Ord 2004 11/12/1962 ORDINANCE NO. 2004 AN ORDINANCE REGULATING THE PARKING AND LOCATION OF TRAILERS AND REGULATING THE LICENSING, LOCATION, ERECTION, MAINTENANCE AND CONDUCT OF TRAILER PARKS AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY,OF WICHITA FALLS, TEXAS SECTION lc Definitions. Whenever used in this ordinance, unless a different meaning appears from the context: (a) A 'house trailer," a°mobile home," or"trailers' means any vehicle or structure so designed and constructed in such manner as will permit occupancy thereof as sleeping and for living ouarters for one or more persons, or the con- duct of any business or profession, occupation or trade (or use as a selling or advertising device), and so designed that it is or may be mounted on wheels and used as a conveyance on highways or city streets, propelled or drawn by its own or other motive power, excepting a device used exclusively upon stationary rails or tracks. Such a structure shall be considered as a prefabricated building when its wheels are removed and when mounted upon a permanent type foundation, and as such will be required to conform to all applicable requirements of the building, electrical, and plumbing codes and all other applicable codes and ordinances of the City of Wichita Falls. (b) "Dependent mobile home" shall mean a mobile home which does P not have a flush toilet and a bath or shower. (c) A "Trailer Park's means any park, trailer camp, trailer court, court, camp, site, lot, parcel, or tract of land designed, maintained or intended for the purpose of supplying a location or accommodations for any house trailer or trailers or upon which any trailer or trailers are parked and shall include all buildings used or intended for use as part of the equipment thereof whether a charge is made for the use of the trailer park and its facili- ties or not. "Trailer Park" shall not include automobile or trailer sales lots on which unoccupied trailers are parked for purposes of inspection and sale. (d) A "trailer space" means a section of ground in a trailer park of not less than 700 square feet of unoccupied space in an area designated as the location for only one automobile and one trailer or one trailer. (e) The word "person" shall be construed to include a person, partnership, firm, company, corporation, tenant, owner, lessee, or licensee, their agents, heirs or assigns. SECTION 2. Enforcement. It is hereby made the duty of the Building Inspector and City Health " III Officer to enforce all provisions of this Ordinance as prescribed herein or such provisions as may hereafter be enacted, and for the purpose of securing such enforcement, the Building Inspector and City Health Officer, or their duly authorized representatives, shall have the right and are hereby empowered to enter any premises on which any trailers are located, or are about to be located, and inspect the same and all accommodations connected therewith at any reasonable time. SECTION 3. Location Outside Trailer Parks. (a) It shall be unlawful, and is hereby declared to be a nuisance, within the limits of the City of Wichita Falls, for any person to park any trailer on any street, alley, or highway, or other public place, or any tract of land owned by any person, occupied or unoccupied, within the City of Wichita Falls, except as provided in this ordinance. (b) Emergency or temporary stopping or parking is permitted on any street, alley or highway for not longer than five hours subject to any other and further prohibitions, regulations, or limitations imposed by the traffic and parking regulations or ordinances for that street, alley or highway. (c) No person shall park or occupy any trailer on the premises of any occupied dwelling or on any lot which is not a part of the premises of any occupied dwelling either of which is situated outside an approved trailer park; except, the parking of only one unoccupied trailer in an accessory private garage, building, or in a rear yard, is permitted providing no living quarters shall be maintained or any business practiced in said trailer while such trailer is so parked or stored. 4 Ordinance - 2004, Cont/d. SECTION 4. License for Trailer Park; Application Therefor and Issuance Thereof. (a) It shall be unlawful for any person to establish, operate or maintain, or permit to be established, operated or maintained upon any property owned or controlled by him, a trailer park within the limits of the City of Wichita Falls without having first secured a license therefor and for each of them from the Building Inspector, granted and existing in compliance with the terms of this ordinance. Such license shall expire on December 31st of the year in which it is issued. Application for renewal of permits shall be made within 30 days prior to expiration and a renewal fee paid for a full 12-month period (b) The application for such license or the renewal thereof shall be filed with the Building Inspector and shall be accompanied by a fee of Fifty Dollars ($50.00) for the first twenty (20) trailer spaces or fraction thereof and Two Dollars and Fifty Cents ($2.50) for each additional trailer space in the existing or proposed park. The cost of any permit secured having less than 10 months to run before the expiration date, as herein provided, shall be pro- rated. The application for a license or a renewal thereof shall be made on forms furnished by the Building Inspector and shall include the name and address of the owner in fee of the tract (if the fee is vested in some person other than the applicant, a duly verified statement by that person that the applicant is author- ized by him to construct or maintain the trailer park and make the application),;; and such legal description of the premises upon which the trailer park is or will be located as will readily identify and definitely locate the premises. The application shall be accompanied by two copies of a plan of the park showing the following, either existing or as proposed: (1) The extent and area used for park purposes; (2) Roadways and driveways; (3) Location of trailer spaces; (4) Location and number of sanitary conveniences, including toilets, washrooms, laundries and utility rooms to be used by occupants of trailer spaces; (5) Method and plan of sewage disposal; (6) Method and plan of garbage removal; (7) Plan for water supply; (S) Plan for electrical lighting of park and electrical service to trailer spaces and other facilities. (c) Before such license may be issued, the premises and park plan must be inspected and approved by the Building Inspector or his duly authorized representative, as complying with all the provisions of this ordinance and all other applicable ordinances of the City of Wichita Falls. (d) Licenses issued under the terms of this ordinance convey no right to erect any building, to do any plumbing work, or to do any electrical work, SECTION 5. Location. (a) No trailer park shall be located in the Number One Fire Zone. (b) No trailer park shall be located within the limits of the City of Wichita Falls unless city water and city sanitary sewer connections and fire protection facilities are available. (c) No occupied trailer shall be located within less than fifteen feet of any other building or other trailer or vehicle or the boundary line of the tract on which located, except that trailers may be located not less than ten feet from the rear boundary line of the tract on which located when Per- mitted by the Building Inspector. In residential areas, no trailer may be located nearer the street than the legal front building line for the lot or tract upon which located. SECTION 6. Park Plan. (a) Every trailer shall be located on a well-drained area, free from marsh and heavy or dense growth or brush or weeds, and the premises shall be properly graded so as to prevent the accumulation of storm or other waters and so as to insure rapid drainage during and following rain. (b) Trailer spaces shall be clearly designated and the park so arranged that all trailer spaces shall abut on a driveway of not less than twenty feet in width, giving easy access from all trailer spaces to a public street or highway. Such driveway shall be paved to a standard at least equal to a two course asphalt penetration treatment and maintained in good condition, be well marked in the daytime and well lighted at night, and shall not be obstructed. All entrances and exits shall be well marked and so arranged that they will be easily controlled and supervised. 2 Ordinance # 2004 Cont'd. (c) very trailer space shall be fdrhished with s,n electric service outlet in compliance with the City of Wichita Falls Electrical Code. Such outlet shall be eruipped with an externally operated switch or fuse of not less than 30 amperes capacity, and a heavy duty cutlet receptacle. • SECTION`t 7. Water Supply. An adequate supply of potable ablutionary and culinary watery fur- nished through a pipe or distribution system meeting the recuirements of the City of Wichita Falls plumbing code and connected directly with the City water main, with supply outlet located at each trailer space shall be furnished. SECTION 3. Sewage and Refuse Disposal. (a) Waste from showers, bath tubs, flush toilets, urinals, lava- tories. slop sinks, and laundries in service and other buildings within the park shall be discharged into the public sewer system in compliance with appli= cable ordinances. (b) Each mobile home space shall be provided with a trapped sewer at least four inches in diameter, which shall be connected to receive the waste from the shower, bath tub, flush toilet, lavatory and kitchen sink of the mobile home harbored in such space and having any or all of such facilities. The trapped sewer in each space shall be connected to discharge the mobile home waste into the public sewer system in compliance with applicable ordinances. (c) Metal garbage cans shall be provided and shall have tight fitting covers and of not less than ten (10) gallons and not more than thirty (30) gallons capacity and shall be provided in ouantities adequate to permit disposal of all garbage and rubbish. Garbage cans shall be located not farther than two hundred (200) feet from any mobile home space. Garbage and rubbish shall be • collected and disposed of as frecuently as may be necessary to insure that the garbage cans shall not overflow and shall be in a sanitary condition at all times. SF':CTION 9. Sanitation Facilities. Each park containing dependent mobile homes shall be provided with toilets, baths or showers;, and other sanitation facilities which shall conform to the following reoui.rementso (a) Toilet facilities for males shall consist of not less than one (1) flush toilet and one (1) urinal for each fifteen (15) dependent mobile homes or any less number thereof. (b) Toilet facilities for females shall consist of not less than onc , flush toilet for each ten (10) dependent mobile homes or any less number thereof.. (c) Each sex shall be provided with not less than one (1) lavatory and one (1) shower with individual dressing accommodations for each ten (10) dependent mobile homes or any less number thereof. (d) Each toilet, and each shower with individual dressing accommoda- tions, shall be in a private compartment or stall. (e) The toilet and other sanitation facilities for males and females shall be either in separate buildings or shall be separated, if in the same building, by a soundproof wall. SECTION 10. Service Buildings. (a) Service buildings housing sanitation and laundry facilities; or any other such facilities; shall be permanent structures complying with all applicable ordinances and statutes regulating buildings, electrical installations and plumbing and sanitation systems. (b) The service buildings shall be well lighted at all times of the day and night, shall be well ventilated with screened openings, shall be con- structed of such moisture-proof material. including painted woodwork, as shall permit repeated cleaning and washing, and shall be maintained at a temperature of at least 70 degrees Fahrenheit during the period from October 1st to May 1st. The floors of the service buildings shall be of material impervious to water and shall slope to a floor drain or drains connected with the sewer system. 3 1 Ordinance # 2004,. 0ontd. (c) Service buildings housing sanitation facilities shall be located not closer than fifteen (15) feet nor farther than two hundred (200) feet from any mobile home space upon which a dependent mobile home is located. (d) All service buildings and the grounds. of the park shall be maintained in a clean, sightly_condition and kept free of any condition tending to menace the health of any occupant or the public or constitute a nuisance. SECTION 11. Fuels. Liquefied petroleum gas for cooking and heating purposes shall not be used at individual mobile home spaces unless the containers are properly connected by copper or other suitable metallic tubing. Liquefied petroleum gas cylinders shall be securely fastened in place, and adequately protected from the weather. No cylinder containing liquefied petroleum gas shall be located in a mobile home: nor within five (5) feet of ingress and egress thereof. All such installations shall comply with all applicable ordinanecz of the City of Wichita Falls. SECTION 12. Registration. (a) Each trailer park shall be under the direct management of the owner or his agent or representative for whose acts he or they shall be fully responsible. (b) The name of the person entrusted with the direct management of the camp shall be filed for reference with the Building Inspector and with the Police Department of the City of Wichita Falls. Such person or persons must be of good reputation and character and shall satisfy the public authority as to their experience and capacity to supervise, manage, regulate, control and main- tain good order. SECTION 13. management. (a) In every trailer park there shall be an office building in which shall be located the office of the person in charge .of said park. A copy of the park license and of this ordinance shall be posted therein and the park register shall at all times be kept in said office. (b) It is hereby made the duty of the attendant or person in charge, together with the licensee to (1) Keep at all times a register containing a record of all mobile home owners and occupants located within the park. The register shall contain the following information. (a) The name and address of each mobile home occupant; (b) The name and address of the owner of each mobile home and motor vehicle by which it is towed; (c) The make, model year, and license number of each mobile home and motor vehicle; (d) The state, territory, or country issuing such licenses; (e) The date of arrival and of departure of each mobile home; (f) Whether or not each mobile home is a dependent or independent mobile home. (g) The gross floor area and nominal dimensions of the mobile home. The park shall keep the register available for inspection at all times by law enforcement officers, public health officials, and other public officials whose duties necessitate acquisition of the informa- tion contained in the register. The register record 4 • • Ordinance #2004, Conttd. for each occupant registered shall not be destroyed for a period of three years following the date of departure of the registrant from the parka (2) Maintain the park in a clean, orderly and sanitary condition at all times. (3) See that the provisions of this ordinance are com- plied with and enforced and report promptly to the proper authorities any violation of this ordinance or any other violations of law which may come to his attention. (4) Report to the City Health Officer all cases of persons or animals infected or suspected of being infected with any communicable disease. (5) Prevent the running loose of dogs, cats or other animals or pets. (6) Maintain in convenient places, approved by the Fire Department, hand fire extinguishers in the ratio of not less than one to each four trailer spaces. Fire extinguishers shall comply with all ordinances of the City of Wichita Falls pertaining thereto. (7) Prohibit the lighting of open fires on the premises. (4) Prohibit the use of any trailer by a greater number of occupants than that which it is designed to accommodate. SECTION 14. Revocation and Suspension. The Building Inspector and City Health Officer are each hereby authorizc:d. to revoke any license issued pursuant to the terms of this ordinance if after due investigation he determines that the holder thereof has violated any of the provisions of this ordinance or that any trailer park is being main- tained in an unsanitary or unsafe manner or is a nuisance. SECTION 15. Non-conforming Trailers and Trailer Parks. (a) Any trailer parked, used, or occupied outside a trailer park as specified in Section 3 hereof on the date of passage of this ordinance shall be considered a non-conforming trailer. Such trailer shall: not be eligible for the issuance of any permit for work thereon under the building, plumbing, or electri- cal codes of the City of Wichita Falls and no work on such trailers requiring such a permit shall be performed. A non-conforming trailer shall be made to conform to the provisions of this ordinance within three years from the date of passage of said ordinance; any trailer not conforming thereto within three years of passage thereof shall be in violation of said ordinance and shall suffer the penalties provided herein. (b) Any trailer park in use and/or existence on the date of passage of this ordinance and not complying with all applicable provisions of said ordinance shall be considered a non-conforming trailer park. Such non-conforming trailer park shall be made to comply with all provisions of this ordinance within three (3) years of date of passage of said ordinances and shall be re- cuired to make substantial improvements toward conformance with said ordinance each of the three years subsequent to date of passage of said ordinance. If at the end of any of the three years subsequent to passage of this ordinance sub- stantial progress toward conformity with this ordinance has not been made in the opinion of the Building Inspector and/or City Health Officer, the license for such trailer park shall be revoked immediately and shall not be re-issued nor new license issued until and unless such trailer park shall conform to the provisions of this ordinance in every respect. Any trailer park not complying with all pro- visions of this ordinance in every respect within (3) years of the date of passage of said ordinance shall have the license therefor revoked and shall not be issued a new license until and unless such trailer park shall conform to the provisions of this ordinance in every respect. SECTION 16. Penalties for Violation of Ordinance. Two Hundred Dollars ($200) maximum, with each day of operation in violation constituting a separate offense. 5 1 w rc1 2-.)''' SECTION 17 Separability and Conflict If any section, subsection, sentence, clause, phrase or portion of :', his ordinance is for any reason held invalid or unconstitutional by any court f competent jurisdiction; such portion shall be deemed a separate, distinct and ind,,pendent provision and such holding shall not affect the val idity of the remaining portions thereof.
