Ord 1992 7/23/1962 ORDINANCE NO. 1992 AN ORDINANCE REGULATING SOLICITORS, PEDDLERS, HAWKERS, ITINERANT MERCHANTS OR TRANSIENT VENDORS OF MERCHANDISE WHO GO IN OR UPON PRI- VATE RESIDENCES WITHIN THE CITY OF WICHITA FALLS, TEXAS, WITHOUT HAVING BEEN REQUESTED OR INVITED TO DO SO, FOR THE PURPOSE OF SOLICIT- ING ORDERS OR THE SALE OF GOODS OR MERCHANDISE; PROVIDING FOR A PERMIT AND LICENSE FEE; PROVIDING PENALTIES FOR THE VIOLATION HEREOF; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF W tCHITA FALLS, TEXAS: SECTION 1. It shall hereafter be unlawful for any solicitor, peddler, hawker, itinerant merchant or transient vendor of merchandise to go in and upon private residences in the City of Wichita Falls, Texas, without having been requested or invited so to do by the owner or owners, occupant or occupants of said private residence for the purpose of soliciting orders for the sale of goods, wares and merchan- dise, or for the selling, peddling or hawking the same, without first securing a permit from the City Clerk as herein provided. SECTION '2. Any person, firm or corporation, desiring to engage in the business of going in and upon private residences in the City of Wichita Falls for the purpose of soliciting orders for the sale of goods , wares or merchandise , or of selling, hawking or peddling the same, shall make an application for a permit to the City Clerk, who shall, if same is in proper form, refer such application to the Advisory Committee provided for in Section 6-1203 of the Codification of Ordinances of the City of Wichita Falls . The Committee shall investigate said applicants and report their findings and recommenda- tions to the City Clerk as soon as is reasonably possible. The City Clerk shall then either grant or refuse such permit , as recommended by the Advisory Committee. SECTION 3. Such permit shall be dated and signed by the City Clerk, and issued upon the payment of the fee herein required, and shall specify the term of such permit, not to exceed one year after date of issuance . Each person engaging in the business covered by this ordinance shall be required to have a permit, which he shall carry with him and display upon request. The fee for such permit shall be as follows : For permits with a term from one day to six months, $1.00 per day; for permits with a term from six months to one year, the fee shall be $50.00 plus one dollar for each day over six months; for permits with a term of one year, the fee shall be $100,00. SECTION 4. If, upon receipt of written information or upon his own investigation, the City Clerk finds that the holder of any permit has made untrue statements in his application, or that he is conducting his business in such a way as to be inimical to the protection of the health, life and property of the citizens of the City of Wichita Falls and not in conformity with the intent and purpose of this ordinance, the City Clerk shall suspend such permit, provided, however, that before any permit is suspended, the Clerk shall give the holder of the permit 24 hours notice in writing that a hearing is to be had, and that at said hearing the Clerk shall ascertain the facts and if any reasons above set forth for revoking the permit are found to exist, the permit shall be revoked. SECTION 5. The provisions of this ordinance shall not apply to the sale or soliciting of orders for sale of milk, dairy products, vegetables, poultry, eggs and other farm and garden produce, bread and bakery products, so far as the sale of the commodity so named is now authorized by law. SECTION 6. Be it further ordained that any person violating the provisions of this ordinance shall upon the conviction thereof Ate be fined not more than c100. 00. SECTION 7. Be it further ordained that all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 8. The fact that the City of Wichita Falls does not now have an adequate ordinance regulating the business covered herein creates an emergency, and this ordinance is hereby declared an emer- gency on the ground of urgent public need for the preservation of peace, health and safety of property, and this ordinance shall take effect from and after its passage and approval.
