, reconstruct,
alter, repair, remove or replace said sidewalks or driveways, under the supervision
of the City Engineer and in accordance with the spe cifications hereinbefore pro-
vided for, or such other specifications as may be prepared by the City Engineer,
and adopted by the governing body.
SECTION 111. Any person, firm or corporation may apply to the Building
Inspector for an exception to Section 1 provided that the exception is for one of
the following reasons:
1) The building to be constructed is in an area in which there
are existing buildings on the same street which do not have
sidewalks built in conjunction with the existing buildings.
2) The building to be constructed is in an area in which the
safety of children and pedestrians does not require the
construction of sidewalks.
3) The average lot size in a block is twenty thousand (20,000)
square feet or more, provided the safety of children and
pedestrians does not require the construction of sidewalks.
SECTION 1V. Any person, firm or corporation requesting an exception
based on Section 111 above shall first present said request to the Building
Inspector of the City of Wichita Falls who shall have the authority to grant
or deny said exception and provided that any person dissatisfied with the
decision of the Building Inspector shall have the right to appeal said decision
to the City Planning Board, whose decision shall be subject to review and
approval by the Board of Aldermen of the City of Wichita Falls.
SECTION V. The Building Inspector shall not issue a permit for the
construction of any buildings on any lot or lots abutting on a city street unless
there shall also be presented an application for the construction of a sidewalk in
conjunction with said building or an exception to the building of a 'sidewalk, as
set out in Section iV above. The Building Inspector shall not issue a certificate
of occupancy for any building on any lot or lots abutting on a city street until a
sidewalk in conjunction with said building meeting the approval of the City Engineer
shall have been completed or an exception granted to the building of a sidewalk,
as set out in Section 1V above.
SECTION Vi, The fact that there are no mandatory provisions for the
construction of sidewalks within the City of Wichita Falls and the fact that
the safety of children and other people within the City of Wichita Falls requires
that provisions be made for sidewalks creates an emergency is hereby declared to
exist and by reason thereof, this ordinance shall take effect and be in full
force from and after the date of its passage.
